The purpose of market definition in antitrust law is to identify a grouping of sales such that a single firm who controlled them could maintain prices for a significant time at above the competitive level. The conceptions and procedures that go into “market definition” in antitrust can be quite different from those that go into market definition in IP law. When the issue of market definition appears in IP cases, it is mainly as a query about the range over which rivalry occurs. The recent history of scientific excellence of a society could be used as an indicator of its economic, cultural and communal prosperity. In this work, two examples of countries that successfully arose from the remnants of comparative poverty and established themselves as scientifically thriving societies, South Korea and Slovenia, are compared with the case of Serbia, a country that is presumably on the doorsteps of a similarly explosive developmental path. Guidelines for social progress in the direction of greater scientific and social prominence are outlined in the course of the discourse. It is concluded that the ideal model of growth …

This paper juxtaposes the legal decisions made in the case of Percy Schmeiser, who was sued by Monsanto for patent infringement, against the attempt by the Organic Agriculture Protection Fund to obtain class certification in its efforts to sue Monsanto and Bayer for genetic contamination of organic canola. Together these two cases establish an unacceptable incongruity at common law between the rights enjoyed by intellectual property owners and any corresponding duties that might attach to their inventions. Broadening Participation Through E-Petitions? An Empirical Study Of Petitions To The German Parliament, Ralf Lindner

Petitioning is a well established form of political participation in most liberal democracies, but little is known about petitioners, their socio-demographics, motivations and assessments of petitioning processes. In 2005, the German parliament introduced public e-petitions which are submitted, signed and discussed on the Internet. This article reports a 2007 survey of 571 traditional and 350 e-petitioners. The results indicate that both petitioner samples are characterised by an above average level of general political participation and Internet use. Users of the e-petition system are younger than traditional petitioners, but the group continues to be dominated by men and those with higher …

Broadband deployment in the United States is expanding rapidly but unevenly. Using new FCC census data on wireline and wireless broadband providers, we study mobile broadband provision within the United States. Although rural areas lag non-rural areas in the availability of residential access to both mobile and fixed broadband, mobile broadband is at least partially filling in geographical gaps in fixed-line broadband coverage. Multiple regression results indicate that population density and growth, and the fraction of blacks, Hispanics, and youth in an area are positive predictors of the number of mobile broadband providers. Antidepressant (AD) use has been purported to increase the risk of breast and ovarian cancer, although both epidemiological and pre-clinical studies have reported mixed results [1]–[6]. Previous studies in a variety of biomedical fields have found that financial ties to drug companies are associated with favorable study conclusions [7].

This Article recommends means by which legal, scientific, engineering, and a host of other public and private actors can bring environmentally sound innovation into widespread use to achieve sustainable development.
