Presently the senior deputy general counsel for regulation and government affairs at PNC Fi-nancial Services Group, Kieran Fallon completed a 16-year tenure in the legal division of the Board of Governors of the Federal Reserve System in 2011. As associate general counsel dur-ing the Global Financial Crisis (GFC), he helped design the Federal Reserve’s Commercial Pa-per Funding Facility, restructure American International Group (AIG), and implement the Dodd-Frank Act. Relatedly, Fallon also served as general counsel for the Financial Stability Oversight Board from 2008 to 2011. This Lessons Learned is based on an interview conducted with Fallon on August 13, 2020.

The purpose of this qualitative participatory action research was to explore how complexity is engaged and experienced in complex regulatory systems, and to understand how cannabis might be regulated in ways that lead to socially equitable conditions. This was accomplished by studying the lived experiences of governmental leaders charged with the responsibility of establishing regulatory frameworks for legalized cannabis where none previously existed. Using the learning history methodology, the study deeply explores the ways that complex systems coexist by capturing the lived experiences of research participants and enhance theoretical understanding of complex regulatory systems. In 2010, Tennessee’s 106th General Assembly passed the First to the Top Act (2010), a companion legislation for the federal Race to the Top Act (2009) program launched by the Obama Administration. A provision of this state law required that half of teacher and principal evaluations be based upon student achievement, which included a component of required continuous academic growth. For school districts whose students scored at the highest academic performance levels, the continuous growth component would negatively impact their teachers’ and principals’ annual evaluations. Utah has become an unlikely leader in regional planning through a voluntary partnership of key leaders, agencies, local government, and the general public. Given that regional planning efforts around the nation have generally evoked strong reactions from residents concerned about losing local control, the success of Envision Utah—the organization that emerged as a key driver of regional planning in Utah—in building a consensus around regional growth management holds lessons for other regions.
