Special Administrative Measures: An Example Of Counterterror Excesses And Their Roots In U.S. Criminal Justice, Francesca Laguardia
Department of Justice Studies Faculty Scholarship and Creative Works
This article examines the creation and implementation of pretrial Special Administrative Measures [SAMs], a version of pretrial solitary confinement now used most often to confine terror suspects in the federal criminal justice system. Through an in-depth archival study, this article brings attention to the importance of 20th-century criminal justice trends to the 21st-century response to the threat of terrorism, including an increasingly preventive focus and decreasing judicial checks on executive action. The findings suggest that practices believed to be excessive responses to the threat of terrorism are in fact a natural outgrowth of late modern criminal justice.

In 1971, the New York Times released the first installment in a series later referred to as the Pentagon Papers that would eventually have significant political, social, and historical impacts that are felt even in the 21st Century. Following the first release, President Nixon’s administration sought an injunction against the publication of the remaining contents of the classified study, ultimately becoming an extensive legal process that culminated in the Supreme Court. In a per curiam opinion, the Court ruled that in accordance with Organization for a Better Austin v. Keefe and Near v. Minnesota that the federal government did not …

Hunting For Huntington’S Evidence: An Empirical Reassessment Of The Clash Of Civilizations Theory, John Daniel Shindelar

I inquire into Samuel P. Huntington’s clash of civilizations theory as outlined in his landmark The Clash of Civilizations. I explore conflicts starting at the end of the Cold War to 2007 in order to examine whether Huntington’s theory has been materializing (there is a marked increase in conflicts between Civilizations, and they have become more intense) or if the face of conflicts has stayed relatively similar to Cold War era clashes. I use International Crisis Behavior data on conflicts since the fall of the U.S.S.R. which Huntington cites as the end of a bipolar world and the beginning of …

The purpose of my research is to determine what factors affect the outcome of the Vocational Rehabilitation and Employment program. Previous literature examines individuals from each state in various stages of the program to determine which factors cause their individual outcome. Although previous research covered a broad spectrum of factors there still remains a lack of significant evidence to determine the observed outcome. I added state expenditures to the previous data to attempt to determine whether or not there is a correlation between funding and the completion of the program.
