The Impact Of Presentence Investigations On Plea Bargained Dispositions In Kings County Supreme Court, Joseph G. Enright

This study examines the presentence function of probation from an historical and empirical perspective which argues that the purported diminution of the role of the presentence report (PSR) in the sentencing process–as a result of sentence bargaining–is more reflective of a prevailing disenchantment with the rehabilitative ideal than any thoroughly considered, reliable validation of the PSR's dispensibility. It is demonstrated, through a review of the literature, that poorly conceived, polemically biased empirical research has helped to perpetuate the notion that these reports have little value. Moral Development, Socioeconomic Status, And Family Intactness: Status Offenders Versus Criminal Offenders, Michael A. Glynn
All-Inclusive List of Electronic Theses and Dissertations
This study examined the possible differences between the two legally defined groups of juvenile delinquents (status offenders and criminal offenders) on the variables of moral development, socioeconomic status, and family intactness. Moral development was measured using Gibbs' Sociomoral Reflection Measure. Socioeconomic status was determined by the subject's parent's ranking on Nam's Occupational Status Score Index, and family intactness or non-intactness was determined from an examination of court records. The subjects were 106 males between the ages of 13 and 17 inclusive, and were evenly divided in the two legal categories. No significant differences were found between the two groups on …

The Effects Of General Equivalency Diploma (Ged) Acquisition On Parole Success In Kentucky, William Ratliff

Post release follow-up was conducted on a total of 95 Kentucky Correctional Facilities inmates, who had acquired a General Equivalency Certificate in the years 1981-1983.
The rate of Recidivism of this group was compared to that of all parolees released during that period.
It was found that the parolees in general who were released during that time period returned to the institution at a rate of 36.7 percent, The parolees who had completed the GED Program in the institution prior to release returned at a rate of 35.78 percent.

The Moral Dilemma Of Positivism, Anthony D'Amato

I think there has been an advance in positivist thinking, and that advance consists of the recognition by MacCormick, a positivist, that positivism needs to be justified morally (and not just as an apparent scientific and objective fact about legal systems). But the justification that is required cannot consist in labelling "sovereignty of conscience" as a moral principle, nor in compounding the confusion by claiming that positivism minimally and hence necessarily promotes sovereignty of conscience. We need, from the positivists, a more logical and coherent argument than that. Until one comes along, I continue to believe that positivists inherently have …
