To meet the environmental challenges of a warming planet and an increasingly complex, high tech economy, government must become smarter about how it makes policies and deploys its limited resources. It specifically needs to build a robust capacity to analyze large volumes of environmental and economic data by using machine-learning algorithms to improve regulatory oversight, monitoring, and decision-making. Three challenges can be expected to drive the need for algorithmic environmental governance: more problems, less funding, and growing public demands. Environmental regulators have embraced management-based regulation as a flexible instrument for addressing a range of important problems often poorly addressed by other types of regulations. Under management-based regulation, regulated firms must engage in management-related activities oriented toward addressing targeted problems—such as planning and analysis to mitigate risk and the implementation of internal management systems geared towards continuous improvement. In contrast with more restrictive forms of regulation which can impose one-size-fits-all solutions, management-based regulation offers firms greater operational choice about how to solve regulatory problems, leveraging firms’ internal informational advantage to innovate and search for alternative measures to achieve the intended …

In policymaking, evidence-based policymaking is an essential method for influencing policies and decisions by telling decision-makers “what works” (Head, 2008). Western sciences typically make up most of the evidence decision-makers use, but because people are boundedly rational in understanding and incorporating it—politics, values, and beliefs impact thought processes— scholars and policymakers also include other types of knowledge to make decisions. One way for decision-makers to incorporate other types of knowledge into policies is through public comments. While communities in the United States are already experiencing the effects of climate change, scientists project that sea level rise, increased precipitation, and record-breaking extreme weather events will devastate vulnerable regions in the following decades. The absence of federal strategies for climate change adaptation leaves state and city governments with broad discretion to undertake climate change adaptation measures. City parks and recreation departments are facing budget shortfalls and increasing expectations from customers. Governments are now embracing sustainability practices to create financial savings while also fostering relations with customers.

In March 2006, the National Policy Consensus Center (NPCC) and the United States Environmental Protection Agency (US EPA) co-hosted a multi-stakeholder Colloquium to consider whether collaborative approaches would allow Supplemental Environmental Projects (SEPs) to leverage environmental, public health, economic, and social benefits for communities affected by environmental law violations. A SEP is an environmentally beneficial project that a violator voluntarily agrees to perform, in addition to actions required to correct the violation(s), as part of an enforcement settlement.
