In recent years, historians have uncovered a good deal about the domestic production and circulation of development knowledge between US philanthropies and US universities. They have begun to trace as well the role of US foundations in the formation of transnational epistemic communities of experts that cohered around, and defined, developments such as population control, food production and economic planning initiatives.³ The voice of the foundation in these histories nevertheless remains largely that of the foundation presidents and senior officers in New York. There is a firestorm of political and cultural conflict around environmental issues,including but running well beyond climate change. Legal scholarship is in a bad position to make sense of this conflict because the field has concentrated on making sound policy recommendations to an idealized lawmaker, neglecting the deeply held and sharply clashing values that drive, or block, environmental lawmaking. This Article sets out a framework for understanding and engaging the clash of values in environmental law and, by extension,approaching the field more generally. This Article examines the astonishing array of doctrines used to determine what constitutes marriage fraud. It begins by locating the traditional nineteenth-century annulment-by-fraud doctrine within the realm of contract fraud, observing that in the family law context fraudulent marriages were voidable solely at the option of the injured party. The Article then explains how, in the twentieth century, a massive expansion of public benefits tied to marriage prompted new marriage fraud doctrines to develop in various areas of the law, shifting the concept of the injured party from the defrauded spouse to the public at large. Civilian Aviation Screening: A Time-Series Analysis Of Confiscated Firearms At Screening Checkpoints, Shon Agard

This study investigated the aviation screening process and sought to determine if the federalization of the screening process had any effect on the number of firearm confiscations at civilian aviation screening checkpoints. The hypothesis of the study was that airport screening firearms confiscations (per one million screenings) were lower before the U.S. government (TSA) took over screening in 2001-2002. This quantitative research required the performance of an interrupted time series analysis. Interrupted time series analysis evaluates the impact of one or more events on the values in the time series. An interrupted time series analysis attempts to determine whether an …

Our report, "The Latino Community in Multnomah County: An Unsettling Profile" uncovers an array of racial inequities across the systems of income, employment, education, juvenile justice, corrections, child welfare, philanthropic giving, housing, immigration, research practices (particularly population measurement), wealth, health, health insurance coverage, racial harassment, public service and voter registration. These systems maintain our second-class status and serve to limit our current well being and the prospects for a bright future for our children.

Improvised Explosive Device (IED) is a weapon of choice and is likely to remain a major component of the Global War on Terrorism. It is critical that gaps in knowledge transfer are quickly addressed in order to more effectively equip personnel to counter IED (C-IED) threat. The Population Council undertook this study to assess the knowledge, attitudes, and practices regarding emergency contraception (ECP) among providers in public and private facilities and pharmacies in India. The objectives of the study were to: assess providers' knowledge of ECP's biological mechanism; understand providers' knowledge and attitudes about ECP's safety, effectiveness, and availability as an OTC drug; and identify providers' definitions of “repeated use” and profiling women who are “repeated users” of ECP. This study's findings show that most providers, including doctors and some KOLs, were incorrectly informed about ECP's mechanism of action. Service guidelines are necessary for accurate and …

Are games more like coffee mugs, posters, and T-shirts, or are they more like books, magazines, and films? For purposes of the right of publicity, the answer matters. The critical question is whether games should be treated as merchandise or as expression. Three classic judicial decisions, decided in 1967, 1970, and 1973, held that the defendants needed permission to use the plaintiffs' names in their board games. These decisions judicially confirmed that games are merchandise, not something equivalent to more traditional media of expression. As merchandise, games are not like books; instead, they are akin to celebrity-embossed coffee mugs. To …

A key issue in the decades-long struggle over US health care spending is how to distribute liability for expenses across all market participants, from insurers to providers. The rise and abandonment in the 1990s of capitation payments—lump-sum, per person payments to health care providers to provide all care for a specified individual or group—offers a stark example of how difficult it is for providers to assume meaningful financial responsibility for patient care. Retributivists thus face a difficult challenge. Either we must go against the social grain, and perhaps our own intuitions, by insisting that a criminal offense carry the same penalty or punishment no matter how many previous convictions an offender has accrued; or we must find a way to justify the recidivist premium. I shall take the second route here by arguing that recidivism itself is a kind of criminal offense. In developing this argument, I shall rely on Youngjae Lee's insightful analysis of "recidivism as omission." I shall complement his analysis, however, by grounding it in a conception of criminal …

The national weather service of the United States came into being in 1870 for the practical utility of the American people. The interaction between weather, agriculture, and commerce provided the impetus for the inception of the service. Many historians put forward the notion of an obdurate weather bureau, a scientific backwater with no interest in modernization until after World War II. I disagree with this popular historiography and instead offer a history of the weather bureau’s attempts to institute the latest meteorological practices that takes into consideration the burdens and obligations of the bureau, as well as the historical context. …

Computer-based modeling and simulation has been a training staple in the military domain since the first aircraft simulators were adopted. More recently, virtual environments based on modeling, simulation and serious games, have introduced relatively low-cost, yet high value additions to the learning environment. As these virtual environments have proliferated, many researchers have investigated the relationship between theoretical foundations of learning, learner development and content delivery, and applied their findings in an attempt to bolster learning, yet performance deficiencies continue to exist. This study asserts that performance deficiencies exist in part because of insufficient contextually appropriate opportunities to practice.
