Experiential Learning & Teaching in Higher Education
Experiential learning can be in the form of internships, field trips, service learning, and research projects. The practical nature of criminal justice is a logical fit for experience-based learning. Specifically, academic field trips may be viewed as examples of short-term experiential education. However, do experiential learning trips have an academic impact over time? Using survey data, the current study examines if students acquire and retain knowledge after a prison tour of Eastern State Penitentiary. Pre- and post-tour surveys of student learning outcomes showed a statistically significant gain between the pre- and post-tour survey results. A follow-up survey explored if students …

Because of the compelling role it plays as an enigma, mental illness has been featured in innumerable theaters of human history and our present-day society. There is perhaps no greater place for this dynamic than our criminal justice system. This analysis provides a thorough examination of how our modern approach to the management of mental illness evolved in accordance to the ways in which it began. Fatal drug overdoses have affected both urban and rural communities in recent years but is more pronounced in rural areas. In this narrative, a commentary regarding the increased maternal morbidity and mortality rates for rural women, the lack of access to appropriate medical and substance abuse treatment, and societal and intragroup stigma will be addressed, as these issues are plaguing rural substance users and their recovery. There has been a specter haunting America for over 400 years. That specter is an insidious and destructive beast that has found its way into every crevice and layer of all American institutions. In Gideon v. Wainwright, the U.S. Supreme Court held that the government must provide a criminal defense lawyer for any accused person who cannot afford one. But for too many people, Gideon's promise remains unfulfilled. In Texas, there are no statewide guidelines about who is entitled to a court-appointed lawyer. Instead, counties create their own rules that create serious gaps in constitutional protection. Getting Gideon Right investigates the financial standards that determine an accused person's eligibility for appointed counsel in Texas county courts. The report reveals a patchwork of county court policies that are both complex and severe.

This literature review examines the practice of juvenile solitary confinement, applies the United States Supreme Court’s Eighth Amendment jurisprudence, argues that the practice should be declared unconstitutional as a violation of the Eighth Amendment, and calls for a categorical ban. The Cruel and Unusual Punishment Clause of the Eighth Amendment states, “nor [shall] cruel and unusual punishments [be] inflicted.” U.S. Const. amend. VIII. Juvenile solitary confinement is cruel and unusual, in violation of the Eighth Amendment, because juveniles are different. The United States Supreme Court has long recognized that juveniles should not be held to the same standards of …

Mental health stigma is a key factor to what makes members of the community who are diagnosed with mental illness feel like outcasts to the “normal” population. This study investigated the relationship between right-winged beliefs and offenders diagnosed with mental illness. Sigma as it relates to mental health, offenders, and right-winged beliefs have been studied separately before, but there is a lack of information on the stigma that the public has towards offenders who struggle with their mental health and the possible predictors of stigma towards this group. Perhaps the most widely recognized personality assessment in the world, the MBTI has been implemented as a valuable predictive and diagnostic tool by innumerable businesses, coaches, psychologists, and interested individuals. However, recent research has shown that the MBTI is host to a variety of significant validity issues, and the test altogether fails to address any aspects of deviant personality. Since its inception, the United Nations Convention Against Torture (UNCAT) conceived torture as a state crime. The Convention established a so-called “state-nexus” that effectively excludes torture committed by non-state actors. The Committee Against Torture as well as the world’s major anti-torture NGOs have almost exclusively focused on ill-treatment perpetrated by state entities. Yet, there have been efforts to extend the definition to private actors, including the “de facto authority” approach, and the due diligence doctrine. This article explores the effectiveness of these efforts to expand the scope of the UNCAT when applied to organized criminal organization such as gangs and …
Juveniles, Transferred Juveniles, And The Impact Of A Criminal Record On Employment Prospects In Adulthood: An Experimental Study, Joanna Daou

Previous research shows that a criminal record reduces an individual’s employability. The impact of a juvenile record on employability as a young adult, however, has rarely been examined, and no previous studies have estimated the effect of a criminal record when a juvenile was waived to the adult court. The current study seeks to fill these gaps in the literature using an experimental correspondence approach. The results of this research indicate that the effects of a delinquency record on employability for juveniles and young adults are comparable to the effects of a criminal record for adults.

Fostering that idea of lawyers as change-makers can be difficult in the typical 1L curriculum. The traditional, doctrinal law school classroom typically has a formula comprised of extensive textbook reading, the Socratic classroom, in which that reading is processed in a large group, and, finally, a cumulative, high-stakes exam at the end of the semester.6 That formula has largely not changed for decades.7 The lawyering skills classroom is often the only outlier from that formula for first-year law students.8 Even so, the skills classroom can be formulaic in its own right—introduction of an assignment, classroom instruction regarding …

When, why, how, and by whom was “time” combined with “law” in Japan? This paper scrutinizes the issue based on Yoshiro Okada’s research, especially his most important works: Nihon no Koyomi and his thesis “Meiji no Kaireki: ‘Toki’ no chuo shuken-ka.” It is thus possible to understand how the political authorities used the unification of the calendar system to demonstrate their power and to govern the lives of the nation. This has also lead to increased interactions of those with mental illnesses and/or disabilities with law enforcement and the criminal justice system. Testing The Protest Paradigm And Racial Threat: Analyzing Articles Of Blm Protests In 2014 And 2020, Rebecca Angela Ruiz

The study examines the media coverage of Black Lives Matter protest in years 2014 & 2020. I collected a sample of articles (n=120) from 6 national-level media outlets that varied in political leans. Using the Protest Paradigm and Racial Threat theoretical frameworks to analyze the results, findings suggest that the articles do reflect upon the Protest Paradigm through overall negative sentiment and significant references to looting. I also argue that articles may also reflect racial threat due to a lack of transparency of protesters’ racial makeup or diversity attending demonstrations.

Racial Differences In Perceptions Of Sanction Severity, Sarah L. Franklin

Research has consistently found an association between race and relative perceptions of incarceration severity. Black people view incarceration as less severe than an equivalent period of probation. However, few studies have examined why this relationship exists. The present study surveys a large sample of young adults to examine whether the observed relationship between race and incarceration severity can be replicated. In doing so, the study then considers whether constructs related to socioeconomic status, criminal system experiences, perceptions of legitimacy, and sanction attitudes explain the racial divide. Results indicate a significant relationship between race and incarceration severity, such that Black people, …
