Bargaining Market Equity Adjustments By Rank And Discipline, Jonathan P. Blitz, Jeffrey F. Cross

Journal of Collective Bargaining in the Academy

Faculty contract negotiations generally include wages, hours, and other conditions of employment as well as mutually agreed non-mandatory subjects of bargaining. Negotiators typically address wages in terms of across-the-board increases, promotion in rank, merit increases, and one-time signing bonuses. Less typically, faculty salary negotiations include various forms of equity adjustments and salary increases linked to the underlying market and social forces and to salary compression that may, or may not, be related to these forces. The authors describe how they negotiated differential discipline-specific target salaries based in part on College and University Personnel Association faculty salary data.

Public employee labor unions in South Dakota possess a feeble set of bargaining rights, so weak it should be considered “collective begging.” However, our recent contract contains significant victories despite decades of playing defense. What lessons can be learned from this experience that might help other similarly situated faculty unions? What does this case study teach us about the disparity of power, especially where labor has fewer legal and political tools than management? A growing concern related to large-truck crashes has increased in the State of Texas in recent years due to the potential economic impacts and level of injury severity that can be sustained. Yet, studies on large truck involved crashes highlighting the contributing factors leading to injury severity have not been conducted in detail in the State of Texas especially for its interstate system. What are the legal and ethical implications of continuing to treat a brain dead patient? And may a hospital refuse to provide such treatment? These ethical and legal problems are raised in two recent cases. In the first Marlise Muñoz, a pregnant woman declared brain dead, was kept on life support against her family’s wishes due to the treating hospital’s interpretation of a Texas fetal protection law. In the other a hospital refused to treat Jahi McMath, a brain dead girl, despite her family's entreaties. The cases, at first, appear similar because in each case the hospital was refusing to …

In the current work, we examined the impact of the American Medical Association’s recent classification of obesity as a disease on weight-management processes. Across three experimental studies, we highlighted the potential hidden costs associated with labeling obesity as a disease, showing that this message, presented in an actual New York Times article, undermined beneficial weight-loss self-regulatory processes. A disease-based, relative to an information-based, weight-management message weakened the importance placed on health-focused dieting and reduced concerns about weight among obese individuals—the very people whom such public-health messages are targeting. Further, the decreased concern about weight predicted higher-calorie food choices. In addition, …

Effects of the Objective and Perceived Built Environment on Bicycling for Transportation:
This paper investigates the relative effects of the objectively-measured built environment versus stated perceptions of the built-environment on bicycling. Data are from a random phone survey conducted in the Portland, Oregon region. Binary logit and linear regression models, using objective measures, perceived measures, and both sets of measures, were estimated to predict odds of bicycling and frequency of bicycling separately. Results showed that the perceived environment and objective environment had independent effects on bicycling. Modeling Impact of Traffic Conditions on Variability of Midblock Roadside Fine Particulate Matter Concentrations on an Urban Arterial: This paper presents an innovative modeling of fine particulate matter (PM2.5) concentrations as a function of very high resolution meteorological and traffic data. Peak period measurements were taken at a mid-block roadside location on an urban arterial commuter roadway. To capture the impact of dynamic traffic conditions, data were analyzed at 10-second intervals, with substantially higher resolution than typical roadside air quality study designs. SUMMARY OF ARGUMENT

The Governor confines her argument in this amicus brief to whether the superior court correctly concluded that the education tax credit program enacted under RSA § 77-G violates Article 83 insofar as it permits organizations authorized to receive donations subsidized by the credit to use those donations to fund student scholarships to religious, non-public schools. In the Governor’s view, the superior court’s finding of unconstitutionality was correct.

Case Study in Portland, Oregon This study examines driver and pedestrian behaviors at two enhanced midblock pedestrian crossings in Portland, Oregon. One crossing is on a five-lane arterial with a posted speed of 35/45 miles-per-hour (MPH) and features six rectangular rapid flash beacon (RRFB) assemblies and a narrow median refuge. The other crossing is on a suburban arterial with four travel lanes and a two-way left-turn lane. The crossing is enhanced with four RRFB assemblies and a median island with a “Z” crossing, or Danish offset, designed to encourage pedestrians to face oncoming traffic before completing the second stage of …

The introduction of wider stop spacing through the removal or consolidation of existing stops is one method transit agencies can use to reduce travel time and reliability on many transit lines. A great deal of research has been done to provide tools for determining optimal stop spacing, but tools are still needed to help service planners determine the optimal stops to remove. Stop-level bus performance data provide the information needed to develop a method for assessing the total benefits and costs to riders of removing individual stops. There is growing investment in infrastructure to support non-motorized travel modes in the United States, in particular for bicycling. However, there remains a dearth of knowledge on the relationships between built environments and bicycling for non-work transportation. This issue is exacerbated by researchers and practitioners continuing to combine walking and bicycling into the category “non-motorized modes,” despite the two having many differences. This paper addresses these shortcomings through a segmented analysis of mode choice and mode share for walking, bicycling, and automobile travel. Institute for Veterans and Military Families

This study examines the the demographics of military families, which can be used to can assist in better serving their needs, reducing their stress, and increasing their happiness with military life. The diversity of these families significantly impacts their interaction with their social networks and societal institutions, and would benefit from policy that creates additional programs aimed at helping military children through critical military transition points. Additional research is needed on how younger children operate in military families, and the impact of supports available for spouses caring for younger children during deployments and separation from their spouse.

Special Administrative Measures: An Example Of Counterterror Excesses And Their Roots In U.S. Criminal Justice, Francesca Laguardia

This article examines the creation and implementation of pretrial Special Administrative Measures [SAMs], a version of pretrial solitary confinement now used most often to confine terror suspects in the federal criminal justice system. Through an in-depth archival study, this article brings attention to the importance of 20th-century criminal justice trends to the 21st-century response to the threat of terrorism, including an increasingly preventive focus and decreasing judicial checks on executive action. The findings suggest that practices believed to be excessive responses to the threat of terrorism are in fact a natural outgrowth of late modern criminal justice.

The purpose of this poster is to introduce Conjoint Behavioral Consultation via Distance delivery (CBC-D) as a potential intervention service for rural educators. This poster provides a detailed description of the CBC-D process and practical considerations when using tele-education technology to deliver consultation services to rural schools. Implications for school psychology practice and future research are discussed.

• Children with social-behavioral concerns are at high risk of developing long-term, pervasive problems.

• Interventions which aim to decrease negative behaviors and increase social and adaptive skills across both home and school settings have the potential to be particularly effective.

• However, families of students with social-behavioral problems also tend toward disengagement from, or limited connection with, schools or other service-delivery systems (Dishion & Stromshak, 2006).

This paper details the socio-legal factors that shape the relationship between the child, the family, and the state, and the ways unaccompanied migrant children’s lives have come to be defined and contested. The legal identity of migrant children is socially situated within a history that intertwines social movements of helping professionals, legal jurisdictions characterized by increasingly intolerant approaches to juveniles, and shifts in the treatment of unauthorized migrant youth under immigration law over time. The apex of China’s 1911 Republican Revolution, the election in Nanjing of native son Dr. Sun Yat-sen, heralded an historic break with autocracy. Tragically, Sun Yat-Sen’s democracy did not last long. A bitter period of feudal strife followed as warlords sought to carve fiefdoms out of the young republic. Humiliating concessions to Japan under the Versailles Treaty added to the new republic’s problems. Continuing violation of China’s sovereignty spawned the May 4th, 1919 student movement in Peking. Reverberations from May 4th helped launch a small communist party cell in Shanghai and a larger democracy movement across the country.
