Juvenile Solitary Confinement And The Eighth Amendment, Taylor R. Graves

This literature review examines the practice of juvenile solitary confinement, applies the United States Supreme Court’s Eighth Amendment jurisprudence, argues that the practice should be declared unconstitutional as a violation of the Eighth Amendment, and calls for a categorical ban. The Cruel and Unusual Punishment Clause of the Eighth Amendment states, “nor [shall] cruel and unusual punishments [be] inflicted.” U.S. Const. amend. VIII. Juvenile solitary confinement is cruel and unusual, in violation of the Eighth Amendment, because juveniles are different. Since its inception, the United Nations Convention Against Torture (UNCAT) conceived torture as a state crime. The Convention established a so-called “state-nexus” that effectively excludes torture committed by non-state actors. The Committee Against Torture as well as the world’s major anti-torture NGOs have almost exclusively focused on ill-treatment perpetrated by state entities. Yet, there have been efforts to extend the definition to private actors, including the “de facto authority” approach, and the due diligence doctrine. Juveniles, Transferred Juveniles, And The Impact Of A Criminal Record On Employment Prospects In Adulthood: An Experimental Study, Joanna Daou

Previous research shows that a criminal record reduces an individual’s employability. The impact of a juvenile record on employability as a young adult, however, has rarely been examined, and no previous studies have estimated the effect of a criminal record when a juvenile was waived to the adult court. The current study seeks to fill these gaps in the literature using an experimental correspondence approach. The results of this research indicate that the effects of a delinquency record on employability for juveniles and young adults are comparable to the effects of a criminal record for adults.

However, recent research has shown that the MBTI is host to a variety of significant validity issues, and the test altogether fails to address any aspects of deviant personality. Testing The Protest Paradigm And Racial Threat: Analyzing Articles Of Blm Protests In 2014 And 2020, Rebecca Angela Ruiz

The study examines the media coverage of Black Lives Matter protest in years 2014 & 2020. I collected a sample of articles (n=120) from 6 national-level media outlets that varied in political leans. Using the Protest Paradigm and Racial Threat theoretical frameworks to analyze the results, findings suggest that the articles do reflect upon the Protest Paradigm through overall negative sentiment and significant references to looting. I also argue that articles may also reflect racial threat due to a lack of transparency of protesters’ racial makeup or diversity attending demonstrations.

Racial Differences In Perceptions Of Sanction Severity, Sarah L. Franklin

Research has consistently found an association between race and relative perceptions of incarceration severity. Black people view incarceration as less severe than an equivalent period of probation. However, few studies have examined why this relationship exists. The present study surveys a large sample of young adults to examine whether the observed relationship between race and incarceration severity can be replicated. In doing so, the study then considers whether constructs related to socioeconomic status, criminal system experiences, perceptions of legitimacy, and sanction attitudes explain the racial divide. Results indicate a significant relationship between race and incarceration severity, such that Black people, …

One in 12 children will have a parent incarcerated at some point in their lifetime, with a staggering rate of one in four for African American children (Wildeman et al., 2018). Though the incarcerated populations have been in decline across the United States in the past decade (Carson, 2020), its impact still dwarfs that of most other countries (Coyle et al., 2016). While an increasing number of researchers, non-profit organizations, and law enforcement agencies have expressed growing concern about the relationship between involuntary celibates (i.e., incels) and violence, no research to date has examined the potential for suicide and self-harm among men who call themselves incels. This study examines suicide posts shared to incel sub-Reddits that were collected by u/IncelGraveyard (N=80). The posts reveal that the notes discuss six subordinate themes, including the method of their planned attempt, the ways they used the internet, the online incel community, failed alternatives and coping, the effects of their suicide on others, and the afterlife. …

The current ethnographic study reflects my participation in elements of the three stages of the correctional officer training program (CTP) offered by the Correctional Service of Canada (CSC). Unpacking my experience, I use Van Maanen and Schein (1977) theory of organizational socialization to analyze the formal and informal socialization processes inherent to the structure of the training academy. Thematic reflection on informal socialization processes reveal that the pressures tied to module content and testing reinforce values welcomed by CSC, such as organizational commitment, before the recruit’s arrival at the academy. Sex offense registration and notification (SORN) policies can contribute to stigma and negative consequences for partners of registered individuals. The present study utilized a self-report questionnaire to ask these partners what they would say to policymakers if given the opportunity. A thematic analysis of the responses revealed three themes which highlight the distinct issues related to registries, describe direct consequences experienced by the partners, and propose changes to existing policy. This study provides valuable insight into the experiences of a hard-to-reach population and can help generate critical discussion around the sweeping impacts SORN policies have on individuals they were not …

The significance of social supports throughout an individual’s life-course has been widely documented. However, there is ambiguity about whether social supports are likely to encourage or discourage reoffending. The current study qualitatively examines the kinds of support offered to a sample of probationers and parolees by their social support networks through a thematic analysis of transcripts gained from semi-structured interviews with 15 clients and 16 of their “PoPPs” (parents/partners/peers of probationers and parolees). Results indicate that there are several forms of support provided by correctional clients’ loved ones. These forms of support were well-received by the clients who considered them …

Prison programs have existed for decades; however, recent attention towards prison reform has raised awareness of the importance of correctional education. Research has shown that many of these programs are highly effective for incarcerated individuals in that program participation is likely to decrease recidivism and increase post-release employment success. Using in-depth interviews with 40 currently incarcerated men – 20 of whom participated in a 2-year prison program (the LIFERS program) and 20 who did not – and matched institutional records for visitation and disciplinary infractions, this study expands on the current research by assessing additional measures of program efficacy, including …

Criminologists and psychologists have long recognized that parenting practices can affect childhood outcomes and the development of moral beliefs in children. Another body of literature provides evidence that morality is a key cause of antisocial behavior. Yet, a noticeable gap in this line of work has been testing the mediation effects of parenting practices on cyberbullying via moral beliefs. Using a sample of South Korean adolescents, we tested whether moral beliefs mediate the relationships between parenting practices and cyberbullying perpetration.
