Differentiating Regulation Of Public And Private Institutions: A Preliminary Inquiry, Jonathan G.S. Koppell

Twenty years ago, James Q. Wilson and Patricia Rachal argued that government cannot regulate itself. In an era of revived federalism, increased reliance on contractors, and proliferation of quasi-public organizations, the importance of government self-regulation is greater than ever. This paper tests an underlying assumption of Wilson and Rachal's claim: that regulation of public and private organizations can be differentiated. Employing a meta-research design, this pilot study uses existing regulatory case studies to create "regulatory relationship profiles" for public and private organizations. The continuing oppression and violation of human rights in Mexico is predicated on the abuse of executive power, suppression of the powers of the Comision Nacional de Derechos Humanos (the National Commission for the Protection of Human Rights), and the usurpation of the authority of the judiciary. This thesis conducts a comparative analysis of the protection of human rights under the Constitution of the United States, the German Basic Law, and the Constitution of Mexico. During the 1960s and 1970s, the individual rights revolution that swept through American society remade much of the nation's health law in its image. Sick people acquired the right to be told of the risks and benefits of proposed treatments and then to give thumbs-up or thumbs-down to their doctors' decisions. Successful suits for medical negligence went from rare to commonplace. Elderly and poor Americans achieved statutory rights of access to publicly funded healthcare, and courts burnished these rights with myriad procedural protections. The critically ill and their families won the right to refuse aggressive, life-sustaining treatments. Psychiatric patients acquired …

The purpose of this study is to examine municipal involvement in international relations in the United States. This municipal phenomenon is occurring concurrently with both a shift away from the traditional nation-centric structure of international relations under the influence of globalism as well as a sharp decline in intergovernmental aid. The research questions were: (1) What are the indicators that define municipal involvement in international relations? and (2) What is the extent of that involvement?

This thesis examines the impact that recommendations made by the President's Blue Ribbon Commission on Defense Management, informally known as the Packard Commission, had on reducing cost overruns in major DoD acquisition programs. Cost overruns are a recurring problem in the DoD, and the study of possible effects resulting from the implementation of acquisition reform efforts such as the Packard Commission study could alter this trend. Why Targets Of Regulations Do Not Comply: The Case Of Conservation Compliance In The Corn Belt, J. Dixon Esseks, Steven E. Kraft, Edward J. Furlong

This article employs survey data to test hypotheses about Corn Belt farmers’ intentions to apply conservation compliance plans. The data came from winter 1995 telephone interviews with a random sample of 839 farmers in that five-state region who had USDA-approved plans for their high4 erodible cropland For ethical and practical reasons noncompliance was measured indirectly-the respondents’ estimates of the percentage of their peers in the county who would “not apply their plans to any meaningful extent in 1995.” Regression analysis found that, as predicted by deterrence theory, farmers who believed in high probabilities of violations being detected or penalized were …
