Scholars have validated both the damaging presence of police officer stress and separately, their increasing obese condition in the United States. Previous studies of police officers focus on stress or body weight, but not these variables conjointly. The purpose of this study was to inform policy creation by examining the problem of officer stress in relation to the calculated body mass index (BMI) values and to gain insight into stress outcomes. Unemployment among formerly incarcerated citizens is a complex problem that continues to grow. Previous reentry studies describe the collateral effects of incarceration on employment from the perspective of formerly incarcerated individuals, yet little academic research exists regarding reentry practitioners' perceptions of constraints during the job search process. The response to civil disturbances has historically been the aggressive use of force or escalation with tactics such as the use of police dogs, armed federal troops during war protests, and police field forces. These types of tactics can escalate tensions between protestors and police and only add to the violence and destruction of the incident. Rural America faces an increasingly dire access-to-justice crisis, which serves to exacerbate the already disproportionate share of social problems afflicting rural areas. One critical aspect of the crisis is the dearth of information and research regarding the extent of the problem and its impacts. This Article begins to fill that gap by providing surveys of rural access to justice in six geographically, demographically, and economically varied states: California, Georgia, Maine, Minnesota, South Dakota, and Wisconsin. There is, without question, a public health crisis in the United States arising from both illicit and prescription opioid misuse, addiction, and overdose. The Food and Drug Administration (FDA) is one regulator with an important role to play in minimizing the harms associated with prescription opioids, while also ensuring that prescription opioids are available for the evidence-based management of pain. One question, however, is to what extent the agency can consider in its decisions to approve opioids and keep existing ones on the market the provider and patient behaviors contributing to the epidemic. Existing literature indicates that various factors affect police stress. This article uses data from the ‘Work and Family Services for Law Enforcement Personnel in the United States, 1995’ downloaded from the Inter-University Consortium for Political and Social Research (‘ICPSR’) website. Respondents include 594 sworn police officers from 21 agencies in New York City. Using structural equation modeling, results indicate that sex, race, education, and tenure do not have a direct influence on total job stress, but have a direct impact on family discussion with co-workers, counseling support, and negative working environment. The Downstream Effects Of Bail And Pretrial Detention On Racial Disparities In Incarceration, Ellen A. Donnelly, John M. Macdonald

Bail and pretrial detention decisions may have important consequences for racial disparities in incarceration rates. Poor minority defendants who are unable to post bail and get released from jail before trial may be more likely to plead guilty and accept longer sentences of incarceration. Racial disparities in incarceration sentences may then reflect a combination of differences in the seriousness of a defendant’s case, criminal history, and economic resources to pay bail. This study examines the extent to which bail decision-making and pretrial detention explain Black-White disparities in criminal adjudications and sentences in the Delaware courts from 2012 to 2014. There is an overrepresentation of youths with disabilities in the juvenile justice system. As a result, each year thousands of juvenile offenders despite of the seriousness of the crimes committed, are released from incarceration with the hopes of living a successful life in society. Despite progressive research on identifying factors associated with desistance, it is still unclear what factors contribute to desistance for serious juvenile offenders and especially those with disabilities. As the fight for transgender rights becomes more visible in the United States, the plight of incarcerated transgender individuals seeking medical care behind bars is likewise gaining attention—and some trans prisoners are gaining access to gender-affirming care. However, progress for incarcerated members of the trans community has been slow, piecemeal, and not without problems. As federal court opinions in Eighth Amendment access-to-care cases brought by trans prisoners show, how a court interprets the subjective intent requirements of the Eighth Amendment and how the imprisoned plaintiff pleads his/her/their case can make or break the claim. Female offenders are distinctly different from male offenders, and present with their own gender-specific needs and issues both in and out of the correctional setting. Most approaches to treatment and programming for female offenders are currently based on research involving males and approaches designed for males. Inquiry regarding the gender-specific needs of female inmates as they pertain to treatment and reentry programs is necessary so professionals can better understand how to serve this population. Inconsistent findings within the existing literature tend to confuse the ability of behavior-focused alternative schools to address behavior problems of at-risk juveniles. Recent studies have suggested that juveniles who successfully commit to greater self-regulation skills display both academic success and positive classroom behavior. Although self-regulation skills have been positively associated with behavioral success among juveniles placed in behavior-focused alternative schools, it remains unclear as to what aspects of these programs that juveniles experience as facilitating the development of such skills. Urban violence has become common in lower-income communities that have high rates of shootings and African-American victims. Urban violence causes victims and their family and friends to experience trauma and puts them at risk for post-traumatic stress disorder (PTSD) injuries. However, there is a gap in knowledge in the framework of urban communities and their range of needs to address PTSD. The influences that crime control, due process factors, and individual demographic characteristics have on the criminal trial outcomes of accused arsonists was unknown. Absent this knowledge, it was not clear if public policy ensures justice for the accused, particularly for the disadvantaged. This Article offers an unorthodox theory of insanity. According to the traditional theory, insanity is a cognitive or volitional incapacity arising from a mental disease or defect. As an alternative to the traditional theory, some commentators have proposed that insanity is an especially debilitating form of irrationality. Each of these theories faces fair-minded objections. In contrast to these theories, this Article proposes that a person is insane if and because he lacks a sense of agency. Both criminal justice researchers and practitioners have suspected that generational preferences and the nature of police patrol work have acted as dual forces leading potential police recruits away from police careers, resulting in large numbers of unfilled police positions. This challenge is exacerbated by accelerating retirements and expanding police duties. Police recruitment became an even larger managerial issue after the 2008 recession failed to resolve the most critical factor driving people away from police careers in the first place: police departments saw fewer and fewer qualified applicants, despite the recession bringing more applicants in number. Public opinion is often reported as punitive towards sentencing young people. Attitudes remain important to investigate given their potential to influence policy within the criminal justice system. Therefore, it is important to understand the formation of these attitudes and their consistency with sentencing principles. Semi-structured interviews (n = 72) and surveys (n = 502) were used to gauge opinions of sentencing young people under different scenario manipulations (age, weapon, drug treatment, prior record). The findings revealed the public expected punishment, but favoured rehabilitation with an opportunity to repent, suggesting the public are open to alternatives to ‘tough on …

The Effect Of Partisanship On The Passage Of Environmental Legislation, Samantha Yoest

This paper addresses the question of how partisanship plays a role in congressional productivity by looking at the number of environmental laws passed each year. This includes analysis of anti-environmental legislation and the connection to party. It was found that, on average, Democratic majorities produce more environmental laws than Republican majorities. Not only that, but polarization has the largest influence on environmental legislation. With an increase in polarization on environmental issues, more anti-environmental legislation is being voted on in Congress, and fewer environmental laws are being passed per year. The justice system diverts young offenders away from further contact through restorative justice processes. Juvenile justice conferencing allows for the goals of restorative justice to be met, including meeting the needs of victims and offenders. Apologies, when offered by offenders to victims within a conferencing setting, can assist with meeting these restorative goals. Apologies, however, need to be effective to have the desired outcome. Several variables influence the effectiveness of apologies, including the perceived voluntariness of apologies, with prompted apologies reducing apology effectiveness. The Western Australian Government stated that the Criminal Property Confiscation Act 2000 (WA) (‘CPCA’) will provide ‘the strongest and most effective’ confiscation powers in the world.1 It was observed by the High Court that the CPCA has enabled a confiscation of property scheme that has a ‘significant impact upon personal and property rights.’2 Strong powers to fight crime are justified, but it is critical that these powers are used responsibly and that innocent parties are protected. The lampricide 3-trifluoromethyl-4-nitrophenol (TFM) has been used for decades to control invasive sea lamprey (Petromyzon marinus) populations in the Great Lakes, normally with little harm to other fish populations. However, due to the nature of lampricide treatments and the chemical properties of TFM, adverse effects to non-target fishes and non-target mortality occasionally occur. However, investigations of non-target mortality can be complex, particularly if fish deaths are not noticed immediately, due to decomposition of the carcasses. Societal pressure to increase security after violent incidents on post-secondary campuses such as the Virginia Tech shooting in 2007, combined with the pressure for universities to have high recruitment rates, has led to an emerging climate of security on campuses across North America. The present study uses Valverde’s (2001; 2008; 2009; 2011a; 2011 b; 2014) security projects framework to examine the lived experiences of security measures on a Canadian urban-integrated campus. Through semi-structured interviews with administrators, campus police officers, students, and faculty, and constructivist grounded theorizing, this study provides an in-depth examination of security from multiple perspectives within one institution. …

The criminal justice system is becoming automated. At every stage, from policing to evidence to parole, machine learning and other computer systems guide outcomes. Widespread debates over the pros and cons of these technologies have overlooked a crucial issue: ownership. Developers often claim that details about how their tools work are trade secrets and refuse to disclose that information to criminal defendants or their attorneys. The introduction of intellectual property claims into the criminal justice system raises undertheorized tensions between life, liberty, and property interests.

The paradoxical character of fire is perfectly captured by the juxtaposition between the initial ease and excitement of lighting fires, and fire’s destructive and uncontrollable nature. Australia is fire prone with its hot, dry climate, volatile vegetation and urban sprawl surrounded by bushland. Since an estimated 50% of fires lit in Australia are deliberate (Stanley & Read, 2016) the problem of intentional firesetting cannot be overstated.
