The Omnibus Budget Reconciliation Act of 1990 (OBRA), passed by Congress in November 1990, placed new requirements on local governments for withholding Social Security taxes on wages paid to employees. Final regulations were issued by the U.S. Department of the Treasury and the Internal Revenue Service on June 28, 1991. These regulations affect all public sector employees who are not part of , a qualified retirement plan. Because of uncertainties I.and questions regarding the provisions of the law, this Technical Bulletin offers answers on how the act affects municipal governments in Tennessee.

Certain battalion chiefs in the Kern County, California fire department are not executives under the Fair Labor Standards Act (FLSA). That's what the 9th U. S. Circuit Court of Appeals said in Abshire v. County of Kern, 908 F.2d 483 (1990). In March, the U. S. Supreme Court refused to review that decision, in effect upholding it. Some newspapers called that case an expensive disaster for municipalities. The real question is whether the executives in a city's municipal departments are executives as defined by FLSA.

The Revenue Reconciliation Act of 1990 (Act) passed by Congress imposed increases in federal excise taxes on gasoline and diesel fuel. The tax on gasoline was increased to 14.1 cents per gallon while the tax on diesel fuel was raised to 20.1 cents per gallon. The new rates became effective December 1, 1990.

Municipal Capital Maintenance And Fiscal Distress, Mary K. Bumgarner, Jorge Martinez-Vazques, David L. Sjoquist

This paper formalizes and empirically tests the hypothesis that the deficient maintenance of public infrastructure is caused by fiscal distress. We utilize a production-decision framework in which public officials combine maintenance and new capital to produce a desired level of capital services. The behavior implied in the fiscal distress hypothesis is treated as perverse deviations from the optimal production path. The empirical findings from cross-sectional expenditures data give support to the fiscal distress hypothesis.

During the 1991 session of the Tennessee General Assembly, more than 1,500 bills were introduced in each house. From these bills, our legislature adopted 523 new public acts. This publication, a joint effort of the Municipal Technical Advisory Service and the 1ML Risk Management Pool, summarizes those acts that affect municipalities and municipal officials. These two organizations feel that if municipal officials know about new laws, they are more likely to conform their actions to those laws.
