A Constituição cidadão brasileira e a Constituição portuguesa de 1976 comungam, em grande medida, dos meus valores de liberdade, igualdade, justiça, e outros, progressivos e de cidadania.

Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

A Liberdade de Informação poderá ser simultaneamente defendida pelo dever de abstenção do Estado na esfera de exercício privado (não perigoso) de cada cidadão ou grupo “ordeiro” de cidadãos, e pelo dever de protecção dos cidadãos e das suas pessoas morais (incluindo obviamente associações e empresas) nos casos em que a ordem natural da rede social equitativa seja rompida, designadamente por fenómenos de massificação arregimentadora, trusts anti-concorrência, violação de direitos fundamentais, etc., e, no limite, crime. Mas o discernimento e ponderação terão que ser muito grandes.

Congestion results in losses in productivity, added delivery time, extra costs for consumers, as well as damage to the environment. The most obvious solution to traffic congestion is to build more roads, but the prevailing thought among experts is that adding supply is not an effective long-term solution. Another approach is congestion pricing, where motorists are charged different prices based on demand. A literature review supports congestion pricing’s effectiveness, efficiency, and equity. Perhaps most importantly, a number of case studies suggest that congestion pricing is politically feasible.

The project of the “Treaty that establishes a Constitution for the Europe”, beyond its political consequences, puts some challenges to the classical constitutional theory. At first sight, it seems completely heterodox towards canon constitutional tendencies, and first of all in what concerns the constituent power classical theories. However, a more rigorous analysis of the history of the modern constitutionalism and its founding texts, mainly French, can lead us to detect very revealing bridges between the liberal modern constitutionalism of the XVIIIth century and the present constitution making of a codified European Constitution. The question that this study seeks to answer is. Does site-based management increase student achievement? Researchers believe that when a school can function more like a closed system, involved in site-based decision making, the culture of the organization may be more conducive to higher student achievement. This study has attempted to determine if there is a basis for this belief.

This article is the third examination of the six issues the author identified in "Some Key Issues Facing Boston's Public Schools in 1984," following the November 1983 election of the first thirteen-member Boston School Committee. Lessons In The Common Good: Voluntarism On College Campuses, Jodi Raybuck

This article describes the current interest and activity in community service and the undergraduate educational experience. Many examples of campus-based voluntarism with a social reform twist set the stage for passage of the National and Community Trust Act of 1993. What is still necessary, however, is recognition by faculty, administrators, and agency officials that the community service experience must be structured properly, so that both service and learning take place. Drawing on the efforts at Babson College and direct involvement with the national scene, this analysis offers recommendations for implementing a program that helps to cultivate good citizenship and values.

Many critics of America's public education system hail parental or school choice, a program that allows public school systems to compete against one another and, under some proposals, against private educational institutions, for students and educational funding, as the answer to Americas educational crisis. Proponents argue that competition will force public schools to offer students a quality education or close. This article does not evaluate the claims of the parental-choice proposals; rather, it examines the difficulties inherent in funding such a system through traditional school finance mechanisms.
