Mikhalevich & Powell make a compelling case that some invertebrates may be sentient and that our moral obligations in the context of welfare should hence extend to them. Although the case is similar to that made for fishes, there is one obvious difference in that examples of invertebrate sentience probably arose independently from vertebrate sentience. We have unequivocal proof that complex cognition arose multiple times over evolutionary history. Given that cognition is our best tool for indirectly quantifying sentience, it seems highly likely that this multiple polygenesis may also have occurred for sentience. Pangolins are one of the most heavily poached, yet least understood mammals in the world. In this study, we used an object-choice task to assess the ecological relevance and use of sensory information in Sunda pangolin foraging behavior. This is the first controlled experiment on pangolin behavior to our knowledge.

Treves et al. (2019) make a convincing case that conservation efforts need to go beyond an anthropocentric worldview. Implementing that vision, however, will require human advocates to represent nonhuman interests. Where will the knowledge of those interests come from? How can humans know what is in the best interest of another animal, a plant, or an ecosystem? We discuss how the values embedded in current scientific practices may be ill-suited to representing nonhuman interests and we offer some ideas for correcting these shortcomings.

Each of the criteria for determining which should be given moral standing has its shortcomings. The criterion of cognitive is especially weak. That research on comparative cognition may default to the simplest account is not grounds for abandoning this scientific practice. Instead, we should dissociate scientific evidence of cognitive ability from moral obligation. In addition to the criteria suggested by Mikhalevich & Powell for including species in welfare protections, I would suggest a very old one — the ability to physically move.

Thailand has fewer than 10,000 elephants left. More of them are living in captivity to serve the tourist industry under grim conditions than are living free in what is left of their wild habitat. Baker & Winkler (2020) provide a detailed examination of elephants in captivity, from an historical perspective to modern-day concerns. Concerns include the poor level of mahout skills and subsequent captive elephant welfare issues in the Thai elephant tourism industry. Rewilding is proposed as a method of rehabilitation and a way to include mahouts in the conservation process. In this commentary, we show that there are some unforeseen obstacles to applying the sort of individualistic welfare-based ethics that M&P have in mind to certain arthropods, namely, insects. We appreciate the goals of Mikhalevich & Powell (M&P) and largely agree with their conclusions but we differ on some of their definitions and terms. Affects (emotional feelings) should be part of sentience. Although the evidence presented for insect sentience is strong, we list some of the counterevidence that should be considered. Our own research supports M&P’s choice of arthropods, cephalopods, and vertebrates as the only sentient organisms with moral status.

Welfare protections for vertebrates are grounded in the belief that vertebrates are sentient and capable of feeling whereas invertebrates are not. We agree with Mikhalevich & Powell that the exclusion of small-brained invertebrates from bioethics is not warranted by the current state of the scientific evidence. The choice to promote protection for certain invertebrates should be based on the Animal Sentience Precautionary Principle (ASPP). Studies on invertebrate minds suggest that the neural machinery for basic cognition is cheap, and that bigger brains are probably associated with greater memory storage rather than more advanced cognition. Sentience may be linked to feedforward mechanisms (Reafferenzprinzip) that allow organisms with active movement to distinguish active and passive sensing. Invertebrates may offer special opportunities for testing these hypotheses.

When performing canine operant conditioning studies, the delivery of the reward can be a limiting factor of the study. While there are a few commercially available options for automatically delivering rewards, they generally require manual input, such as using a remote control, in accordance with the experiment script. This means that human reaction times and transmission distances can cause interruptions to the flow of the experiment. The potential for development of non-supervised conditioning studies is limited by this same factor. Recent empirical studies have reported evidence that many aquatic species, including fish, cephalopods and crustaceans, have the capacity for nociception and pain, and that their welfare should be taken into consideration. Some sceptics, rejecting the precautionary principle, have denied that any study demonstrates pain or other aspects of sentience in fish. This target article discusses some of the scientific shortcomings of these critiques through a detailed analysis of a study exploring nociception and analgesia in larval zebrafish.

The majority of commentaries are supportive of our position on the scepticism that muddies the waters surrounding fish pain and sentience. There is substantial empirical evidence for pain in fish. Animals’ experience of pain cannot be compared to artificial intelligence (AI) because AI can only mimic responses to nociceptive input on the basis of human observations and programming. Accepting that fish are sentient would not be detrimental to the industries reliant on fish. A more proactive discussion between scientists and stakeholders is needed to improve fish welfare for the benefit of all.

Mather argues convincingly for the existence of minds in octopuses based largely on laboratory experiments. Many of these experiments are highly invasive and involve mutilation and death. Moreover, octopuses are now being hailed as a “new model” for biological research and are being enthusiastically bred in captivity, both for research and for food. We argue that the compelling evidence for mind in octopuses must be accompanied by intense scrutiny of the ethics that shape how we treat them and that the intrinsic value of their individual lives must be recognized.
