For the criminal defendant, his attorney acts as his loyal and zealous advocate before the court (American Bar Association, 2015), and due process protections of the U.S. adversarial system have afforded this relationship special privilege. In this chapter, we explore the influence and role of the attorney in plea decision making. We first explore the legal context of the attorney’s role in plea bargaining, reviewing several cases that address a defendant’s right to effective assistance of counsel. This paper analyzes the impact of the Cook County State’s Attorney’s Office Deferred Prosecution Program (DPP) on participation outcome patterns and compares recidivism rates between a sample of DPP participants (695) and a comparison group (991) of defendants found guilty through traditional adjudication from February 28, 2011 and December 5, 2012 with recidivism rates through June 6, 2014. Binary logistic and cox proportional regressions were utilized to evaluate the program. No statistically significant difference in re-arrest rates was found for a sample of DPP participants and a comparison group of defendants found guilty through traditional adjudication. Since 1991, 14 state and federal prisons have been built in Appalachia with a recent proposal for a federal prison to be constructed in Letcher County, KY. Contradicting the narrative that Appalachia remains separated from the national economy, the ills of carceral growth are apparent throughout the region. This study examines the proposal to build a federal prison in Letcher County, KY. The purpose of this study is to gain further insight into the impact that the carceral state, including its promise of economic development, has on environmental harm and land exploitation in the region. In his concurrence with the Supreme Court ruling in Furman v. Georgia (1972), Justice Thurgood Marshall postulated that levels of support for capital punishment are associated with the amount of knowledge about the death penalty process. He suggested that exposure to information about capital punishment produces sentiments in opposition to capital punishment except in instances for which support is based on retributive beliefs. These notions have become known as the Marshall Hypothesis and have been empirically tested among a variety of populations. Serial murder has been a popular media phenomenon across the United States since the 1980s, and media representations of serial killers may significantly influence public opinion as well as impact capital punishment policies. This content analysis examined the portrayal of one dozen different serial killers using 120 online media reports which included articles published between the 1970s to present day. Results of the analysis showed serial killers were often sensationalized and portrayed in biased ways by popular media, with little attention afforded to academic theories. Starting in 2016, Cuyahoga County Prosecutor’s Office and the research team collaborated to identify individuals who owe DNA, swab eligible offenders who owe, and followed up after their DNA is entered into CODIS. This brief focuses on the second and third phases this project—the swabbing, the following up, and disseminating the results. As an assessment of the efficacy of changes to practice, this report explains the process and outcomes of swabbing and submitting swabs of individuals who owe DNA in Cuyahoga County and the outcomes of what happened after a person’s DNA was entered into CODIS. The Fourth Amendment to the United States Constitution protects individuals from unreasonable searches and seizures. As technology evolves, courts must examine Fourth Amendment concerns implicated by the introduction of new and enhanced police surveillance techniques. Recent Supreme Court cases have demonstrated a trend towards reconsidering the mechanical application of traditional Fourth Amendment doctrine to define the scope of constitutional protections for modern technological devices and personal data. Community notification policies seek to prevent crime, raise awareness, or otherwise educate the public about criminal activity by requiring or permitting the police or other community actors to disseminate information to the public. Policies can focus on potential victims, potential offenders, the community at large, or some combination of these three. Victim-oriented policies seek to reduce the likelihood of victimization by encouraging precautionary behavior on the part of at-risk individuals. Offender-oriented policies publicize information (e.g., the severity of penalties or the likelihood of arrest) with the aim of deterring potential offenders from engaging in harmful activities. On college campuses, Title IX is used to prevent sexual assault. As sexual assault is experienced predominately by women, this research seeks to examine a relationship between gender and opinions on the Title IX changes of 2017, which rescinded protections for victims of sexual assault. To answer this, a thematic content analysis was conducted on online news article comment forums. The results indicated that men were more likely to support changes to Title IX guidelines, and women were more likely to oppose these changes. Hidden within the day-to-day routine responses of fire departments are possible multiple fires set by individuals in a small area with an unusual frequency. These fires may be the initial announcement of an emerging serial offender who is declaring a wound, an intolerable life situation, or is triggered by unknown events. This study sought to predict incendiary fires within a known cluster by using observable variables, both prior to and after the cluster event. This study explored the role religious belief and practice played amongst Jewish, female inmates during their incarceration. A group of ten correctional chaplains who work with Jewish, female, inmates and a comparison group of ten chaplains who work with Protestant, female inmates were interviewed. The study determined the reasons for and benefits of religious observance among these inmates and included assisting in dealing with fear, providing a sense of peace, and deceitful motives for personal gains. Religious practice also assisted inmate populations in healing from trauma, improving self-respect and self-esteem, building support systems, and additionally for Jewish, female inmates constructing …

Research on the dynamics of violence has revealed that crimes involving a prejudicial motive often occur in close temporal proximity to a galvanizing event such as elections, terrorist attacks, or unprecedented Supreme Court decisions. Given the particularly contested nature of marriage policy, it is not inconceivable that same-sex marriage recognition might incite retaliatory violence. Same-sex couples were granted the right to marry by the United States Supreme Court in June of 2015. There is no disagreement among social scientists that there is a disproportionate number of African Americans incarcerated. This study attempts to offer one possible explanation. This was a quasi-replication of a study conducted nearly two decades ago using African American adolescent males between the ages of 14 to 18. Previous research and prominent theories in the area of sex offender treatment, in terms of the biological foundation of substance abuse, behaviors of sex offenders, and the presence of aggression, helped to guide this research.
