My thesis is a simple one. In the twentieth century state corporate law norms for the large publicly held corporation have been progressively supplanted by federal standards, particularly those originating in federal securities law. This has occurred both because of the promulgation of new federal standards and because of the atrophy of state corporate law. Certain applications of this thesis are little questioned today. For instance, it is now a conventional idea that the state law applicable to insider trading has largely been ignored and has been generally displaced by such federal securities law staples as Rule 10b-5, section 16 …

San Diego Law Review

This Article analyzes the basis for safe-haven programs for refugees fleeing war and civil strife under contemporary principles of international law. The authors trace the development of safe-haven programs in the United States and offer an analysis and critique of the Temporary Protected Status program created by the Immigration and Nationality Act of 1990. Focusing on the struggle to gain safe haven for refugees from El Salvador, the authors review the United States government's historical use of safe haven programs as a political tool. Finally, the Article looks at how other countries have responded to refugee crises and suggests a …

The problem of jail overcrowding has forced corrections officials and jail administrators to examine ways in which to better manage available jail space. Pretrial release and detention policies have been a target of this examination as pretrial defendants typically account for 50% of a jail's population. Standards for pretrial release exist, but their administration varies by jurisdiction. The impact of jail overcrowding on pretrial release policies has been to decrease the time available to render a decision. Recent efforts to standardize pretrial release standards in Oregon have not addressed the issue of expediency. The current study examines pretrial misconduct (failure …

Attitudes & Opinions Of Circuit Court Judges On The Issue Of Substance Abuse During Pregnancy, Michelle Degeorge

The purpose of this study was to determine the attitudes and opinions of circuit court judges in Kentucky concerning the issue of pregnancy and substance abuse. A questionnaire was mailed to all 90 circuit court judges in Kentucky. The questionnaire, consisting of both a Likert scale and open-ended questions, dealt with concerns relating to the criminalization of pregnant substance abusers, fetal rights, state intervention in the case of pregnant substance abusers, and mothers rights. The ages of the judges, as well as their years of experience on the bench, were used to determine their attitudes on these issues. Results showed …

Social Security benefits were never designed to be one’s sole source of retirement income. Due to fiscal constraints, it is likely that Social Security benefits in the future will be less generous when the young workers of today retire. In the future, retirement income security will depend heavily on wealth accumulated during one’s working years. The role of the Social Security Administration must be transformed to one of motivating, informing, and educating the young workers of today about retirement financial planning so that they can adequately plan and prepare for a financially secure retirement tomorrow.

A Cameroonian proverb states that "[h]e who asks questions cannot avoid the answers,"' and, unfortunately, that proverb applies to law professors. At the end of each semester, law professors must endure the agony of creation that Mary Shelley's Dr. Frankenstein had to experience only once in his life. We are horrified to see the monsters we have created, so different from what we intended. The joy of teaching is the constant challenge and interaction with students in the classroom; the agony of teaching is reading what some of those same students have written on their examinations.
