การปฏิรูปโครงสร้างการอภิบาลน้ำของไทยเกิดขึ้นหลังจากเหตุการณ์น้ำท่วมใหญ่ พ.ศ. 2554 เพื่อลดความเสี่ยงอุทกภัยและสร้างความมั่นคงในภาคการผลิต มีผลต่อสมดุลอำนาจทั้งในการกำหนดนโยบายและการปฏิบัติตั้งแต่ในระดับชาติจนถึงท้องถิ่น บทความปริทัศน์ชิ้นนี้สะท้อนความก้าวหน้าและความท้าทายในการจัดการน้ำของประเทศไทยภายใต้กรอบแนวคิดการอภิบาลน้ำแบบมีส่วนร่วม ผลการศึกษาพบว่าการจัดการน้ำในปัจจุบันเริ่มให้ความสำคัญต่อวิถีชีวิตผ่านการใช้พื้นที่รับน้ำนองและโครงการจัดการน้ำชุมชนด้วยข้อมูลสารสนเทศ แต่มิได้ทำให้เกิด “จุดเปลี่ยนแห่งความร่วมมือ” อย่างแท้จริง เนื่องจากการเปลี่ยนศูนย์อำนาจการจัดการน้ำไปสู่ระบอบรัฐราชการอย่างเข้มข้น ทำให้ชาวชนบทที่รองรับน้ำท่วมให้ภาครัฐมีวิถีชีวิตอยู่บนความไม่แน่นอน และยังเปิดโอกาสให้ภาคการเมือง ภาคประชาสังคม ชุมชนท้องถิ่น และภาคส่วนอื่น ๆ ในการมีส่วนร่วมกำหนดนโยบายน้อยเกินไป จึงขาดการบูรณาการความรู้ที่หลากหลาย และการกำหนดสิทธิในการจัดการน้ำร่วมกันอย่างเสรี การต่อรองระบอบอภิบาลน้ำควรต้องดำเนินต่อไปให้สอดคล้องกับความต้องการที่แท้จริงของสังคม

บทความวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) และ 2) เพื่อเสนอแนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ใช้การวิจัยเชิงปริมาณ โดยใช้แบบสอบถาม (questionnaire) กับ 1) บุคลากรขององค์กรปกครองส่วนท้องถิ่น ประกอบด้วย นายกองค์กรปกครองส่วนท้องถิ่นหรือตัวแทน ปลัดองค์กรปกครองส่วนท้องถิ่น เจ้าพนักงานป้องกันและบรรเทาสาธารณภัย นักสาธารณสุขและสิ่งแวดล้อม จำนวน 104 คน 2) บุคลากรโรงพยาบาลส่งเสริมสุขภาพตำบล ประกอบด้วยผู้อำนวยการโรงพยาบาลส่งเสริมสุขภาพตำบล พยาบาลวิชาชีพชำนาญการ เจ้าพนักงานสาธารณสุขชำนาญงาน จำนวน 60 คน 3) ตัวแทนชุมชน จำนวน 140 คน รวมทั้งสิ้น 304 คน วิเคราะห์ข้อมูลด้วยสถิติเชิงพรรณนา ผลการวิจัยพบว่าระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ในภาพรวมอยู่ในระดับมาก ( = 4.06, S.D. = 0.52) เมื่อพิจารณาเป็นรายด้าน พบว่าด้านที่มีค่าเฉลี่ยสูงที่สุด คือ การพัฒนาศักยภาพระบบการเตรียมพร้อม ( = 4.15, S.D. = 0.54) รองลงมาคือ การเสริมสร้างความร่วมมือการเตรียมพร้อมรับมือ ( = 4.06, S.D. = 0.60) การบริหารจัดการแผนแบบบูรณาการ ( = 4.02, S.D. = 0.66) และการเสริมสร้างศักยภาพของทุกภาคส่วน ( = 3.89, S.D. = 0.43) ตามลำดับ 2) แนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ได้แก่ การเสริมสร้างศักยภาพของทุกภาคส่วน ประกอบด้วยการเสริมสร้างศักยภาพขององค์กรปกครองส่วนท้องถิ่น การเสริมสร้างศักยภาพของโรงพยาบาลส่งเสริมสุขภาพตำบล การเสริมสร้างศักยภาพของชุมชน การเสริมสร้างศักยภาพของอาสาสมัครสาธารณสุขประจำหมู่บ้าน (อสม.) และการเสริมสร้างศักยภาพของประชาชน

อินเดียกับการจัดการจลาจลในกรณีแคชเมียร์, สุรัตน์ โหราชัยกุล, สิริกร ธารีรัตนาวิบูลย์

นับตั้งแต่ได้รับเอกราชในปี ค.ศ. 1947 อินเดียก็เผชิญความท้าทายด้านความมั่นคงมาโดยตลอด ในบรรดาความท้าทายเหล่านั้น การก่อจลาจลในรูปแบบต่าง ๆ ที่เกี่ยวกับแคชเมียร์หรือในแคชเมียร์ ปัญจาบ ภูมิภาคตะวันออกเฉียงเหนือ และนักซาไลต์ เป็นภัยคุกคามที่บั่นทอนความมั่นคงแห่งชาติของอินเดียมากที่สุด บทความนี้มีวัตถุประสงค์เพียงข้อเดียวคือ เพื่อตอบคำถามวิจัยว่าอินเดียมีวิธีจัดการกับปัญหาจลาจลในแคชเมียร์อย่างไร ในขณะเดียวกันก็มีข้อโต้แย้งสำคัญสองประการ คือ (1) การก่อจลาจลในแคชเมียร์มีปัจจัยภายนอกมาเกี่ยวข้องอย่างสำคัญยิ่ง ทำให้รัฐบาลอินเดียแก้ปัญหาได้ยากลำบาก และ (2) การแก้ปัญหาแคชเมียร์ของอินเดียมีหลักคิดและวิธีตรงกับกรอบความมั่นคงแบบดั้งเดิมและกรอบความมั่นคงของมนุษย์ผสมผสานกัน ต่างจากโลกวิชาการที่มักจะมองกรอบทั้งสองแยกจากกันสิ้นเชิง บทความแบ่งออกเป็น 3 ส่วน ส่วนแรกบรรยายพัฒนาการประเด็นปัญหาการจลาจลในแคชเมียร์ ส่วนที่สองอธิบายการจัดการจลาจลแคชเมียร์ของอินเดีย และส่วนสุดท้ายสรุปเนื้อหาใจความของบทความพร้อมทิ้งท้ายด้วยข้อคิดบางประการ

วัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาซึ่งเป็นองค์การที่มีศักยภาพในการทำหน้าที่ของสมองซีกขวาในการผลิตจินตนาการนั้น เป็นหัวใจสำคัญในการสร้างนวัตกรรมองค์การระดับโลก อาทิ มหาวิหาร ซากราดา ฟามิเลีย บทความนี้มีวัตถุประสงค์เพื่อศึกษาลักษณะการบริหารวัฒนธรรมองค์การ ของวัดร่องขุ่น จังหวัดเชียงราย ว่าได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาหรือไม่ อย่างไร ในการสร้างนวัตกรรมองค์การ และศึกษามาตรการเพื่อส่งเสริมและประยุกต์ใช้กับองค์การภาครัฐ โดยอาศัยการบูรณาการข้ามศาสตร์ ด้วยวิธีวิจัยแบบผสม ทั้งเชิงปริมาณและคุณภาพ เครื่องมือในการวิจัย ได้แก่ แบบสอบถาม แบบสัมภาษณ์กึ่งโครงสร้าง และแบบสัมภาษณ์เชิงลึก กลุ่มตัวอย่าง ได้แก่ กลุ่มผู้ที่ปฎิบัติงานในวัดร่องขุ่น กลุ่มผู้เชี่ยวชาญสาขาต่าง ๆ และกลุ่มสาธารณชน ข้อค้นพบคือ (1) การบริหารวัฒนธรรมองค์การของวัดร่องขุ่น ได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาทุกมิติ ข้อมูลจากแบบสอบถามแสดงว่ากลุ่มตัวอย่างมีการรับรู้วัฒนธรรมสร้างสรรค์ ลักษณะองค์การสมองซีกขวา และการสร้างนวัตกรรมของวัดร่องขุ่น อยู่ในระดับสูงที่สุด สอดคล้องกับผลการสัมภาษณ์และข้อเสนอทางทฤษฎี (2) มาตรการส่งเสริมและประยุกต์ใช้การบริหารด้วยแนวทางวัฒนธรรมสร้างสรรรค์ขององค์การสมองซีกขวา เพื่อสร้างนวัตกรรมขององค์การภาครัฐ ได้แก่ การส่งเสริมวัฒนธรรมเชิงรุกและวัฒนธรรมมืออาชีพ การขจัดวัฒนธรรมความกลัวและวัฒนธรรมการลอกเลียนแบบ

In response to the rise of incarceration in jails and prisons, and the number of children adversely impacted by their parents’ incarceration, in 1993, a nonprofit organized called Companions Journeying Together (“CJT”), created the Aunt Mary’s Storybook (AMS) program to foster positive connections between incarcerated parents to their children. What began as a Christmastime program for mothers in the Cook County Jail has grown into a year-round program operating in prisons and jails throughout Illinois. AMS provides those incarcerated with an opportunity to record themselves reading a book to their children, and AMS then mails/transmits the recording along with a …

Abstract
The present study investigated the impact of departmental procedural fairness on officers' psychological well-being and engagement in citizenship behaviors. An additional variable considered was the mediating impact of psychological safety on officers' psychological well-being and citizenship behaviors. The findings of this study identify internal operations of police departments as fertile ground for systemic improvements within policing.

Criminal defendants unable to afford an attorney are entitled to one for free in the United States, but how and when they obtain access to that lawyer is another question. We examine judicial attitudes and behavior in granting access to counsel in areas where logistics are particularly forbidding. Based on survey responses from 1,091 magistrate judges presiding in lower criminal courts in suburban and rural jurisdictions in upstate New York, we describe both the procedures used to determine defendants' financial eligibility for free counsel, and the logistical challenges that surround securing the physical presence of a lawyer at the first …

งานวิจัยเรื่อง “แนวทางการเพิ่มประสิทธิภาพของการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556” มีวัตถุประสงค์เพื่อศึกษาแนวทางการบังคับใช้กฎหมายของต่างประเทศในการป้องกันปราบปรามองค์กรอาชญากรรมข้ามชาติ ประเมินผลการดำเนินงานและผลกระทบของการบังคับใช้ รวมทั้งปัญหาอุปสรรคของหน่วยงานในกระบวนการยุติธรรมและหน่วยงานที่เกี่ยวข้องต่อการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 อันนำมาสู่การเสนอแนะแนวทางการเพิ่มประสิทธิภาพของการบังคับใช้พระราชบัญญัติฉบับนี้ โดยเป็นการวิจัยเชิงผสมผสานระหว่างการวิจัยเชิงปริมาณและการวิจัยเชิงคุณภาพ ผลการศึกษาพบว่าการบังคับใช้พระราชบัญญัติฉบับนี้มีประสิทธิภาพในด้านคุณภาพของการนำมาใช้ โดยสามารถเป็นเครื่องมือในการป้องกันและปราบปรามการกระทำผิดขององค์กรอาชญากรรมข้ามชาติขนาดใหญ่ที่ส่งผลกระทบมูลค่ามหาศาล บรรลุเจตนารมณ์ของกฎหมายในการลงโทษองค์กรอาชญากรรมข้ามชาติ ข้อเสนอแนะที่สำคัญ ได้แก่ การกำหนดนโยบายในการนำพระราชบัญญัติฉบับนี้มาใช้อย่างจริงจัง การจัดทำคู่มือการปฏิบัติงานควบคู่กับการสร้างความรู้ความเข้าใจแก่เจ้าหน้าที่ผู้เกี่ยวข้อง และการจัดตั้งหน่วยงานกลางทำหน้าที่ใน การตรวจสอบคดีที่เกี่ยวข้องกับองค์กรอาชญากรรมข้ามชาติ เป็นต้น

This study uplifted the stories of formerly incarcerated and/or system-impacted students attending a California community college (i.e., “Rising Scholars”) to provide qualitative context to a growing literature following the state’s promotion of support programs at the University of California (UC), California State University (CSU), and California Community Colleges (CCC) systems. When a defendant is arrested, they can choose to either hire a private attorney to represent them, have appointed counsel such as a public defender, or have no representation. While the Sixth Amendment guarantees the right to counsel regardless of a defendant’s ability to pay, this counsel is not always required at first appearance. In fact, only 14 states have made it a requirement to have counsel at first appearance, and even in those states, counsel is not always appointed immediately. This thesis explores how the COVID-19 pandemic has impacted wildlife rangers with an emphasis on the influences of tourism rates. Two sets of data are used: one is a survey of rangers around the world and the other looks at global governmental tourism data. While coming from a routine activities perspective, the problem of decreased capable guardianship becomes apparent in the form of massively decreased tourism arrivals and troubling ranger perceptions. Previous studies have linked victimization with poor mental health scores, especially in the LGBTQ+ college population. They also showed a higher rate of victimization for LGBTQ+ students. The goal of this study was to investigate the relationship between victimization and mental health in the LGBTQ+ college population. To conduct this study, I used data from the Spring 2021 and 2022, American College Health Association (ACHA) - National College Health Assessment (NCHA). Mexico represents a dichotomy of images: first, as a land of sun, surf, and a place of destiny for vacationers, and second, as providing a haven for violent drug cartels operating with virtual impunity from the power of the state that appears unable to provide a fundamental duty - public safety. In the current environment of cartel violence, festive similes of mariachis called narcocorridos are muffling traditional Mexican poems by singing ballads praising drug cartel leaders. Policing in Canada and America has come under the microscope due to several high-profile incidents of police violence against racialized citizens. The murder of George Floyd by officer Derek Chauvin thrust the concept of ‘defund the police’ to the mainstream public dialogue. To date, there are few studies that explore what defund the police means. The present media analysis addresses this research gap by analyzing how Canadian mass media covered the defund police movement. © 2020, The Author(s). The internet mafia trope has shaped our knowledge about organised crime groups online, yet the evidence is largely speculative and the logic often flawed. This paper adds to current knowledge by exploring the development, operation and demise of an online criminal group as a case study. In this article we analyse a DDoS (Distributed Denial of Service) stresser (also known as booter) which sells its services online to enable offenders to launch attacks. This article explores the links between internet radicalization, access to weapons, and the current threat from terrorists who have been radicalized online. The prevalence of domestic terrorism, domestic hate groups, and online incitement and radicalization have led to considerable focus on the tension between counterterror efforts and the First Amendment. Many scholars recommend rethinking the extent of First Amendment protection, as well as Fourth, Fifth, and Sixth Amendment protections, and some judges appear to be listening. The graphic and bodily facts of a legal question of rights are relevant to the courts, particularly in questions that directly implicate physical bodies and pain, such as right to die cases, or what level of search may be allowable and when. However, in the case of abortion, or more specifically the bodily ramifications of pregnancy and childbirth, this detail is conspicuously absent. This article, relying on a content analysis of over 220 legal opinions on abortion rights, documents this absence of rhetoric. Law enforcement agencies across the United States are establishing real-time crime centers (RTCCs) at a rapid rate, yet research exploring the decisions to establish them is lacking. This study therefore attempts to fill that void by using a mixed methods approach to examine whether adaptive organizational theories, consisting of contingency theory (Lawrence & Lorsch, 1967; Woodward, 1965), resource dependency theory (Pfeffer & Salancik, 1978), and institutional theory (DiMaggio & Powell 1991; Meyer & Rowan, 1977), can be used to explain a law enforcement agency's decision to set up an RTCC. The spatialisation of violent crime is explored in two large case studies, Chicago and Sydney, using spatial econometric methods and macro-sociological variables derived from Social Disorganisation Theory.
Social Disorganisation Theory (SDT) is introduced in terms of its formulation in response to highly specific conditions arising in Chicago, as well as its adoption of methodological and theoretical developments from existing traditions. This specificity belies its breadth of application and enduring presence in criminology. Housing insecurity is one of the main drivers of poverty and inequality in contemporary urban society. We know that this insecurity contributes to poor outcomes for the individuals experiencing it. We know less about how this housing insecurity impacts contact with the criminal justice system. Using event history analysis, this study assesses the effects of housing insecurity in Polk County Iowa and Palm Beach County Florida. Results confirm that housing insecurity increases the risk of being rearrested each day a person is without stable housing. Previously juveniles as young as 14 guilty of murder were eligible to be sentenced to life without the possibility of parole. However, the decision of Miller v. Alabama (2012) declared mandatory life without the possibility of parole (LWOP) unconstitutional. Juveniles sentenced to LWOP were now able to be either resentenced or eligible for possible parole. The current study examined which scales on the Personality Assessment Inventory (PAI) predict parole outcomes for adult men seeking parole who committed murder when they were juveniles and sentenced to LWOP. For decades, commentators have adopted a story of mass incarceration’s rise as caused by “punitive populism.” Growing prison populations, expanding criminal codes, and raced and classed disparities in enforcement result from “pathological politics”: voters and politicians act in a vicious feedback loop, driving more criminal law and punishment. The criminal system’s problems are political. But how should society solve these political problems? Scholars often identify two kinds of approaches: (1) the technocratic, which seeks to wrest power from irrational and punitive voters, replacing electoral politics with agencies and commissions; and (2) the democratic, which treats criminal policy as insufficiently responsive …

Fines and fees for legal violations finance American criminal justice systems but often at a severe cost to those incurring fines and fees. While fines and fees are a long-standing feature of the United States criminal justice system, the use of fines and fees recently captured attention of scholars in the wake of questions prompted by recent social, political, and legal developments.
