The criminal justice response to perpetrators of intimate partner violence (IPV) is often a rehabilitative group treatment called Batterers Intervention Programs (Bl). This thesis assesses the effects of motivational interviewing (Ml) on clients ordered to local probation for IPV. Records were collected on IPV offenders enrolled in BI, within a small city in the Southeast Criminal Justice Agency. The pre-MI data were gathered from 2006, and post-MI data from 2007-2008 after the implementation of Ml. This thesis focuses on the use of MI as an intervention to enhance clients' motivation to change. This research is guided by questions that involve …

When a fatal traffic accident happens, we expect the local police and prosecutors to handle the investigation and criminal charges. When afatal airplane crash occurs, however, we turn instead to the National Transportation Safety Board (NTSB). The reason is that air crashes are complicated and the NTSB has vast expertise. Without that expertise, investigations falter. We need look no further than the mess made by Malaysian authorities in the search for Flight 370 to see the importance of expertise in handling complicated investigations and processes. Under the common law, burglary is defined as a crime committed against the property of another, and is listed as a property offense for purposes of statistical description by the Uniform Crime Reports (UCR) and the National Crime Victimization Survey (NCVS). However, burglary is prosecuted and sentenced as a violent crime under habitual offender laws at the federal level, and can be regarded as violent in state law, depending on varied circumstances. The theory of symbolic interactionism explains how social interactions influence behavior. In this study, it is reasoned that culturally sensitive interactions may be associated with adjudicated youth behavior. The purpose of this project is to (1) examine the differences in adjudicated male youths' perceptions of the level of cultural competency in juvenile justice staff members and (2) to identify whether staff members' cultural competency is related to self-restraint, distress, and delinquent behavior in adjudicated male youth. Utilizing a cross-sectional design, adjudicated youths enrolled in a variety of re-entry and transitional programs were surveyed. Youths retrospectively assessed the cultural competency of …

This Article reviews every capital clemency over the last four decades. It demonstrates that in the majority of cases, the reason for commutation was known at the conclusion of direct appeals—years or even decades before the habeas process ended. Yet when governors or pardon boards actually commuted the death sentences, they typically waited until the eve of execution, with only days or hours to spare. Leaving clemency until the last minute sometimes leads to many years of unnecessary state and federal habeas corpus litigation, and this Article documents nearly 300 years of wasted habeas corpus review. In 2005, New Jersey enacted the Smoke Free Air Act to deter the onset of smoking of high school students by raising the legal age of tobacco purchase from 18 to 19 (Cave, Holl, & Schweber, 2005). This was intended to reduce smoking in this population by restricting virtually all high school students' access to cigarettes; however, this legislation also reduced smoking in ways proposed by the concepts of Ronald Akers' Social Learning Theory (1979). The focus of this project is looking at current programs in the Denver area that work in some capacity to combat human trafficking. Research suggests that Denver is a huge drop off point for victims due to a major international airport and two major cross-country highways intersecting in the middle of downtown Denver. While the project does not provide any conclusive evidence, the numbers presented do show that perhaps there is a correlation between the establishment of these programs and an increase in arrest rates for certain charges. Criminological, psychological, and developmental researchers have relentlessly explored behavioral characteristics and juvenile justice outcomes in an effort to establish the most appropriate means of analyzing childhood and adolescent problem behaviors. Cross-discipline, empirical evidence and factor analytic research has consistently identified the presence of two predictive concepts, physical aggression and nonaggressive rule-breaking. Research pertaining to the risk factors and correlates of these two distinct substructures of offending align with theoretically postulated typologies of delinquency and offending as well as the frequently cited patterns of delinquency and offending within reviews of longitudinal research. Kennedy sought to get the “bankrollers and kingpins” by introducing the Federal Wire Act in 1961, which sought to target the mob’s most profitable racket—bookkeeping on horseracing and sports gambling by prohibiting such gambling on the nation’s communication system at the time (telephone and telegraph). More than 30 years later members of Congress sought to use the Wire Act to stop the rise of casino-style gambling on the Internet. Backpage.com and Craigslist are replacing the street corner as a crime source for buying and selling of sex. “To reduce commercial sexual exploitation and enforce existing trafficking laws, communities must first recognize the extent of the problem within their local area (Janson, Mann, Marro, & Matvey, 2013, 99). In a population density study conducted in 15 major U. S. cities, it was found that males over 18 years of age who buy sex online ranged from 0.6% in San Francisco to 21.4% in Houston (Roe-Sepoqitz, Hickle, Gallagher, Smith, & Hedberg, 2013). The growing recognition throughout the nineteenth century that juveniles were different than adults culminated in the establishment of the first juvenile court in Cook County, Illinois in 1899. By 1945, every state had developed its own juvenile justice system separate and distinct from the criminal justice system. Since its inception, the juvenile justice system has experienced two waves of adultification in which the lines between the juvenile and criminal justice systems were blurred. Objective Current knowledge regarding psychiatric disorders and crime in youth is limited to juvenile justice and community samples. This study examined relationships between psychiatric disorders and self-reported crime involvement in a sample of youth representative of the US population. Method The National Comorbidity Survey–Adolescent Supplement (N = 10,123; ages 13–17 years; 2001–2004) was used to examine the relationship between lifetime DSM-IV–based diagnoses, reported crime (property, violent, other), and arrest history. Logistic regression compared the odds of reported crime involvement with specific psychiatric disorders to those without any diagnoses, and examined the odds of crime by psychiatric comorbidity. However, within the past fifty years there has been some noteworthy research performed. Still, the amount of research undertaken within the realm of the criminal investigative process has not corresponded to the magnitude of its importance in everyday police operations. This research sought to determine the relationship between obtaining a criminal justice or forensic science degree and the CSI Effect followed by whether the students were satisfied with their major selection. Additionally, this research sought to determine if there were discrepancies between students’ expectations before entering the forensic science or criminal justice degree program and students’ attitudes while enrolled in the forensic science or criminal justice degree program. Police ethics and decision making are issues of concern to both academic scholars and police leaders. While previous studies have focused on perceptions of police officers, little research has focused on the perceptions of young people about police ethical decision-making. This study aims to capture such perceptions from a cohort of college students majoring in criminal justice. An experiment was conducted to test the effects of evidence complexity and laboratory type on jurors' perceptions of forensic evidence. The study specifically focused on three types of labs: public labs, private labs, and "corporate labs." Public labs are managed by a federal, state, or local law enforcement agency, where evidence is usually analyzed internally at an agency. Private labs are those that have been formed as private businesses to provide services to federal, state, and local crime labs with overflow work. Existing research on sexual victimization in correctional facilities has expanded since the enactment of the Prison Rape Elimination Act (PREA) of 2003. Previous literature suggests that the prevalence of sexual victimization in prisons is unknown, yet the known ramifications of reported sexual assaults are serious for both the individuals involved and the institution. Government policies such as the Prison Rape Elimination Act (PREA) of 2003 attempt to address the issue of sexual violence in U.S. correctional facilities.
