Redundancy has a bad reputation among legal intellectuals. When someone says, for example, that the ninth and tenth amendments are redundant, we can be pretty sure that this person attaches little importance to these constitutional provisions. Listen to one of the definitions of redundant provided by the Oxford English Dictionary: "superabundant, superfluous, excessive."' In this essay, the author proposes that legal theorists pay serious attention to the concept of redundancy used by engineers. He explains how redundancy--in this special sense--is essential to any intellectual enterprise in which we try to reach action-guiding conclusions, including the enterprise of law. The author …

In Abstract Right and the Possibility of a Nondistributive Conception of Contract: Hegel and Contemporary Contract Theory, Peter Benson criticizes the authors presentation of a consent theory of contract, in part, on the ground that it "refers only to the empirical facts of the requirements of human needs and fulfillment. Like [Charles] Fried's [account], his conception of the consensual basis of a contract does not preserve the required standpoint of abstraction. " On this basis Professor Benson concludes that the author's approach fails to "provide an adequate elucidation of a nondistributive conception of contract.

Professional organizations sometimes promulgate guidelines intended to inform their members' practice. These standards may be designed to guide practitioners under ordinary conditions, or they may define an ideal toward which to strive. If courts adopt idealized standards as criteria of responsible practice for the purpose of establishing tort liability, professional organizations might respond by refraining from developing such guidelines or by framing them with an eye toward preventing liability rather than strictly for the purpose of enhancing patient care. The dual purposes of this field study were to ascertain the legislative, court, and administrative rule requirements for equal employment opportunity and affirmative action for the newly created Illinois Vocational Student Services Network and to develop equal employment opportunity and affirmative action policies for the network. The findings of this field study are applicable to Educational Service Regions in the State of Illinois and projects, entities, or programs that utilize Educational Service Regions as fiscal agents. With minor modifications, the affirmative action policy could be utilized by school districts and other public agencies.

Our purpose is to bridge the criminal justice and stratification research literatures and to pursue the argument that homologous structural principles stratify allocation processes across central institutions of American society. The principle observed here in the making of bail decisions, as in earlier studies of the allocation of earnings, is that stratification resources operate to the greater advantage of whites than blacks. The operation of this principle is established through the estimation of covariance structure models of pretrial release decisions affecting 5660 defendants in 10 federal courts.
