The Functions Of Transaction Costs: Rethinking Transaction Cost Minimization In A World Of Friction, David M. Driesen, Shubha Ghosh

This article critically examines the goal of minimizing transaction costs, including the costs of legal decision-making. This goal permeates the law and economics literature and has profoundly influenced public policy. While most transaction cost scholarship has focused upon private law, the minimization goal has strongly influenced public law, where it has contributed to a variety of legal changes aimed at reducing public transaction costs, often through privatization.

We argue that transaction costs purchase corollary benefits. They frequently enable those engaging in transactions to obtain information needed to correct for information asymmetries or inadequate information. They perform the functions of facilitating …

This book chapter questions the conventional theory purporting to establish that environmental benefit trading encourages innovation better than comparable traditional regulation. It argues that the induced innovation hypothesis, that high costs encourage innovation, suggests that trading would lessen incentives for innovation by lowering the cost of complying with conventional approaches. The conventional theory relies upon the incentive emissions trading creates for polluters to make additional reductions in order to sell credits. But emissions trading also creates incentives for half of the pollution sources (the credit buyers) to make less reductions than they would under a traditional regulation. By focusing analysis …

This project developed a model for effective asset management drawn from successful programs in the United States, Australia, and New Zealand. Asset management practices were examined at the City of Ontario Utilities Department; a medium sized utility, and also at the Rainbow Municipal Water District, a small sized utility. Gaps between the ideal model and the existing practices were investigated.

The 1990 Clean Air Act Amendments (CAAA) established, in section 507, the Small Business Stationary Source Technical and Environmental Compliance Assistance Program (SBTCP). SBTCPs under the CAAA are designed to provide small stationary air pollution sources with technical and compliance assistance, develop tools and disseminate information, communicate requirements under the Act, and assist small businesses with pollution prevention.

In Kentucky, the compliance and technical assistance program is known as the Kentucky Business Environmental Assistance Program (KBEAP). The growth of ISO 14001 certificates worldwide has led to much research on the role of voluntary standards in improving the environmental impacts of industry. Most of this research, however, has focused on industrialized countries, with very little research examining the effects of ISO 14001 and other voluntary initiatives in the developing world. This is especially unfortunate because it is in these very countries that proponents of ISO 14001 claim the largest benefits of the standard will occur, by helping polluting industries improve performance and by assisting environmental regulators in enforcing laws more effectively.

A long-existing system of wolves (Canis lupus), muskoxen (Ovibos moschatus), and arctic hares (Lepus arcticus) in a 2600 km² area of Canada’s High Arctic (80° N latitude) began collapsing in 1997 because of unusual adverse summer weather but recovered to a level at which all three species were reproducing by 2004. Recovery of wolf presence and reproduction appeared to be more dependent on muskox increase than on hare increase.

In the ten years since wolves (Canis lupus) were restored to Yellowstone National Park (YNP), elk (Cervus elaphus) numbers have substantially decreased. The northern range elk herd is the largest elk herd in Yellowstone, and constitutes the majority of the park’s elk population. During 1994–2005, early winter counts of northern Yellowstone elk decreased from 19,045 to 9,545. Also, during winters 2000–2004, calf:cow ratios declined from 29:100 to 12:100, and were among the lowest recorded during the past several decades. Though many factors (e.g., predation, hunting, and drought) likely contributed to this decreasing abundance and low recruitment, …

The first purpose is to address the requirements of state law, as provided in the Nevada Revised Statutes (NRS) 278.150(4). Connecticut is in the midst of a demographic transition to a period of lower population growth. These demographic changes will help check the pressures exerted on the state's natural resources by population growth. Water, air, soil, energy sources, food, fisheries, forests, and biodiversity are common pool resources upon which we depend in ways that transcend political boundaries. Those governing Connecticut should help turn the state into a model of how to manage natural resources by halting forest fragmentation, reducing pollution, and promoting environmental science education.

The Clean Air Act of 1970 (CAA) made the Environmental Protection Agency (EPA) responsible for establishing and maintaining federal programs that control air quality. In turn, each state was delegated responsibility for air quality within its borders, although this responsibility may be shared with Native Americans or tribal lands. In many states, jurisdiction has been delegated to regional or local agencies that are then responsible for air quality in their respective air basins. Even though terrain or water bodies define the physical boundaries of air basins, they are usually designated by County boundaries for regulatory convenience (Wooley, David R., 1997).
