Negar Azimi’s “Prisoners of Sex” is a welcome reminder that human rights discourse should always keep its subject, “humans,” firmly in view. The stories she tells of death, torture, hope, and survival bear witness to the challenges and dangers faced by gays and lesbians in Egypt.

Men who have sex with men have become a world cultural flashpoint. Fomenting and exploiting cultural rage at the West is a useful way for Islamists to gain electoral and other types of support, even though the motives of the Islamists may have more to do with the drive for power, regional influence, or economic benefit.

Published as Chapter 7 in Law and Legalization in Transnational Relations, Christian Brütsch & Dirk Lehmkuhl, eds.

This paper analyzes several emerging transnational regulatory systems that engage, but are not centered on state legal systems. Driven primarily by civil society organizations, the new regulatory systems use conventional technical standard setting and certification techniques to establish market-leveraged, social and environmental regulatory programs. These programs resemble state regulatory programs in many important respects, and are increasingly legalized. The case-law of the European Court of Human Rights concerning violations of human rights law during armed conflict has been extended after the first decisions on cases arose from violations, committed during the war in Chechnya between 1999 and 2000. In the words of the Court, at that time the situation called for exceptional measures, in order to regain control over the Republic and suppress an illegal armed insurgency. The legal status of international human rights litigation under the Alien Tort Statute (ATS) has been the subject of much debate, culminating in the Supreme Court's decision in Sosa v. Alvarez-Machain, 542 U.S. 692 (2004). The debate has been almost exclusively doctrinal and has focused on the Judiciary Act of 1789, the historical treatment of the law of nations as general or federal common law, the evolution of the Supreme Court's international law jurisprudence, and the integration of customary international law (CIL) into the domestic legal system.

To Condone Or Condemn? Regional Enforcement Actions In The Absence Of Security Council Authorization, Monica Hakimi

The U.N. Charter establishes that regional arrangements may not take enforcement actions without authorization from the Security Council. Yet the international community does not always enforce this Charter rule. Major international actors repeatedly tolerate deviations from it even as they assert that it allows no exceptions. This Article examines that practice, arguing that two different legal systems govern enforcement actions taken by regional arrangements. One system is reflected in the Charter text and publicly endorsed by major international actors. International development institutions (IDIs) have increasingly emphasized good governance and democratic reform in the provision of foreign assistance. This is especially apparent with respect to the United Nations Development Programme (UNDP), World Bank, European Union (EU), and United States Agency for International Development (USAID). This project describes and explains the good governance and democracy promotion program of each institution.

In 2006, NATO is operating well out of area and conducting missions beyond the collective defense limits of its founding Treaty. NATO increasingly supports humanitarian relief operations, while also engaged in Afghanistan, the Mediterranean, and African crisis spots.

These changes provide the reason to examine the thesis: only if NATO is able to effectively transform will it be able to continue in its role as the primary European security institution. In 1959, Fidel Castro established a Cuban socialist state closely aligned with the Soviet Union. The Soviet Union's collapse brought an end to Soviet economic support which, combined with the U.S. embargo, created an economic crisis in the early 1990s. The Cuban government's instability and desire to maintain control overrides the individual rights of its citizens. These events are the background for the lack of fundamental human rights in Cuba today.

Between 1979 and 1991 El Salvador was embroiled in a civil war that claimed over 70,000 lives. Longstanding socio-economic inequality between the rich and poor led to government-backed human rights abuses dispensed by the military. These ranged from denials of freedom and civil liberties to village massacres.
