中國大陸加入 Wto 後政府職能之變遷 : 調適與挑戰, 陳德昇

中國大陸已於2001年12月1日成為「世界貿易組織」(World Trade Organization) 正式會員國。雖然大陸加入此一號稱「經濟聯合國」的經濟組織眾所關心的議題主要是對大陸產業的街擊，國有企業的生存競爭挑戰，以及失業的惡化，但事實上政府體制與職能的變遷與調控，更是值得重視的課題。換言之，加入世貿組織對應的主體首先是政府，其次才是企業。此外，大陸政府職能調過良好與否，亦將攸關大陸經濟市場化發展，以及政經體制變革之進程，其發展動向值得關注。

針對政府職能調整議題，本文由體制面、行為百與法制面分析與觀察：中國大陸加入WTO後政府職能調整與變遷趨勢，並評估其政府職能轉變較易實現之目標與較困難改變之處，以及WTO 規範「應然」(what ought to be) 面與大陸實際發展之「寶然」(what is) 面之落差與影響。最後將提出台商因應之道及大陸政府職能轉變與政經結構調整之展望。

台灣入世銀行服務業在法規和政策上之調適, 王應傑

世界貿易組織(WTO)的前身為關稅暨貿易總協定(GATT)。臺灣於1990年1月1日，以「臺、澎、金、馬個別關稅領域」正式向GATT 提出入世申請；並於1993年取得其觀察員資格。由於在1994年12月24日烏拉圭回合談判的最後協議中，決定成立WTO，臺灣再於1995年12月1日改申請加入WTO。

此間歷經12年的籌備和努力，臺灣終於在今年(2001年)9月18日完成入世文件採認，最快可於明年1月正式成為WTO 會員，立法院也正在配合行政部門加速進行相關法案的修定。臺灣在入世後，必須克服市場開放對各產業的多方衝擊，而臺灣政府相關部門亦早為入世調整相關產業政策和法規，以期使產業能轉型成功。

本文將針對入世對臺灣銀行服務業相關法規和政策上之調適，作一簡單之介紹和分析。

兩岸經過十多年來漫長的努力終於在今年一起進入WTO，對兩岸而言均是歷史上新頁，審視成立WTO 之目的，乃在提倡自由貿易精神、卻除關稅障礙，強調開放市場，分享經濟主權，並就會員國彼此間因不同的規範制度所引發之相關爭議，尋求共同的解決機制，因此，兩岸入世後，對於相關智慧財產權之爭議解決途逕除了原有的一般個案爭訟、雙方諮商模式外'WTO 協定並提供一多邊之爭端解決機制(爭端解決規則與程序瞭解書(UNDERSTANDING ON RULES AND PROCEDURES GOVERNING THE SEffiEMENT OF DISPUTE，簡稱WTO-DSU) 。

WTO 向有「經濟聯合國」的類稱，台灣在加入九叮O 後，首須了解WTO 所有之規範'尤其在發生國與國間或跨國之爭端事件時，對於WTO-DSU 多邊爭端解決的規則與操作，更須清礎、熟悉，才能避免錯誤並確保自身權益。由於種種環境因素，有關兩岸的雙方諮商無法擴展開來，因此，於兩岸均入世貿後，有認為將可透過WTO-DSU 之多邊爭端解決方式，為兩岸的對話閉關另一扇窗口，果如此，是否意味著制後對兩岸有關智慧財產權爭議的解決，可迴避雙邊諮商，而將之改置於WTO-DSU 多邊爭端解決模式來處理?應值得探討。

1998年3月，中國(海南)改革發展研究院正式提出“關於實行瓊台農業項下自由貿易的建議報告”。 這項建議的提出，曾在海內外產生反響，但由於種種原因，未能實施，今天當中國和中國臺灣先後加入WTO 之後，此項建議，是否還有價值，是否可行，在新形勢下如何推動，本文將對這些問題進行探討。

WTO 是世界最大的多邊貿易組織，是各國與國際經濟體系聯系與合作的重要橋梁，多年來WTO 致力於推行商品和服務貿易自由化、知識產權保護和貿易法規公開化等，通過貿易政策審議機制和爭端解決機制，對世界貿易和投資產生著重大影響。由於世界貿易組織是一個以市場經濟及公平貿易為基礎的多邊貿易體制，而中國大陸經濟體制是20 餘年來，從計劃經濟體制調整到社會主義市場經濟體制，因此，在加入WTO 後其政府、企業及各產業均必須面對市場開放與競爭的衝擊。本文將從經濟制面、產業面及總體經濟面等觀點，探討中國大陸加入WTO以後，到大陸經濟發展之影響。

兩岸工業部門國際分工程度之比較分析, 吳中峻

本文擬從長期的資料著手，首先以產業內貿易指數觀察兩岸貿易型態與國際分工的變化情形，接著針對產業內貿易指數的缺點提出疑問，並配合貿易專業化係數或質易特殊化係數(Trade Specialization Coefficient, TSC) 重新定義國際分工型態。由TSC值進一步觀察兩岸歷年對全球貿易中，工業部門的國際分工型態，並以「雁行」理論，探討兩岸產業的發展關{系。

本文共分陸節，除前言外，第貳節是圓際貿易與國際分工型態的文獻回顧，第參節敘述貿易資料來源與國際分工指標，第肆富有分析臺灣地區國際貿易與分工型態時間趨勢，第伍節說明臺灣地區產業政策與國際分工型態反轉的形成，最後則是結論。

加入Wto對台灣與大陸證券業之衝擊與因應, 吳桂燕

根據WTO議程，大陸將於2001 年年底加入WTO。而依據主要會員國之共識，台灣亦將隨後入會。兩岸入會後，首先將被迫往開放的方向調整，在金融服務業亦將面臨開放問題。台灣與大陸未來皆必須逐步開放金融市場，金融業包括銀行業、證券業、保險業等皆將受到外國金融業激烈的競爭，而兩岸間金融往來亦將可能發生。在全球金融化的趨勢下，競爭將愈趨激烈，尤其來自國外的金融業，挾持龐大的資金與經驗豐富的人力資源，將對兩岸金融業的經營與發展產生巨大的衝擊與影響。其次，兩岸面對入會後最大的挑戰是人才的競爭，尤其金融服務業人才爭奪戰將是中國入會後不可避免的趨勢。

A Positive Political Model Of Supreme Court Economic Decisions, Tony Caporale, Harold Winter

We develop a positive political model of the U.S. Supreme Court. Looking at the Court's economic cases for the period 1953-1993, we find a significant larger fraction of conservative decisions under Republican presidents and more conservative leadership of the House and Senate Judiciary Committees. Conservative decisions are also found to be positively correlated with the fraction of the Court appointed by Republican presidents and the rate of price inflation. We argue that our findings cast serious doubt on the common view of the Supreme Court as a completely independent, apolitical institution.

The Adaptive Architectures for Command and Control (A2C2) program is a multidisciplinary program that employs a scientific basis for designing and analyzing adaptive and reconfigurable organizational structures at the Joint Task Force level. As part of its unique model-driven experimentation method, a pre-experimental model is created to support the formulation of hypotheses, the determination of key variables and parameter values, and the prediction of organizational performance. This is the central question underlying Susanne Jonas's Of Centaurs and Doves and Christopher Chase-Dunn, Susanne Jonas, and Nelson Amaro's Globalization on the Ground. As events continue to unfold for Guatemalans, these scholars tackle the very current issues of democratization, development, justice, and peace in post-war Guatemalan society. The thesis analyses mid-nineteenth century electoral violence in England and Wales in order to contribute to our understanding of the character of Victorian electoral politics, and to assess the pace of political modernization as it has recently been defined. Historians have long acknowledged the presence of physical violence, rioting and intimidation during British elections from at least the Middle Ages to the turn of the twentieth-century, and yet the precise nature, frequency and scale of this phenomenon has remained somewhat obscured by a lack of statistical data on the subject. A census of 53 adolescent females was conducted over a period of time beginning July 15, 2001 and ending March 5, 2002. Each subject was surveyed by using an interview with 66 items. The resources examined in this census were means of transportation and the social support structure before the female became an adolescent. The census found that 72 percent (N=53) of the adolescent females interviewed do not have a car, and 79 percent do not use public transportation. The census also found that 77 percent of the adolescent females interviewed do depend on their family/friends for transportation, and eighty-five …

Security relations between Latin American and the United States are generally well explained by hegemonic stability theory. Succinctly stated, hegemonic stability theory explains that in systems with a hegemonic power there is a greater likelihood of security cooperation. This is because a hegemon provides public goods, such as a stable currency or security from outside interference, and in turn, the less powerful states acknowledge the leadership of the dominant state. The primary focus of this study is on illegal weapons trade in Romania and the Caucasus region of the former USSR. Illegal weapons traffic in these regions is linked with both organized crime and terrorist activities. The main source of weapons for conflicts in the Caucasus region is corruption in Russian military circles.
