White-Collar Crime, White-Collar Time: The Sentencing Of White-Collar Offenders In The Southern District Of New York, Ilene H. Nagel, John L. Hagan

In this Article, Professors Hagan and Nagel report upon their study of sentencing patterns in white-collar cases tried in the Southern District of New York between 1963 and 1976. Using multiple regression analysis, the authors first demonstrate a strong correlation between lenient sentencing practices and white-collar offenses. The authors then focus their study upon various white-collar crimes, using multiple regression analysis to reveal that considerable variation exists between sentencing patterns for the different white-collar offenses and for the different types of defendants sentenced in the Southern District during the period under study.

Introduction: Riots are a recurrent phenomenon in American prisons. In the 1950s and the early 1970s, major riots erupted in prisons across the country, and many have occurred in the past several years.' Riots will continue to occur as long as the dominant function of prisons is the custodial confinement of inmates. As one commentator explains, "The way to make a strong bomb is to build a strong perimeter and generate pressure inside. The passage of Public Law 94-142, the Education for All Handicapped Children Act of 1975, mandates that parents of a handicapped child must be included in the educational planning and placement procedures for their child. The law requires (1) parent counseling and (2) parent participation in the planning of the child’s educational career. Yet almost six years after the passage of Public Law 94-142, the role of parent which emerges today appears to be one of passive involvement in the Individualized Educational Plan (IEP) process. The literature suggests this lack of active participation possibly stems from several sources: the parents’ …

Since 1943, six studies have been made of speech education in Oregon public schools. Several make reference to forensics, but none discuss this aspect of speech education in depth. As a result, the role of forensics in the schools has been assumed or denied. With the educational situation as it is, however, it is necessary that we have a greater understanding of the relationship between forensics and general speech education and language arts education.

This report presents an evaluation of the Park Forest Integration Maintenance Program. The report was conducted at the request of the Village Board of Trustees to aid them in evaluating and directing future policy regarding the Program. This report is not seen as a public relations document but as a working document for the Board and Village staff. As such it assumes a working knowledge of terms such as integration maintenance and affirmative marketing as well as knowledge of the basic history of the Program. Through The Trap Door Darkly: Nebraska Exemption Policy And The Bankruptcy Reform Act Of 1978, Richard F. Duncan

The Bankruptcy Reform Act establishes a somewhat disingenuous exemption policy that first creates, and then allows the individual states to nullify, uniform federal bankruptcy exemptions. The State of Nebraska has chosen to opt out of the federal exemption scheme thereupon assuming a continuing moral obligation to ensure that its exemption policy does not deny Nebraska debtors the fresh start following bankruptcy to which they are entitled. The Unicameral should undertake an immediate reconsideration of Nebraska exemption law with a view to possible elimination of the homestead exemption in favor of an expanded exemption in lieu of homestead to be available …

This paper briefly summarizes the development of the Third United Nations Law of the Sea Conference (UNCLOS III)and the influence that national security had on its development.The missions of the navy as promulgated by Chief of Naval Operations, Admiral Elmo Zumwalt are: Strategic Deterrence;Sea Control; Projection of Force Ashore; and Naval Presence. The effect of the Draft Convention, InformalText (DC IT) provisions in five areas are discussed. These areas are: Transit of International Straits; Archipelagos;the Territorial Sea; the Exclusive Economic Zone; and the Deep Seabed.

Burt W. Griffin has been a judge of the Common Pleas Court of Cuyahoga County, Ohio since January 3, 1975. From 1966 to 1975, he served as a legal aid lawyer in various capacities including Executive Director of the Cleveland Legal Aid Society and National Director of the Legal Services Program, U.S. Office of Economic opportunity. He was Assistant Counsel to the President's Commission on the Assassination of President Kennedy during 1964. Judge Griffin has been a life-long resident of Greater Cleveland.
