In Florida v. HHS, a lawsuit brought on behalf of 26 states challenging the constitutionality of the Patient Protection and Affordable Care Act (ACA), the Supreme Court will determine the future direction of health care reform in the United States. During the unprecedented 5-1/2 hours of oral arguments, the Court will hear 4 issues: the individual purchase mandate, severability, the Medicaid expansion and the Anti-Injunction Act.

The states challenging the ACA maintain that the purchase mandate uniquely penalizes individuals for failing to purchase insurance. Uninsured individuals, however, rarely do nothing. Instead, they self-insure, rely on family, and cost-shift to …

Pharmaceutical companies have strong economic interests in influencing physician-prescribing behaviors. They advertise direct-to-the-consumer and to the physician. Beyond general marketing, manufacturers promote their drugs to physicians through “detailing”—sales representatives (“detailers”) visiting medical offices to persuade physicians to prescribe their products.

By law, pharmacies receive specific information with every prescription, including the physician’s name, the drug, and the dose. Pharmacies sell these records to Prescription Drug Intermediaries (data miners), who use advanced computing to analyze prescriber-identified information (which physicians prescribe what drugs, in what dose, and with what prescribing patterns). Data miners, in turn, lease sophisticated reports to pharmaceutical companies to …

This article starts from the premise that poverty is a growing problem in the United States. Intergenerational poverty, the entrenchment of a class of very poor people, is a major sub set of that problem and is tied very closely to the issue of race. The author claims that missing in the fight by the poor and their allies against stratified poverty is the creation and utilization of power. This paper examines the disparate ways in which commentators have defined power. Testing The Developmental Nature Of Work Motivation Using Kegan’S Constructive-Development Theory, Marilyn J. Bugenhagen, John E. Barbuto Jr.

This article reports a field study testing the relationship between individuals’ constructive-development level and their sources of work motivation. Constructive development was assessed using the Subject–Object Interview for 53 community and educational leaders. Motivation was assessed using the Motivation Sources Inventory. Results indicated that constructive-development progression was significantly related to instrumental motivation. No other significant relationships were found, indicating that the other four sources of work motivation exist independent of individuals’ constructive development. Implications for research and practice are addressed.

Targeting Outcomes of Programs (TOP) is a seven-step hierarchical programming model in which the program development and performance sides are mirror images of each other. It served as a framework to identify a simple method for targeting photographic events in nonformal education programs, indicating why, when, and how photographs would be useful to inform other evaluation strategies. In two case studies, photographs enhanced the formative story of a geoscience project being developed and tested, and contributed to the outcome narrative of a 10-year partnership project between two universities. In both cases, TOP proved to be an efficient and easy-to-use framework. …

The Elder Economic Security Standard^TM Index measures the income that Massachusetts’ seniors need to maintain independence and meet their basic living expenses in the community. The Elder Index uses an income measure that reflects the actual expenses for basic needs of older adults, and includes cost estimates for housing, food, medical care, transportation, and household essentials. Elder Index values are calculated for each state, on a county-by-county basis, providing policy makers and individuals a benchmark for determining what income or governmental supports are needed in their communities.

In this essay, the second of a series, we continue our evaluation of state Tax Increase Limitations (TILs) – special rules that limit state legislatures’ ability to raise taxes, such as by requiring supermajority votes. We analyze two strategies whereby majority parties can evade TILs to the extent they so desire. We further argue that these strategies have some positive normative features. The strategies designed to evade TILs may ultimately lead toward a more effective means for controlling the size of state government than TILs themselves are able to provide.

Currently, the U.S. Department of Homeland Security (DHS) elicits probabilistic judgements from the intelligence community on actions terrorists may take to attack the continental U.S. For example, how likely is the adversary to choose agent 'x' over 'y' or target 'a' over target 'b'? Eliciting these types of judgements is difficult and time consuming. The National Academies and others have suggested that a better approach may be to elicit information on adversary's preferences, perceptions, and capabilities and use this information to calculate probabilities of interest to DHS. The application of a gravity model in freight modeling work on both short-haul and long-haul trips is discussed. A commodity-based gravity model was developed to assess the distribution of freight by long-haul trucks in southeastern Virginia. Although gravity models have been used extensively in transportation studies, little work has been done to address the special characteristics of freight transportation, such as the definition of friction factors and the differences between long-haul and short-haul trips. They have to predict both what tactics their opponent will employ and the outcomes of any resultant conflicts in order to make the best decision about their actions. Game theory has been the dominant technique used by analysts to investigate the possible actions that an enemy will employ. Traditional game theory can be augmented by use of Lanchester equations, a set of differential equations used to determine the outcome of a conflict. More Than A One-Trick Pony: Exploring The Contours Of A Multi-Sector Covener, Madeleine W. Mcnamara, John C. Morris

Today's managers must find ways to identify and sustain productive relationships within multi-sector collaborative arrangements. This paper explores empirically the activities of a convener based on tasks identified by Agranoff and McGuire (2001) and applies this framework to the case of Virginia's Coastal Zone Management Program (VCZMP). We find that the convener displays characteristics described by Agranoff and McGuire, as well as characteristics of traditional hierarchical managers. This research suggests that both sets of skills are necessary for effective multi-sector collaborative governance.

Alternative road pricing schemes are promising strategies to alleviate congestion and other environmental problems related to urban and regional road transportation. However, in practice, environmental issues are not often taken into account, especially at regional level. In 2010, due to the financial crisis in Portugal, several tolls were introduced in some motorways that were previously financed by the government. One of these cases was the A29 motorway, which connects the cities of Aveiro and Oporto. After the introduction of tolls about 50% of the Average Daily Traffic shifted to alternative routes or modes.
