The campus climate literature obscures the complexity of individuals’ perspectives in relation to multiple dimensions of the broader learning environment. Unexamined are the ways students from marginalized backgrounds may respond to oppressive dimensions of the campus climates in unique ways that moderate observed outcome differences. Religion And Support For Political Violence Among Christians And Muslims In Africa, Amy Adamczyk, Gary Lafree

Researchers have found consistently that religion reduces criminal behavior. Yet rising levels of political violence are frequently attributed to a new wave of religious terrorism. Our study seeks to reconcile this apparent discrepancy by studying the attitudes of people living in 34 African nations. Using data from the Afrobarometer survey and mixed modeling, we examine the influence of individual and collective religiosity for shaping civic engagement and willingness to engage in political violence. While individual religiosity decreases support for violent political action, collective religiosity increases it. The effects of religiosity are the same for Muslims and Christians and the country …

Psychological sense of community (SOC) has been examined minimally among the youth of color, and as a mediating variable, as well as construct implicated in promoting wellness. Using data from a sample of 401 students of color (M age = 16.55, standard deviation = 1.31; 54.7% female; 57% Hispanic/Latina[o]) from an underserved northeastern US urban community, we examined the mediating relationship of psychological SOC between social support, participation in youth-based community programs, and outcomes including school belongingness, risk behaviors such as substance use and violent behavior, and psychological symptoms, including depression. As a discipline of crisis and care, environmental communication needs to address questions of environmental justice. This article argues that the most appropriate approach to studying environmental justice communication is engaged scholarship, in which academics collaborate with community partners, advocates, and others to conduct research. The article reviews prior engaged communication scholarship on environmental justice, and proposes four streams of future research, focused on news and information, deliberation and participation, campaigns and movements, and education and literacy.

Nature-based expressive arts therapy promotes the holistic healing and recovery of individuals by interweaving the practices of ecopsychology, ecotherapy, and expressive arts therapy. These interventions have been proven to mediate ranges of symptomologies, such as anxiety disorders and PTSD. Research conducted by the U.S. National Park Services indicates that African- Americans are less likely to have a positive relationship to nature than all other racial groups. The amplification of this report without introspection of its context perpetuates racialized generalizations. Using intersectionality theory as a theoretical framework, this qualitative study uncovered the protective factors present among black and Hispanic adolescent girls living in an urban, underresourced neighborhood in the Northeastern United States. The sample used in this study includes eight focus groups that consisted of adolescent females only (N = 57). Female participants were sampled through six youth-serving summer programs throughout the target city. The female participants were between 11 and 17 years of age, with 73% self-identifying as black (n = 45) and 26% (n = 12) as Hispanic. Adolescents of color in urban communities are at high risk for contracting HIV, unlikely to have access to HIV testing services, or any other form of screening services. Using latent class analysis among a sample of African American/Black (48.1%) and Hispanic/Latina(o) (42%) youth (N = 668; Mage = 16.30; 51% female), this study examined the association cluster group membership, based on sexual negotiation skills and risk behavior, had on HIV knowledge, perception of risk, and the number of sexual partners. Five distinct cluster groups emerged, with significant heterogeneity observed between cluster groups on select dependent variables. A larger proportion of …

งานวิจัยนี้ มีวัตถุประสงค์เพื่อศึกษาปัจจัยที่เกี่ยวข้องกับการแปลงเปลี่ยนพฤติกรรมและความสำเร็จในการกลับคืนสู่สังคมของผู้เคยเป็นนักโทษสู่การเป็นนักกีฬาอาชีพ ศึกษาแนวทางการใช้กีฬาเพื่อฟื้นฟูผู้กระทำผิดและลดการกระทำผิดซ้ำ ใช้วิธีศึกษาเชิงคุณภาพโดยการค้นคว้าข้อมูลจากเอกสารทางวิชาการที่เกี่ยวข้องและการสัมภาษณ์แบบเจาะลึก เลือกกลุ่มตัวอย่างด้วยวิธีการเฉพาะเจาะจง โดยการศึกษาแบบกรณีศึกษา กลุ่มผู้ให้ข้อมูลสำคัญของการศึกษาวิจัยเชิงคุณภาพของการศึกษาวิจัยเรื่องนี้ คือ นักกีฬาอาชีพผู้ซึ่งเคยเป็นนักโทษ ผู้ทรงคุณวุฒิในระดับนโยบาย ผู้บริหารค่าย/สโมสรที่นักกีฬาสังกัดอยู่ และเพื่อนร่วมงานรวมถึงผู้ใกล้ชิด รวมทั้งสิ้น 22 ราย เครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูลคือแบบสัมภาษณ์ วิเคราะห์ข้อมูลโดยพรรณนาเชิงวิเคราะห์เนื้อหา ผลการวิจัยพบว่า ปัจจัยที่เกี่ยวข้องกับการแปลงเปลี่ยนพฤติกรรมและความสำเร็จในการกลับคืนสู่สังคม ประกอบด้วย 1) แรงจูงใจ ประกอบด้วย แรงจูงใจภายนอก คือการมีเป้าหมายในความสำเร็จ การได้รับโอกาส การเป็นที่ยอมรับ การได้รับการยกย่องว่าเป็นแบบอย่าง การมีรายได้ที่เพียงพอในการดูแลครอบครัวและใช้จ่ายส่วนตัว และแรงจูงใจภายในประกอบด้วย การรับรู้ในความสามารถตนเอง ความรู้สึกว่ามีคุณค่า และความกลัวที่ต้องกลับไปรับโทษหากกระทำผิดซ้ำ 2) สภาพแวดล้อมที่ดีทางสังคม คือ ครอบครัวและเพื่อน 3) การฟื้นฟูและแก้ไขผู้กระทำผิดจากในเรือนจำ คือ การปรับเปลี่ยนทัศนคติและพฤติกรรมในระหว่างการรับโทษด้วยการใช้กีฬา โดยกรมราชทัณฑ์ได้ใช้กีฬาเพื่อฟื้นฟูผู้กระทำผิดซ้ำ เสริมสร้างสมรรถภาพร่างกาย พัฒนาด้านจิตใจ ส่งเสริมระเบียบวินัย รวมถึงมีการสนับสนุนนักโทษที่มีความสามารถในกีฬาเฉพาะด้าน ให้เข้ารับการแข่งขันในรายการต่าง ๆ ตลอดจนโครงการด้านกีฬาจากภาครัฐและเอกชนที่ให้ความร่วมมือในการสร้างโอกาสในการกลับคืนสู่สังคม

การวิเคราะห์บทบาทและการทำหน้าที่ “คนกลาง” ในกระบวนการยุติธรรมเชิงสมานฉันท์, มณีรัตน์ ชื่นเจริญ

จากผลการศึกษาพบว่าสภาพปัญหาและอุปสรรคในการทำหน้าที่ของคนกลางภายในหน่วยงานของกระบวนการยุติธรรมในสังคมไทยนั้นเกิด คนกลางยังขาดความรู้ความเข้าใจในหลักการพื้นฐานของกระบวนการยุติธรรมอย่างแท้จริง ในด้านบุคลากรปฏิบัติงานนั้นพบปัญหาในเรื่องคุณสมบัติ เทคนิค ทักษะ การสมัครใจ และความเป็นกลางของคนกลาง การมีบุคลากรที่ไม่เพียงพอ และค่าตอบแทนของบุคลากรในการปฏิบัติงานยังไม่เหมาะสม ในส่วนของปัญหาและอุปสรรคด้านกระบวนการและการบริหารจัดการในการดำเนินงานนั้นหากคนกลางไม่เตรียมความพร้อมก่อนเข้าสู่กระบวนการและในระหว่างการดำเนินการไม่สามารถควบคุมสถานการณ์ความขัดแย้งที่เกิดขึ้นได้ก็จะทำให้กระบวนการฯ ไม่สำเร็จ ส่วนทางด้านปัญหาและอุปสรรคด้านนโยบายนั้นพบว่าขาดนโยบาย แนวทาง การติดตามประเมินผลและแรงจูงใจในการปฏิบัติงานที่ต่อเนื่อง ส่วนผลการวิเคราะห์เปรียบเทียบการทำหน้าที่ของคนกลางในกระบวนการยุติธรรมเชิงสมานฉันท์ระหว่างหน่วยงานกระบวนการยุติธรรมของสังคมไทยและหลักการพื้นฐานฯ ขององค์การสหประชาชาติพบว่าการทำหน้าที่ของคนกลางนั้นมีความสอดคล้องกับหลักการพื้นฐานฯ โดยคนกลางจะมีบทบาทและทำหน้าที่เป็นผู้อำนวยความสะดวกในการเตรียมการประชุม ดำเนินการประชุม ทำการประเมินและตอบสนองต่อความต้องการของแต่ละฝ่าย พร้อมทั้งพัฒนาและดำเนินการตามแผนลดความเสี่ยง และปฏิบัติต่อผู้เข้าร่วมอย่างเป็นธรรม บริหารจัดการเวลาให้เพียงพอสำหรับกระบวนการเพื่อให้ประสบความสำเร็จ และมีการติดตามผลทั้งกับผู้กระทำความผิดเพื่อให้มั่นใจว่าได้ปฏิบัติตามข้อตกลงแล้ว และกับผู้เสียหายว่าได้รับการชดใช้เยียวยาตามข้อตกลง ในส่วนของข้อเสนอแนะและแนวทางที่เหมาะสมในการทำหน้าที่คนกลางในกระบวนการยุติธรรมเชิงสมานฉันท์นั้นพบว่าคนกลางควรมีองค์ความรู้และเข้าใจในหลักการอย่างแท้จริง และควรให้มีการเพิ่มบุคลาการปฏิบัติงาน พร้อมทั้งจะต้องผ่านการฝึกอบรม เทคนิค และทักษะ รวมทั้งจะต้องมีนโยบายอย่างต่อเนื่องในการให้ความสำคัญและการใช้กระบวนการยุติธรรมเชิงสมานฉันท์

This Article briefly considers the origins of the term social justice and its evolution beside our understandings of human rights and liberalism, which are two other significant justice categories. After this reflection on the contemporary meaning of social justice, I suggest that vulnerability theory, which seeks to replace the rational man of liberal legal thought with the vulnerable subject, should be used to define the contours of the term. การศึกษาวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาลักษณะ รูปแบบ สภาพปัญหาและสาเหตุของอาชญากรรมที่ใช้บิทคอยน์ในฐานะสกุลเงินเข้ารหัสเป็นเครื่องมือ ตลอดจนศึกษาแนวนโยบาย กฎหมายและมาตรการต่างๆที่เกี่ยวข้องกับสกุลเงินเข้ารหัสทั้งในประเทศไทยและต่างประเทศ เพื่อเสนอแนวทางการป้องกันอาชญากรรมที่เกี่ยวกับสกุลเงินเข้ารหัสในประเทศไทยได้อย่างเหมาะสม การศึกษาวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพด้วยการศึกษาจากเอกสารและการวิจัยภาคสนามโดยการเก็บข้อมูลจากผู้ให้ข้อมูลสำคัญ ผลการศึกษาพบว่าปัจจุบันมีการนำบิทคอยน์ไปใช้เป็นเครื่องมือในการก่ออาชญากรรมโดยตรงด้วยการนำไปใช้เป็นสื่อกลางในการกระทำความผิดในรูปแบบต่างๆ ได้แก่ การซื้อขายแลกเปลี่ยนสินค้าและบริการที่ผิดกฎหมาย การฟอกเงินและการสนับสนุนเงินทุนให้กลุ่มผู้ก่อการร้าย และการนำไปใช้เป็นเครื่องมือในทางอ้อมด้วยการนำเอาชื่อของบิทคอยน์ไปหลอกลวงฉ้อโกงในลักษณะคล้ายกันกับแชร์ลูกโซ่ โดยมีสภาพปัญหาและสาเหตุจากลักษณะพิเศษต่างๆของบิทคอยน์ที่เอื้อต่อการนำไปใช้ในการก่ออาชญากรรม โดยเฉพาะคุณสมบัติที่ไม่มีการเปิดเผยตัวตนผู้ใช้งาน สภาพปัญหาและสาเหตุจากกฎหมาย ได้แก่ สถานภาพทางกฎหมายที่ไม่ชัดเจนของบิทคอยน์ กฎหมายที่เกี่ยวข้องยังไม่สามารถใช้ป้องกันการนำบิทคอยน์ไปใช้ในการกระทำผิดได้ ปัญหาในด้านการตีความกฎหมายที่ขัดแย้งกันเกี่ยวกับการเก็บพยานหลักฐานทางอิเล็กทรอนิกส์ และการขาดกฎหมายที่บัญญัติหลักเกณฑ์และวิธีการในการยึดและอายัดบิทคอยน์ รวมทั้งสภาพปัญหาและสาเหตุจากการบังคับใช้กฎหมายที่เจ้าหน้าที่ที่เกี่ยวข้องยังขาดองค์ความรู้ วิธีการ และเครื่องมือหรือกลไกต่างๆ ทั้งยังขาดการบูรณาการร่วมกันทั้งจากหน่วยงานของรัฐ ภาคเอกชนและความร่วมมือระหว่างประเทศ และจากการศึกษาแนวนโยบาย กฎหมายและมาตรการต่างๆที่เกี่ยวข้องพบว่าแต่ละประเทศมีทิศทางการกำหนดนโยบายที่แตกต่างกันทั้งรูปแบบของการยอมรับ กึ่งยอมรับกึ่งควบคุม และปฏิเสธบิทคอยน์และสกุลเงินเข้ารหัสต่างๆขึ้นอยู่กับแนวคิดทางการเมือง สภาพเศรษฐกิจและวัฒนธรรมของประเทศนั้นๆ ทั้งนี้ ประเทศไทยควรมีการกำหนดมาตรการในการยืนยันตัวตนผู้ใช้งาน กำหนดหลักปฏิบัติในการเก็บรวบรวมพยานหลักฐานทางอิเล็กทรอนิกส์ที่ชัดเจน บัญญัติหลักกฎหมายเกี่ยวกับการยึดและอายัดสกุลเงินเข้ารหัส ส่งเสริมให้มีการศึกษาวิจัยและพัฒนาองค์ความรู้ เครื่องมือ และกลไกต่างๆ การสร้างความร่วมมือระหว่างหน่วยงานภาครัฐและภาคเอกชนและหน่วยงานระหว่างประเทศ รวมทั้งการผลักดันให้มีการพัฒนาสกุลเงินดิจิทัลแห่งชาติ และการสร้างความรับรู้ให้แก่ประชาชนในประเด็นที่เกี่ยวข้องกับอาชญากรรมที่เกี่ยวกับสกุลเงินเข้ารหัส

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาความสัมพันธ์ระหว่างมนุษย์และสัตว์ในมิติต่างๆของสังคมโดยเฉพาะกับสัตว์เศรษฐกิจ จนนำไปสู่การปฏิบัติต่อสัตว์ในโรงฆ่าของมนุษย์ ซึ่งพบว่ามีปัญหาตั้งแต่การเลี้ยงสัตว์ในฟาร์ม การขนส่ง และกระบวนการฆ่าสัตว์ในโรงฆ่า โดยเฉพาะในโรงฆ่าที่มีปัญหาตั้งแต่สภาพอาคารโรงฆ่าที่สกปรก เครื่องมือไม่ได้มาตรฐาน การดูแลสัตว์ก่อนการเข้าฆ่าที่พนักงานไม่มีความรู้ความเข้าใจที่ดีพอ และวิธีการฆ่าที่ใช้วิธีการทำให้สัตว์สลบโดยใช้ค้อนทุบที่ศีรษะของสัตว์ ซึ่งปัญหาส่วนใหญ่จะเกิดขึ้นในโรงฆ่าขนาดเล็ก ที่มีปัญหาทั้งด้านสุขอนามัยและด้านสวัสดิภาพสัตว์ นอกจากนี้ยังมีปัญหาด้านการตรวจสอบและการบังคับใช้กฎหมายของเจ้าหน้าที่รัฐ ที่ไม่สามารถตรวจสอบขั้นตอนในการฆ่าของโรงฆ่าสัตว์ได้อย่างทั่วถึง รวมถึงข้อกฎหมายที่ยังมีช่องโหว่ในการปฏิบัติต่อสัตว์ ส่งผลให้สัตว์เศรษฐกิจในโรงฆ่านี้ยังไม่ได้รับความคุ้มครองที่ดีพอโดยมีแนวคิดและทฤษฎีเป็นฐานเครื่องมือในการอธิบายถึงความสัมพันธ์และการปฏิบัติต่อสัตว์ของมนุษย์ เป็นการวิจัยเชิงคุณภาพ ซึ่งใช้วิธีการรวบรวมข้อมูลจากเอกสาร การสัมภาษณ์ และการสังเกตการณ์ ซึ่งพื้นที่ในการศึกษาจะศึกษาเฉพาะการปฏิบัติต่อสัตว์ในโรงฆ่าเท่านั้น จากการศึกษาพบว่า ความสัมพันธ์ของมนุษย์กับสัตว์ที่เกิดขึ้นในบริบทต่างๆของสังคม มีความเกี่ยวพันกับ ศาสนา เศรษฐกิจ วัฒนธรรม และกฎหมาย จนนำไปสู่วิธีการปฏิบัติต่อสัตว์แต่ละประเภท ซึ่งในวิทยานิพนธ์ฉบับนี้มุ่งเน้นที่จะศึกษาความสัมพันธ์ของมนุษย์และสัตว์ในสังคมโดยจะมุ่งเน้นไปที่สัตว์เศรษฐกิจจนนำไปสู่การปฏิบัติต่อสัตว์ในโรงฆ่าที่เป็นปัญหา ข้อเสนอแนะในการวิจัยครั้งนี้ คือให้รัฐสนุบสนันผู้ประกอบการรายย่อยด้านอุปกรณ์ สถานที่ และเครื่องมือให้มีมาตรฐานที่ดีขึ้น ปรับแก้บทลงโทษให้มีรายละเอียดและบทลงโทษที่มากขึ้น และประชาสัมพันธ์ให้ประชาชนทั่วไปมีการตื่นตัวต่อชีวิตสัตว์ในโรงฆ่า การศึกษาในครั้งนี้จึงคาดหวังที่จะให้ผู้ที่มีส่วนเกี่ยวข้อง เช่น ผู้ประกอบการโรงฆ่าสัตว์ เจ้าหน้าที่ของรัฐ รวมถึงประชาชน ได้ตระหนักถึงคุณค่าในชีวิตของสัตว์ทุกชีวิตและคาดหวังให้มีการตื่นตัวในการรณรงค์ให้มีการฆ่าสัตว์ให้ถูกต้องตามหลัก

การศึกษาเรื่อง แนวทางการพัฒนาระบบฐานข้อมูลการขึ้นทะเบียนผู้กระทำผิดทางเพศและการแจ้งเตือนต่อสาธารณชนของสำนักงานตำรวจแห่งชาติ มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหา สาเหตุ และลักษณะเฉพาะของการกระทำผิดทางเพศ รวมถึงมาตรการป้องกันปราบปรามการกระทำผิดทางเพศที่มีอยู่ในปัจจุบัน ศึกษาหลักการ แนวคิด รูปแบบ และวิธีการนำระบบขึ้นทะเบียนผู้กระทำผิดทางเพศและการแจ้งเตือนต่อสาธารณชนมาใช้ในการป้องกันและปราบปรามการกระทำผิดทางเพศ ที่ได้ดุลยภาพระหว่างการป้องกันปราบปรามอาชญากรรมกับสิทธิเสรีภาพของผู้มีส่วนเกี่ยวข้อง เพื่อให้ทราบแนวทางในการที่จะนำ “การขึ้นทะเบียนผู้กระทำผิดทางเพศและการแจ้งเตือนต่อสาธารณชน” มาใช้พัฒนาฐานข้อมูลการกระทำผิดทางเพศในกระบวนการยุติธรรมของไทยให้มีประสิทธิภาพยิ่งขึ้น ใช้วิธีการวิจัยเชิงคุณภาพ โดยการค้นคว้าเอกสารวิชาการ กฎหมาย และระเบียบต่างๆ ประกอบกับการเก็บรวบรวมข้อมูลจากการสัมภาษณ์เชิงลึกและการสนทนากลุ่ม เพื่อวิเคราะห์ข้อมูลและหาแนวทางสรุป ผลการวิจัยพบว่า การกระทำผิดทางเพศเป็นพฤติกรรมเบี่ยงเบนทางเพศ เกิดขึ้นจากความผิดปกติทางจิตใจ หากไม่ได้รับการรักษาหรือดำเนินการอย่างเหมาะสม จะทำให้มีความเสี่ยงที่จะกระทำผิดทางเพศซ้ำเมื่อกลับเข้ามาสู่สังคมได้ ซึ่งในต่างประเทศ เช่น สหรัฐอเมริกา สหราชอาณาจักร ประเทศฝรั่งเศส และอีก 27 ประเทศ มีระบบการขึ้นทะเบียนผู้กระทำผิดทางเพศและการแจ้งเตือนต่อสาธารณชน เป็นมาตรการหนึ่งในการดำเนินการกับผู้กระทำผิดทางเพศเพื่อป้องกันไม่ให้เกิดการกระทำผิดทางเพศซ้ำ แต่ประเทศไทยยังไม่มีมาตรการดังกล่าว ดังนั้น ผู้วิจัยเห็นว่าประเทศไทยควรตรากฎหมายในการขึ้นทะเบียนผู้กระทำผิดทางเพศและการแจ้งเตือนต่อสาธารณชนขึ้นเพื่อให้การป้องกันปราบปรามการกระทำผิดทางเพศในประเทศไทยเป็นไปอย่างมีประสิทธิภาพยิ่งขึ้น โดยกำหนดให้กองทะเบียนประวัติอาชญากร สำนักงานตำรวจแห่งชาติเป็นหน่วยงานในการจัดเก็บและบริหารข้อมูล มีการบูรณาการข้อมูลผู้กระทำผิดทางเพศกับฐานข้อมูลทะเบียนประวัติอาชญากรเดิม แบ่งประเภทผู้กระทำผิดทางเพศตามความรุนแรงของการกระทำผิด และกำหนดระยะเวลาการขึ้นทะเบียน 5 ปี 15 ปี และ 25 ปี ตามลำดับ สำหรับการเปิดเผยข้อมูล ผู้วิจัยกำหนดให้มีการเปิดเผยข้อมูลผู้กระทำผิดทางเพศที่มีความรุนแรงและกระทำต่อเหยื่อที่เป็นเด็กเท่านั้น เพื่อรักษาดุลยภาพของความปลอดภัยของสมาชิกในสังคมโดยรวมและสิทธิ เสรีภาพของผู้กระทำผิดทางเพศ โดยผู้วิจัยได้กำหนดให้มี การจำกัดถิ่นที่อยู่ การจำกัดอาชีพ และการควบคุมการเดินทางระหว่างประเทศด้วย อันเป็นการเพิ่มความปลอดภัยในสังคม และประสิทธิภาพการป้องกันการกระทำผิดทางเพศ

การบังคับสูญหายในประเทศไทย: ประสบการณ์และมุมมองในเชิงกฎหมายและกระบวนการยุติธรรมทางอาญา, ปณิธาน พิมลวิชยากิจ

การศึกษาเรื่อง “การบังคับสูญหายในประเทศไทย: ประสบการณ์และมุมมองในเชิงกฎหมายและกระบวนการยุติธรรมทางอาญา” มีวัตถุประสงค์เพื่อศึกษาประสบการณ์ในเชิงกฎหมายและกระบวนการยุติธรรมทางอาญา รวมถึงมุมมองหรือทัศนคติของผู้ให้ข้อมูลสำคัญต่อปัญหาการบังคับสูญหายในประเทศไทย สำหรับการศึกษาครั้งนี้เป็นการวิจัยเชิงคุณภาพด้วยเทคนิคการสัมภาษณ์เชิงลึก ซึ่งเป็นการเก็บรวบรวมข้อมูลจากผู้ให้ข้อมูลสำคัญจำนวน 3 กลุ่ม ได้แก่ ผู้แทนจากหน่วยงานที่เกี่ยวข้อง ผู้เชี่ยวชาญทางด้านกฎหมาย และสมาชิกครอบครัวของผู้สูญหาย โดยผลการศึกษาพบว่า การบังคับสูญหายในประเทศไทยอยู่ในสภาวะที่ไม่มีบทกฎหมายฉบับใดกำหนดคำนิยามและกำหนดว่ามีความผิด จึงส่งผลให้เกิดปัญหาด้านบทบัญญัติทางกฎหมาย กล่าวคือสังคมไทยไม่เข้าใจถึงความหมายของการบังคับสูญหายอย่างถ่องแท้ และส่งผลให้การบังคับสูญหายไม่มีสถานะเป็นอาชญากรรม ดังนั้นจึงทำให้มีการนำกฎหมายอื่นที่ระบุถึงฐานความผิดที่เกี่ยวข้องซึ่งยังมีอัตราโทษที่ไม่เหมาะสมมาบังคับใช้แทน นอกจากนี้ยังส่งผลให้เกิดปัญหาทางด้านกระบวนการยุติธรรมทางอาญา เช่น การสืบสวนสอบสวนที่ไม่น่าเชื่อถือ การที่ครอบครัวของผู้สูญหายไม่สามารถมีส่วนร่วมในกระบวนการยุติธรรม หรือการช่วยเหลือเยียวยาที่ไม่มีหลักเกณฑ์ที่ชัดเจนและเหมาะสมกับความเสียหายที่เกิดขึ้น ดังนั้น รัฐบาลจึงควรบังคับใช้กฎหมายสำหรับการบังคับสูญหายเป็นการเฉพาะ เพื่อทำให้เกิดกระบวนการแก้ไขปัญหาการบังคับสูญหายอย่างเหมาะสมและมีประสิทธิภาพ รวมทั้งกำหนดมาตรการอื่น เช่น การช่วยเหลือเยียวยาด้านการเงินแก่ครอบครัวผู้สูญหายในระหว่างการดำเนินคดี การจัดตั้งกลุ่ม/เครือข่ายสำหรับกรณีปัญหาการบังคับสูญหายโดยเฉพาะ เป็นต้น

การศึกษามาตรการความมั่นคงปลอดภัยทางไซเบอร์ต่อสถาบันการเงิน, ปรมัตถ์ ไวรักษ์

วิทยานิพนธ์นี้มีวัตถุประสงค์เพื่อศึกษาบทบาทของธนาคารกลางของไทยในการกำกับดูแลสถาบันการเงินต่อการบังคับใช้มาตรการความมั่นคงปลอดภัยไซเบอร์และศึกษาถึงแนวทางการสร้างความร่วมมือระหว่างกลุ่มสถาบันการเงิน โดยใช้รูปแบบการวิจัยเชิงคุณภาพ เก็บข้อมูลด้วยเทคนิคการวิจัยเอกสารร่วมกับการสัมภาษณ์เชิงลึก จากกลุ่มตัวอย่าง 3 กลุ่ม แบ่งเป็น ผู้ปฏิบัติงานในด้านเทคโนโลยีสารสนเทศกลุ่มสถาบันการเงิน ผู้ปฏิบัติงานจากสายงานกระบวนการยุติธรรมหรือสายกฎหมาย และผู้เชี่ยวชาญอิสระด้านการจัดการความมั่นคงปลอดภัยทางไซเบอร์ ผลการศึกษา พบว่า 1) บทบาทที่สำคัญของธนาคารกลางของไทย คือ การวางกรอบแนวทางการรับมือภัยคุกคามไซเบอร์ โดยมีการกำหนดเป็นมาตรการและนโยบายต่าง ๆ ร่วมกับการตรวจสอบกำกับดูแล และการเผยแพร่ความรู้ให้แก่ภาคประชาชน 2) ธนาคารกลางของไทยมีการสร้างความร่วมมือกับกลุ่มสถาบันการเงินและองค์กรอื่น ๆ ทั้งภายในประเทศและต่างประเทศ เพื่อแบ่งปันข้อมูลข่าวสารด้านภัยคุกคามทางไซเบอร์ที่เกิดขึ้น ซึ่งจะก่อให้เกิดทักษะความรู้ใหม่ ๆ ในการร่วมมือกันแก้ปัญหาภัยคุกคามไซเบอร์ ข้อเสนอแนะจากการศึกษานี้สามารถแบ่งได้เป็น 2 ด้าน คือ ด้านการปฏิบัติการ สถาบันการเงินควรมีการฝึกซ้อมรับมือภัยคุกคามทางไซเบอร์ ไปพร้อมกับการสร้างความตระหนักรู้ให้แก่ภาคประชาชนในเชิงรุก รวมทั้งสร้างเครือข่ายด้านเทคโนโลยีสารสนเทศในภาคการเงิน ด้านการออกนโยบาย เสนอให้เพิ่มบทลงโทษสถาบันการเงินจากการไม่ปฏิบัติตามมาตรการที่บังคับใช้ และเสนอให้มีการสร้างความร่วมมือกับภาครัฐปรับหลักสูตรการเรียนการสอนให้มีบทเรียนเกี่ยวกับภัยคุกคามไซเบอร์และมาตรการความมั่นคงปลอดภัยทางไซเบอร์
