Alternative Methodologies In Contemporary Jurisprudence: Comments On Dworkin, Philip E. Soper

I have two brief points to make. Both involve recent developments in jurisprudence, by which I mean by and large the subject that Ronald Dworkin has just been discussing. Indeed, the first point is little more than an acknowledgement of the debt that is owed to Dworkin, not only for his specific contributions to this field, but for the implications of his work for law teaching generally.

Child Sexual Abuse, Jeffrey A. Fagan

Over the past two decades awareness of child sexual abuse among academics and professionals has grown from several convergent trends: the "discovery" of child abuse in the 1960's, concern by feminists over sexual assault and rape, increasing reports to law enforcement and child protective service workers of sexually abused children, and the general "deprivatization" of the family. More recently, general public awareness of child sexual abuse has followed well-publicized cases of child molestation in day-care centers, nationwide concern over pornography and its subsequent links to teenage prostitution, and runaway youth, delinquency, and family violence among adults.

Loan Payments To Secured Creditors As Preferences Under The 1984 Bankruptcy Amendments, Richard F. Duncan

The recent bankruptcy amendments made significant revisions in the law of preferences. At least one of these changes, the elimination of the forty-five day rule from section 547(c)(2), has the potential of rendering the trustee impotent against creditors who receive preferential loan payments while other creditors go unpaid. If this possibility materializes, the primary policy of bankruptcy preference law, equality of distribution among similarly situated creditors, will be severely undercut. The bankruptcy courts should respond by construing the ordinary course requirement strictly so as to avoid extending its protection to preferential payments of long-term loans and other atypical financings.
