The Role Of Recognition In Kelsen's Account Of Legal Obligation And Political Duty, David Ingram

Philosophy: Faculty Publications and Other Works

Kelsen’s critique of absolute sovereignty famously appeals to a basic norm of international recognition. However, in his discussion of legal obligation, generally speaking, he notoriously rejects mutual recognition as having any normative consequence. I argue that this apparent contradiction in Kelsen's estimate regarding the normative force of recognition is resolved in his dynamic account of the democratic generation of law. Democracy is embedded within a modern political ethos that obligates legal subjects to recognize each other along four dimensions: as contractors whose mutually beneficial cooperation measures esteem by fair standards of contribution; as autonomous agents endowed with equal rights; as …

The mindfulness community prioritizes self-awareness and common humanity, but is often entrapped by the idea that oneness is equivalent to sameness. This inclination for objectivity is rooted in the same neural propensities that facilitate bias; the brain is a subjective organ, however, and so neurologically speaking, bias is inevitable. This paper asks: Is striving for sameness separating us from interconnectedness? A human experience is a subjective, diverse, and variable one. This exploratory study examined how racism and sexism among privileged White men intersect and vary to influence factors associated with sexual violence (SV) perpetration. Specifically, this study examined the interconnection of racism and sexism via latent profile analysis (LPA), how profile groups differentially predict attitudinal responses to a victim in an acquaintance rape SV vignette regarding victim blame and rape minimization (e.g., rape myth acceptance), rape proclivity, and bystander intentions to help, and whether or not these attitudes change based on the victim’s race (i.e., White or Black). This dissertation thesis examines the lived experiences, life stories, and storytelling of five Afro-Caribbean and Latina people, who are all local from the borough of Queens, alumni of New York City’s public schools, and since then, became their local public school teachers, classroom practitioners, and local community teachers. We refer to this specific and unique population of teachers as alumni-community teachers and to these and other similar stories as teacher life stories.

Feminist movements have taken on various iterations since they first began, particularly as the movements expanded beyond predominantly Western and white spaces. This research study explores how gender equality is perceived and navigated along the U.S.-Mexico border area, taking into account the various Latin American and U.S. feminist developments that have shaped the current landscape of the border. 11 Mexican and Mexican-American women living in U.S.-Mexico border states were interviewed to gain an understanding of their definitions, perceptions, and opinions on feminism and gender-related issues given their bicultural contexts. Adverse birth outcomes for both the parent and the child disproportionately affect people of color. Evidence demonstrates that one of the ways to mitigate these negative consequences is through the utilization of a doula, a trained birth companion that is not a medical provider but whose role it is to physically and emotionally support the patient through pregnancy, birth, and postpartum. In this paper, we utilize duoethnography - a research method in which practitioners discursively interrogate the relationships between culture, context, and the mechanisms which shape individual autobiographical experiences - to explore what may be beyond ethics in the context of data science. Although ethical frameworks have the ability to reflect cultural priorities, a singular view of ethics, as we explore, often fails to speak to the multiple and diverse priorities held both within and across institutional spaces. Addressing the urgent issues facing humanity today, in his recent encyclical on social friendship, Fratelli Tutti, Pope Francis reminds us that it is “all the more urgent that we rethink our styles of life, our relationships, the organization of our societies and, above all, the meaning of our existence” (no. 33). In this and in his previous encyclical on care for creation, Laudato Si’, Francis makes clear that we do not have a moment to waste. None of his diagnosis should “be read as a cool and detached description of today’s problems” (no. 56).

There is a growing body of literature on the experiences of African American/Black sign language interpreters (Carpenter, 2017; West Oyedele, 2015), but still many challenges faced by this community in the field. For example, many experience isolation in their interpreter education programs and later in the field, and they described the programs they attended as White-centric and oppressive (Carpenter, 2017; Cokey & Schafer, 2016; West Oyedele, 2015). To understand their experiences better, a qualitative study was conducted which involved interviewing ten African American/Black interpreters. The findings indicated many barriers in the field, including racism and discrimination in systems of networking. …

Low-income women and women of color experience adverse birth outcomes at disproportionately higher rates in the United States than most people who give birth. This thesis examines individual interviews conducted with 30 low-income women whose most recent birth was covered by Medicaid, the United States’ largest means-tested public health insurance program. The aim of this thesis is to examine how the women in the study thought about pregnancy, and how they described their intentions to become or avoid becoming pregnant at various times in their life.
