The Family and Medical Leave Act of 1993 (FMLA) permits workers who meet certain conditions to take up to 12 weeks per year of unpaid leave for medical or family care reasons. This memorandum discusses the statutes, legislative history and regulations pertinent to intermittent and reduced schedule leave, as well as select case law.

This brief discusses the most recent and historical NAEP data in math, science, reading, and writing. Arkansas’ NAEP results are compared to national and border state averages. Based on the most recent NAEP exams, Arkansas is performing slightly below the national average in reading, math, science, and writing. There is also data to support that Arkansas students perform less well in Grade 8 than in Grade 4 when compared to the national and border state averages. Arkansas, however, is among the highest performing states with regard to change over the last decade. Since 1992, Arkansas has gained on the national …

The No Child Left Behind (NCLB) Act mandates that states require all teachers to earn full certification and demonstrate competency in the subject area in which they teach. But do these requirements really produce effective teachers— teachers who actually improve student learning and achievement? The existing research base is decidedly mixed, highly politicized, and often just plain confusing. Some experts maintain that teachers’ pedagogical knowledge shows even stronger relationships to teaching effectiveness than their subject matter knowledge (Darling-Hammond, 1997; Darling-Hammond & Youngs, 2002); others insist that teachers’ expertise in their content area is a far better predictor of student achievement …

On December 8, 2003 the Arkansas General Assembly convened in a special session called by the Governor for the purpose of developing a plan to address the court mandate in the Lake View case before the mandated January 1, 2004 deadline. Legislators in both chambers debated a number of plans concerning the relationship between a school’s size and its quality and cost efficiency (e.g. – consolidation of smaller high schools into larger ones) as well as the best means of monitoring student assessment and school accountability. Over the past decade, we’ve heard time and again the dire warning that a major teacher shortage is imminent in our public schools. But is this really the case? Teacher education programs actually produce enough teachers each year to compensate for those who retire. Rather, some researchers suggest that we have focused too much on teacher shortages (the inability to recruit enough teachers) and not enough on teacher attrition (losing teachers already in the field). According to the National Center for Education Statistics’ (NCES) latest School and Staffing Survey (SASS), about one-third of teachers quit during their first three years, …

The term “alternative certification” has been utilized to describe programs ranging from immediate issuance of emergency certification to well-developed, highly professional training programs designed to bring new people into the profession. Because of the mandate to place highly qualified teachers in every classroom, the issue of alternative certification has become even more prominent and there is now more consistency in the academic rigor of alternative certification program across the nation. In this state, TeachArkansas serves as a clearinghouse for the various programs that enable an individual who did not out to be a teacher to become certified (see www.teacharkansas.org).

The Omaha Conditions Survey: 2004 was conducted through telephone interviews with adults from a random sample of Omaha-area households. The sample was drawn from households in the Nebraska portion of the Omaha Metropolitan Statistical Area (MSA). Douglas, Sarpy, Cass, Washington, and Saunders Counties comprise the Nebraska portion of the Omaha MSA.

This project developed a model for effective asset management drawn from successful programs in the United States, Australia, and New Zealand. Asset management practices were examined at the City of Ontario Utilities Department; a medium sized utility, and also at the Rainbow Municipal Water District, a small sized utility. Gaps between the ideal model and the existing practices were investigated.

The paper describes the use of multiple objective decision analysis to qualitatively and quantitatively assess the quality of an endangered watershed and guide future efforts to improve the quality of the watershed. The Upham Brook watershed is an urban watershed that lies at the interface of declining inner city Richmond, Virginia and growth-oriented Henrico County. A section of stream within the watershed has been identified as so dangerously polluted that it threatens the health of the residents who live within the watershed boundaries. The purpose of this study was to determine whether a coordinated and comprehensive system of care for the uninsured changed the behavior of the uninsured by decreasing non-urgent utilization of the emergency departments within a large, urban county. The literature on emergency department trends and interventions designed to decrease "inappropriate" or non-urgent use of the emergency departments was reviewed and links to relevant theoretical concepts were identified. Utilization data from six emergency departments and six federally qualified health centers were evaluated. This dissertation examines the public participation activities of State Departments of Transportation (SDOTs) in the United States. A review of existing literature and legal frameworks suggests that an "authentic" public participation results when dimensions of representativeness, use of public inputs, interactiveness, and quality of citizen inputs have been achieved. The study sought to identify conditions that serve as measurements that must presumably be satisfied for authenticity to exist in public participation. This study focuses on the effect of leadership in the federal government. Using a slightly revised version of Bass's Full Range Leadership Model, the study examines the influence of transformational leadership, transactional leadership, and combination of the two on the perception of leadership effectiveness and follower satisfaction in the federal government. To establish if this revised model is consistent with federal employees' perception of effective leadership, if leadership in the federal government increases follower satisfaction, and if both the transactional and transformational leadership are important to followers' perception of leadership and their satisfaction, data from the 2002 Federal Human Capital …

In the event of a bioterrorist attack, emergency departments are considered the first line of response for all acute levels of care. This study focused on hospital emergency departments in Florida and the activities, policies, and procedures involved in preparing for a bioterrorist attack. Hospital size, location, and system affiliation were related to attaining these levels, and their impact was assessed. Through a cross-sectional survey design, the physical properties of the 77 hospitals (i.e. facilities, equipment, communication systems, etc.), and the social characteristics of the organizations (managerial functions including: planning, training, financial, and environmental characteristics) were examined. Means-end theory provides a useful approach for characterizing the relationship among the attributes or components of an experiential education course (the "means"), the benefits, or the outcomes associated with these attributes/course components, and the personal values (the "ends") these outcomes help to reinforce for course participants. The purpose of this article is to show how this "means-end" perspective can enhance our understanding of the outcomes associated with outdoor adventure programming. A self-administered questionnaire designed to identify the linkages among program attributes (i.e., course components), course outcomes, and personal values was administered to a sample of 216 Outward Bound course participants. …

This plan will guide management of wolves in Utah during an interim period from delisting until 2015, or until it is determined that wolves have established1 in Utah, or assumptions of the plan (political, social, biological, or legal) change. During this interim period, arriving wolves will be studied to determine where they are most likely to settle without conflict.

The goal of this plan is to manage, study, and conserve wolves moving into Utah while avoiding conflicts with the wildlife management objectives of the Ute Indian Tribe; preventing livestock depredation; and protecting the investment made in wildlife in Utah.

While many HEIs around the world do not proclaim or wish to be research-intensive institutions the majority desire to intensify their research activity because it is seen as a sine qua non of higher education. Accordingly, HEIs are busy making critical strategic choices concerning human resources, the research environment, the teaching-research nexus, organisational and management structure, and funding. The Family and Medical Leave Act of 1993 (FMLA) imposes notice obligations on both employers and employees. Employees must give their employer notice of their need for leave by providing an FMLA-qualifying reason for leave. Employees are not, however, required to use the words “FMLA” when asking for leave. Employees must also tell their employer if they wish to substitute paid leave for unpaid FMLA leave. Finally, employees must provide their employer with two-days’ notice of their plans to return to work following leave.

Employers initially must give employees notice of their FMLA rights. Once an employee has requested leave, …

Participation: A Model Of Individual Willingness To Participate In The Transportation Planning Process, Michael Neidhart

This study sought to identify the key determinants that lead individuals to participate in the transportation planning process. Two models of participation, one for the short-term and another for the long-term, were developed to test whether the key internal and external determinants are responsible for influencing a person's willingness to participate. The data for this study came from a mail-back survey that was administered to a random sample of 570 individuals throughout the State of Florida for a response rate of 37.37 percent. The results indicate that the internal motivational determinants exert more influence on a person's short-term willingness to …
