This Article examines ways that governments can mitigate the economic damage caused by the drug war. Part I details four specific legal reforms enacted in Colorado, which aim to reduce the problems of over-criminalization: Requiring a fiscal note for the creation of new statutory crimes; reducing drug possession from a felony to a misdemeanor; narrowing the scope of 'three strikes' laws, and; adjusting old sentences in light of new laws.

Part II explores the fiscal benefits of ending prohibition, such as reduced law enforcement costs and substantially increased tax revenues.

State and local governments play an important role in financing and delivering public services in the United States. In 2008, state and local governments collected 57 percent of total federal, state, and local revenue (Urban Institute and Brookings Institution, Tax Policy Center, 2009). The decentralization of fiscal responsibility has enabled a high degree of variation in state and local tax structures to emerge. This dissertation presents two empirical studies that extend the positive literature on state and local tax policy.

This study began focused on the use of traditional knowledge in promoting sustainable development in crisis conditions. Presented the question: How have successful community-level sustainable development efforts undertaken under crisis conditions drawn upon indigenous knowledge to achieve positive outcomes? The study is a cross case analysis. The three cases addressed in this study have explained some of the ways that indigenous knowledge has played significant positive roles in promoting sustainable development for communities living under crisis conditions in Palestine. During the nineteenth century, legislatures proved “excessively generous” in granting railroad corporations property rights in publicly owned, commercially vital municipal streets and harbors. Jacksonian jurists, suspicious of corporate influence, invoked the public trust doctrine to rescind grants of privilege inconsistent with the public interest. In Illinois Central Railroad Co. v. Illinois, the “lodestar” of the modern doctrine, the Supreme Court refused to recognize the Illinois legislature’s authority to convey the submerged lands of the Chicago Harbor to a railroad corporation, a conveyance that empowered a private enterprise to “practically control . . . for its own profit” a publicly …

Before 2001, the Oklahoma Department of Health achieved little to protect the public from the dangers of secondhand tobacco smoke. In an ongoing effort between 2000 and 2003, the department joined with health groups to lobby for stronger requirements, resulting in a new Oklahoma administrative rule in 2002 and legislation in 2003 regulating secondhand tobacco smoke. This action was congruent with the American Society of Public Administration's Code of Ethics for interactive democratic policymaking, in which administrators are required to serve the public interest with compassion, benevolence, fairness, and optimism.
