Reconciliation And The Rule Of Law: The Changing Role Of International War Crimes Tribunals, Oriana Lavilla Jan 2014

Reconciliation And The Rule Of Law: The Changing Role Of International War Crimes Tribunals, Oriana Lavilla

Claremont-UC Undergraduate Research Conference on the European Union

This paper explores the relationship between international war crimes tribunals and reconciliation in post-conflict societies. The aim of the present study was to examine how the role of international war crimes tribunals has changed in the peacebuilding process since the early years after World War II. Due to the evolving nature of international law and the international criminal legal system, international tribunals have become increasingly recognized as an integral component of peacebuilding in post-conflict societies. The International Criminal Tribunal for the former Yugoslavia (ICTY) was the first international tribunal with a mandate to contribute to international peace and security. The …

Feuds Of A Thousand Years: Explaining Europe Via The World System, Hans Hubbard Jan 2014

Feuds Of A Thousand Years: Explaining Europe Via The World System, Hans Hubbard

Claremont-UC Undergraduate Research Conference on the European Union

This paper argues for a more comprehensive study of the European Union that includes consideration, not only of socio-economic and political processes, but also of changing conceptualisations of identity, governance and democratic legitimacy. It argues for a re-examination of traditional narratives that frame the European Union as a response to the cruelties of the Second World War. Several key paradoxes in European history cannot be satisfactorily accounted for through purely intra-European processes: the European idea’s pre-dating the Second World War; the lack of a strong impulse for unified defence; the UK’s late membership and euroscepticism; the desire for a closed-off …

Delayed Complementarity: How Schengen Area Membership Influenced German And Austrian Investment In Central And Eastern Europe, Romy L. Franks Jan 2014

Delayed Complementarity: How Schengen Area Membership Influenced German And Austrian Investment In Central And Eastern Europe, Romy L. Franks

Claremont-UC Undergraduate Research Conference on the European Union

This paper considers the mutually beneficial relationship of German and Austrian foreign direct investment (FDI) in Central and Eastern Europe (CEE) between 2004 and 2007, and the impact that the CEE states' belated membership in the Schengen Area had on further economic integration. It analyzes how excluding CEE member states from immediate membership in the Schengen Area upon their accession to the EU in 2004 and 2007 affected the economies of Germany, Austria, and the CEE member states. The paper argues that, in reviewing actual FDI and migration numbers following EU enlargements, fears over the potentially negative effects of labor …

Where’S The Consultation? The War Powers Resolution And Libya, Eileen Burgin Jan 2014

Where’S The Consultation? The War Powers Resolution And Libya, Eileen Burgin

The University of New Hampshire Law Review

[Excerpt] “President Barack Obama triggered a War Powers Resolution (WPR) controversy with his military response to the anti-government rebellion and civil war in Libya in 2011. Members of Congress seized upon the WPR, questioning whether the Obama administration had complied with the WPR’s requirements when the United States launched the initial Libyan Operation Odyssey Dawn (OOD) and subsequently participated in the North Atlantic Treaty Organization (NATO) Operation Unified Protector (OUP). Many legislators charged that President Obama had violated the WPR. Concerns centered on such issues as presidential reliance on the United Nations (U.N.) Security Council—rather than Congress—for authorization to act, …

Conflict Between Saudi Arabia And Iran: An Examination Of Critical Factors Inhibiting Their Positive Roles In The Middle East, Ghadah Alghunaim Jan 2014

Conflict Between Saudi Arabia And Iran: An Examination Of Critical Factors Inhibiting Their Positive Roles In The Middle East, Ghadah Alghunaim

Department of Conflict Resolution Studies Theses and Dissertations

Since 1979, Saudi-Iranian relations have been tense due to their position as superior powers in the Middle East. Both countries have different values and perspectives in regards to diplomatic relations with the West. As a consequence of the new developments in Iran's foreign policy and the newfound openness to the West adopted by President Rouhani, the topic has proven to be of research interest. The primary concern of this research was to explore the effect of the conflict between Saudi Arabia and Iran in the Middle East, and whether or not there is a possibility to overcome this conflict using …

Boycotts To Bombs: History, Causes, And Comparison Of The Palestinian Intifadas, Leah Wilson Jan 2014

Boycotts To Bombs: History, Causes, And Comparison Of The Palestinian Intifadas, Leah Wilson

Lewis Honors College Capstone Collection

One of the foremost geopolitical issues of the twenty first century, the conflict between Israel and Palestine has a complicated, ominous history, and limited signs of hope for resolution in the near future. Darkened by particularly bloody and significant events such as the 1948 Arab-Israel dispute, the 1967 Six Day War, and the continuously violent actions taken near the turn of the century, the conflict continues to detrimentally impact the security of the region, the socioeconomic livelihood of Palestinians, and the dwindling influence of international actors to curb recognizably illegal settlements and flagrant human rights violations. Particularly significant to the …

Happiness In Public Policy, Laura Musikanski Jan 2014

Happiness In Public Policy, Laura Musikanski

Journal of Sustainable Social Impact

The happiness movement represents a new paradigm where social, economic, and environmental systems are structured to encourage human well-being in a sustainable environment. Bhutan has adopted Gross National Happiness (GNH) as a way of determining its society’s success in contrast to purely economic goals and the singular use of the gross domestic product indicator. Bhutanese policy promulgation includes use of a GNH screening tool. In the United Kingdom, happiness indicators are being used to collect data and the government is starting to explore their application to policy. The Bhutanese GNH policy screening tool has been adapted for the grassroots activists, …

Aiming For Certainty: The Kanun, Blood Feuds And The Ascertainment Of Customary Law, Sandra F. Joireman Jan 2014

Aiming For Certainty: The Kanun, Blood Feuds And The Ascertainment Of Customary Law, Sandra F. Joireman

Political Science Faculty Publications

Customary law is an alternative legal framework to statute or public law. In the past the existence of customary law was viewed as problematic due to the uncertainty which accompanies legal pluralism. Increasingly, scholars are recognizing legal pluralism as simply a reality to be negotiated, rather than a problem. One frequently proposed solution to the difficulties posed by the existence of customary law is to write it down, or ascertain it, in order to provide for legal certainty. This article addresses this goal in three parts. The first part describes customary law and how it functions in its uncodified form …

Yemen Between Revolution And Counter-Terrorism, Sheila Carapico Jan 2014

Yemen Between Revolution And Counter-Terrorism, Sheila Carapico

Political Science Faculty Publications

This chapter juxtaposes these seemingly two quite different storylines - one about Yemeni aspirations for social justice and better governance and the other about American and Saudi operations undertaken in the name of combating terrorism. The so-called GCC Initiative, and in particular the National Dialogue Conference process playing out as this book goes to press, provides the link between them. From the perspective of domestic politics, the Dialogue can be read as the outcome of agitation by the new generation of 'peaceful youth', as well as an outgrowth of Yemen's tradition of dialogue - an historic effort to resolve crisis …

Rebuilding Communities After Violent Conflict: Informal Justice Systems And Resource Access, Sandra F. Joireman Jan 2014

Rebuilding Communities After Violent Conflict: Informal Justice Systems And Resource Access, Sandra F. Joireman

Political Science Faculty Publications

A community recovering from war or ethnic conflict has to find ways of reweaving the fabric of economic and social life with new patterns of interaction and changed demographics.2 In post-‐‑conflict settings customary law has a particular attraction because of the moral authority it brings to the establishment of order. Customary law is familiar, tied to the identity and history of a community, and operates independently of outside resources. Although the term evokes images of a universal acceptance and ancient origin, customary law has always been dynamic, defined by those in power, and subject to political interests.3 Informal …

Transnational Marriage: Modern Imaginings, Relational Realignments, And Persistent Inequalities, Coralynn V. Davis

Faculty Journal Articles

In the context of shifting cultural anchors as well as unstable global economic conditions, new practices of intimacy and sexuality may become tactics in an individual’s negotiation of conflicting desires and potentials. This article offers reflection on the interface between global forces, powerful transcultural narratives, and state policies, on the one hand, and local, even individual, constructions and tactics in regard to sexuality, marriage, migration, and work, on the other. The article focuses on the life trajectory of Gudiya, an ambitious young Hindu woman who started out life with little social capital and few economic resources in a dusty corner …

A Political And Historic Analysis Of The Relationship Between The United States And Saudi Arabia: How The Relationship Between The United States And Saudi Arabia Has Influenced U.S. Foreign Policy In The Middle East, Caitlin Baalke Jan 2014

A Political And Historic Analysis Of The Relationship Between The United States And Saudi Arabia: How The Relationship Between The United States And Saudi Arabia Has Influenced U.S. Foreign Policy In The Middle East, Caitlin Baalke

Honors Projects

This research discusses the importance of the relationship between the United States and Saudi Arabia and how this relationship has influenced and shaped U.S. foreign policy in the Middle East. The relationship is framed by the international relations theory of neoclassical realism and the institutions theory of critical junctures. Through this framework, a historical and political case study is performed, analyzing the antithesis that the relationship has continued throughout history because of economic interests and oil. This paper discusses the alternative hypotheses and the other factors that have played an important role in U.S. foreign policy in the Middle East, …

How Civil Society Represents Women: Feminists, Catholics, And Mobilization Strategies In Africa, Alice J. Kang Jan 2014

How Civil Society Represents Women: Feminists, Catholics, And Mobilization Strategies In Africa, Alice J. Kang

Department of Political Science: Faculty Publications

In recent years, civil society has risen to speak on behalf of underrepresented groups in Africa. In particular, civil society has advocated for the representation of women’s interests. Yet, relatively little is known about the full range of actors who seek the representation of women’s interests, mobilize around women’s issues, and articulate specific preferences. Some of these actors include not only feminists, but also religious activists who may clash over women’s issues. This gap in knowledge, moreover, extends to non-democratic countries. Who in civil society seeks to influence the representation of women’s interests and how, in both democratic and authoritarian …

North Korean Supernotes: Nuclear Arms Financed By Counterfeit Currency

The primary purpose of this study was to evaluate whether DPRK is producing high quality counterfeit US currency, supernotes, and has determined to what extent supernotes are financing North Korea's emerging nuclear arms program.

The application of Analysis of Competing Hypotheses, ACH, satisfied this study's purpose by meeting the following objectives: the development of multiple hypotheses in an attempt to explain a supernote-nuclear arms program link, assessing evidence from assorted sources, providing a diagnostic weighing …

Reversing The Flood Of Forced Displacement: Shedding Light On Important Determinants Of Return Migration, Prakash Adhikari Ph.D., Wendy L. Hansen Ph.D. Jan 2014

Reversing The Flood Of Forced Displacement: Shedding Light On Important Determinants Of Return Migration, Prakash Adhikari Ph.D., Wendy L. Hansen Ph.D.

Himalayan Research Papers Archive

Most current research on forced migration focuses on explaining patterns of displacement during armed conflicts and the role that social networks play in pulling people away from conflict torn areas. But what happens to displaced persons after a conflict ends? While many of these individuals are able to resettle in the place to which they fled during conflict, some individuals return to their places of origin while others remain in limbo. This research seeks to better understand behavior after flight. Using a rational choice framework, we theorize that people are strategic in their calculations of the costs and benefits of …

Cooperative Security: The American Strategy For A Rising China, Ethan Landau Jan 2014

Cooperative Security: The American Strategy For A Rising China, Ethan Landau

CMC Senior Theses

This paper analyzes the theoretical underpinnings and strategic goals of US security strategy with respect to China. It argues that the language used in statements and publications of US strategy demonstrate the development of a strategy of cooperative security. This strategy is dependent on the security environment the United States cultivates with allies and partners in the region. The paper uses evidence from the two largest PACOM military operations--RIMPAC and Cobra Gold-to demonstrate this developing strategy.

Moscow, We Have A Problem: Russia's Inconsistent Approach To The Evolving Concept Of Sovereignty In The 21st Century, Hillary E. Lundberg Jan 2014

Moscow, We Have A Problem: Russia's Inconsistent Approach To The Evolving Concept Of Sovereignty In The 21st Century, Hillary E. Lundberg

CMC Senior Theses

The 1648 Peace of Westphalia created an understanding of state sovereignty free from external interference that remained largely unaltered until the last century. The horrors of the Holocaust and the significant humanitarian crises of the 20th century have presented the international community with a new type of threat to international peace and security and have sparked an ongoing conversation about the limitations of traditional sovereignty. Russia has positioned itself as a firm supporter of a strict adherence to the Westphalian concept of sovereignty, but my thesis argues that Russians do not value this interpretation as much as they claim …

Why Restrictions On The Immigration Of Health Workers Are Unjust, Javier S. Hidalgo Jan 2014

Why Restrictions On The Immigration Of Health Workers Are Unjust, Javier S. Hidalgo

Jepson School of Leadership Studies articles, book chapters and other publications

Some bioethicists and political philosophers argue that rich states should restrict the immigration of health workers from poor countries in order to prevent harm to people in these countries. In this essay, I argue that restrictions on the immigration of health workers are unjust, even if this immigration results in bad health outcomes for people in poor countries. I contend that negative duties to refrain from interfering with the occupational liberties of health workers outweighs rich states’ positive duties to prevent harm to people in sending countries. Furthermore, I defend this claim against the objection that health workers in poor …

The China Dream And The American Dream, William A. Callahan Jan 2014

The China Dream And The American Dream, William A. Callahan

Research Collection School of Social Sciences

Since Xi Jinping invoked “The China Dream” as a key concept in November 2012, this phrase has come to dominate discussions of China’s future. This paper will examine the China dream phenomenon first by placing it in the context of debates that have been raging in Chinese civil society over the past few years. It will analyze the works of 20 prominent “China dreamers” in terms of debates over the proper relationship between (1) politics and economics, (2) equality and hierarchy, (3) civilization and civility, and (4) nationalism and statism. The other main context for the China dream concept is …

How Ending Gender Violence In India Improves The Nation's International Reputation And Tourism Industry: A Case For Nationalism, Sharon Nambudripad Schiffer Dec 2013

How Ending Gender Violence In India Improves The Nation's International Reputation And Tourism Industry: A Case For Nationalism, Sharon Nambudripad Schiffer

Graduate Masters Theses

As nations have become far more interconnected by means of globalization in the 21st century, the issues that affect one nation often have affects upon others. As India is a nation with a population of more than 1.2 billion, the issues that affect the nation also affect others. As an assault in Delhi, India made international news on December 16, 2012, the international community has become more aware of the incidents of gender-based violence that exist within the country. The ramifications of the international community's knowledge of the assault included a drastic decrease in both its international reputation and its …

China's Rise And The Confucius Institutes: Chinese And American Perspectives, Shryll Whittaker Dec 2013

China's Rise And The Confucius Institutes: Chinese And American Perspectives, Shryll Whittaker

Seton Hall University Dissertations and Theses (ETDs)

The Confucius Institutes are Chinese government-backed nonprofit organizations that promote Chinese language and culture. They are housed on collegiate campuses and designed to complement Chinese language and cultural studies by providing teachers, curriculums, textbooks and other educational materials. Their establishment has been a source of controversy, especially in the United States, due to the institutes’ close ties with and the financial, administrative, and political support they receive from the Chinese government. Critics have had two primary concerns: that the Confucius Institutes provide the Chinese government access to increase soft power by issuing propaganda and that their presence on American collegiate …

The Lion & The Ringmaster: Croatia's Accession To The European Union, Jelena N. Bilandzich Dec 2013

The Lion & The Ringmaster: Croatia's Accession To The European Union, Jelena N. Bilandzich

Master's Theses

July 1, 2013 marked Croatia's official induction into the European Union. For Croatia this was the culmination of a long negotiation process filled with concessions and challenges. This situation inspired the question of how Croatia's alliance with the EU has affected the state? In order to analyze this relationship the aspects of Croatian identity and sovereignty were explored, in addition to the EU's principles and problems regarding member and candidate states. The evidence found within this investigation came from a number of literary sources ranging from the academic to official government documents. Furthermore, nine interviews were conducted within Croatia, which …

The Plight Of Kenyan Domestic Workers In Gulf Countries, Caroline Muthoni Gikuru Dec 2013

The Plight Of Kenyan Domestic Workers In Gulf Countries, Caroline Muthoni Gikuru

Master's Theses

Kenya’s economy remains the regional leader within the East African Community (EAC) and among East African countries at large. However, political instability such as the 2007 post-election violence and the region’s social and political instability trickling into Kenya, have negatively affected the country’s economic growth. To bridge the economic gap, Kenyan women are seeking employment in the domestic service sector in the Gulf Countries, with Saudi Arabia being the most popular destination. At their destination countries, some domestic workers are subjected to various forms of abuse by their employers, leaving the worker without recourse due to the lack of legal …
