Beyond The Individual: Exploring Structural Explanations Of Homelessness Through Thematic Analysis Of Extant Research, Madison R. Mcclain

This thesis examines how homelessness is defined, explained, and addressed within contemporary U.S. research using Critical Race Theory (CRT) and Intersectionality as guiding frameworks. Through a qualitative, deductive thematic analysis of 16 peer-reviewed articles, this study identifies six key themes related to structural causation, policy governance, measurement practices, racial inequality, dominant narratives, and intersecting systems of disadvantage. Findings reveal that while structural explanations of homelessness are widely acknowledged, they are inconsistently defined and often insufficiently theorized. Institutional systems primarily function to manage rather than resolve homelessness, while measurement practices and definitions actively shape who is recognized and prioritized. บทความนี้วิเคราะห์ผลลัพธ์ของนโยบาย “Transforming Rehabilitation” ซึ่งเป็นการปฏิรูปโครงสร้างงานคุมประพฤติในสหราชอาณาจักรโดยให้ภาคเอกชนเข้ามามีส่วนร่วมในการดำเนินงาน ภายใต้ความประสงค์ในการลดอัตราการกระทำผิดซ้ำ เพิ่มประสิทธิภาพในการปฏิบัติงาน และเสริมสร้างนวัตกรรมในการบริหารจัดการผู้กระทำผิด การปฏิรูปนี้ได้มอบหมายหน้าที่โดยให้บริษัทเอกชนที่เป็นผู้รับผิดชอบในการดูแลผู้กระทำผิดที่มีความเสี่ยงต่ำถึงปานกลางผ่านวิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชน (Community Rehabilitation Companies) ในขณะที่หน่วยงานคุมประพฤติแห่งชาติ (National Probation Service) ยังคงรับผิดชอบผู้กระทำผิดที่มีความเสี่ยงสูง การประยุกต์ใช้เครื่องมือทางการเงิน เช่น “ค่าตอบแทนตามการให้บริการ” และ “การจ่ายเงินตามผลลัพธ์” ถูกนำมาใช้เพื่อดึงดูดการลงทุนจากภาคเอกชนและคาดหวังว่าจะเกิดนวัตกรรมด้านเทคโนโลยี จากการศึกษาพบว่าผลการดำเนินงานตามแผนปฏิรูปไม่เป็นไปตามเป้าหมายที่กำหนด ผู้ให้บริการเอกชนไม่สามารถจัดทำบริการเพื่อสนับสนุนการกลับคืนสู่สังคมได้อย่างเพียงพอ ส่งผลให้ผู้กระทำผิดที่ได้รับการแก้ไขฟื้นฟูไม่ได้รับความช่วยเหลือ การให้บริการงานคุมประพฤติขาดความคิดริเริ่มใหม่ และมาตรฐานงานและคุณภาพลดลง ซึ่งสาเหตุหลักเกิดจากการขาดการทดลองนำร่องที่เพียงพอก่อนการขยายผล รวมถึงข้อบกพร่องในกระบวนการประเมินความเสี่ยง ปัญหาทางการเงินทำให้วิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนหลายแห่งล้มละลาย ผลกระทบต่อเสถียรภาพของงานคุมประพฤติและความเชื่อมั่นของประชาชนที่ลดลง จนกลายเป็นปัจจัยให้แนวคิดการลงโทษได้รับความนิยม ขณะที่แนวทางการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนถูกลดบทบาทลง บทความเสนอแนวทางแก้ไขที่สำคัญ ได้แก่ การจำกัดบทบาทของภาคเอกชนให้เป็นเพียงผู้สนับสนุนงานคุมประพฤติ เสริมสร้างความแข็งแกร่งให้กับหน่วยงานคุมประพฤติแห่งชาติในฐานะผู้ให้บริการในการจัดทำงานคุมประพฤติ และการออกแบบเครื่องมือทางการเงินใหม่ที่สร้างแรงจูงใจและส่งเสริมการมีส่วนร่วมของภาคีเครือข่ายและภาคประชาชน นอกจากนี้ บทความยังเสนอแนะให้มีการนำร่องอย่างเป็นระบบเพื่อให้สามารถประเมินความเสี่ยงได้อย่างแม่นยำ และสร้างกลไกการกำกับดูแลที่มีประสิทธิภาพ เพื่อรักษาคุณภาพบริการและสร้างความเชื่อมั่นต่องานคุมประพฤติอย่างยั่งยืน

ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

เสรีภาพในการบันทึกทัศนียภาพ (freedom of panorama) เป็นหลักการที่ถูกพัฒนาขึ้นในลักษณะของการเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ เพื่อทำให้บุคคลสามารถบันทึกภาพอาคารสิ่งปลูกสร้าง ประติมากรรม หรืองานศิลปกรรมอันมีลิขสิทธิ์ที่ตั้งอยู่ถาวรในที่สาธารณะได้โดยไม่ต้องขออนุญาตจากเจ้าของลิขสิทธิ์ หลักการนี้มุ่งที่จะสร้างสมดุลระหว่างสิทธิของเจ้าของผลงานที่ตั้งอยู่ในที่สาธารณะกับประโยชน์ของสาธารณชนและคุณค่าทางศิลปะในทัศนียภาพ แม้เสรีภาพในการบันทึกทัศนียภาพจะได้รับการยอมรับและบัญญัติเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ในกฎหมายหลายประเทศทั่วโลก แต่กลับไม่มีนิยามและขอบเขตที่แน่ชัดและเป็นหนึ่งเดียวกัน ทั้งนี้การกำหนดขอบเขตของเสรีภาพในการบันทึกทัศนียภาพให้กว้างย่อมเป็นการจำกัดสิทธิของเจ้าของลิขสิทธิ์ แต่การให้ขอบเขตของเสรีภาพในการบันทึกทัศนียภาพที่แคบเกินไปก็จะเป็นการจำกัดเสรีภาพของปัจเจกชนและกระทบต่อประโยชน์สาธารณะ บทความวิจัยนี้นำเสนอที่มา หลักการและแนวคิดที่เกี่ยวข้องกับเสรีภาพในการบันทึกทัศนียภาพ โดยศึกษาวิเคราะห์บทบัญญัติข้อยกเว้นการละเมิดลิขสิทธิ์ที่เกี่ยวกับเสรีภาพในการบันทึกทัศนียภาพตามกฎหมายในต่างประเทศจำนวน 20 ประเทศและบทบัญญัติของประเทศไทย บทความวิจัยนี้เสนอบทวิเคราะห์ในประเด็นการกำหนดขอบเขต การปรับใช้และการตีความบทบัญญัติเพื่อให้สอดคล้องกับหลักคิดพื้นฐานของเสรีภาพในการบันทึกทัศนียภาพและหลักการกำหนดข้อยกเว้นการละเมิดลิขสิทธิ์ โดยคำนึงถึงการถ่วงดุลอย่างเหมาะสมระหว่างสิทธิของเจ้าของลิขสิทธิ์กับคุณค่าของเสรีภาพในการบันทึกทัศนียภาพในประเด็นสำคัญ 5 ประการ ได้แก่ การกำหนดประเภทของงานอันมีลิขสิทธิ์ที่อยู่ภายใต้ข้อยกเว้นการละเมิดลิขสิทธิ์ ลักษณะการตั้งอยู่ของงานนั้น ลักษณะการกระทำที่อนุญาตให้กระทำต่องานเหล่านั้น ขอบเขตการนำงานไปใช้ในทางพาณิชย์ และการกำหนดเงื่อนไขอื่นเพิ่มเติม

ปัญหาทางกฎหมายเกี่ยวกับการบังคับใช้พระราชบัญญัติอนุญาโตตุลาการ พ.ศ. 2545 ในประเทศไทย (Legal Problems In The Implementation Of The Arbitration Act B.E. 2545 In Thailand), Siriphat Udakarn

งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา แนวคิด และทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการของประเทศไทย โดยเปรียบเทียบกับหลักการในอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 (อนุสัญญานิวยอร์ก) กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ (2) ศึกษาและเปรียบเทียบกระบวนการอนุญาโตตุลาการของประเทศไทยกับแนวปฏิบัติสากล (3) วิเคราะห์ปัญหาในการบังคับใช้พระราชบัญญัติอนุญาโตตุลาการ พ.ศ. 2545 ที่เป็นอุปสรรคต่อประสิทธิภาพและความน่าเชื่อถือของกระบวนการอนุญาโตตุลาการในประเทศไทย และ (4) เสนอแนะแนวทางปรับปรุงกฎหมายให้เหมาะสมและทันสมัยยิ่งขึ้น งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยใช้วิธีการศึกษาค้นคว้าเอกสารจากอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ ตลอดจนตำรา บทความวิชาการ คำพิพากษา งานวิจัย และวิทยานิพนธ์ทั้งภาษาไทยและต่างประเทศ โดยมุ่งวิเคราะห์เปรียบเทียบประเด็นสำคัญเพื่อเสนอข้อเสนอแนะในการพัฒนากฎหมายไทย ผลการวิจัยพบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการ เช่น ทฤษฎีอำนาจรัฐ ทฤษฎีสัญญา และทฤษฎีความเป็นเอกเทศ รวมถึงหลักความเป็นอิสระของคู่กรณีและหลักพันธกรณีตามสัญญา ยังไม่ถูกประยุกต์ใช้อย่างเหมาะสมในประเทศไทย ทำให้กระบวนการอนุญาโตตุลาการขาดความยืดหยุ่น (2) ข้อพิพาทที่ไม่อาจเข้าสู่กระบวนการอนุญาโตตุลาการตามมาตรา 40 วรรคสอง (2) (ก) ยังไม่มีการบัญญัติให้ชัดเจน ส่งผลให้เกิดความไม่แน่นอนในการตีความ (3) หลักเกณฑ์การเพิกถอนคำชี้ขาดที่ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชนตามมาตรา 40 วรรคสอง (2) (ข) ยังขาดแนวทางการตีความที่แน่นอน และเปิดช่องให้ใช้ดุลพินิจเกินจำเป็น (4) มาตรการคุ้มครองชั่วคราวตามมาตรา 16 ยังไม่มีประสิทธิภาพเพียงพอ เนื่องจากต้องอาศัยข้อตกลงของคู่กรณีและขาดกลไกรองรับจากศาล และ (5) เมื่อเปรียบเทียบกับกฎหมายของประเทศที่มีกระบวนการอนุญาโตตุลาการที่พัฒนาแล้ว เช่น สหราชอาณาจักร สาธารณรัฐสิงคโปร์ รวมถึงอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ พบว่า ประเทศเหล่านี้มีแนวทางที่ส่งเสริมกระบวนการอย่างมีประสิทธิภาพ ทั้งในด้านบทบาทของศาล การตีความนโยบายสาธารณะ และการบังคับใช้มาตรการคุ้มครองชั่วคราว ซึ่งประเทศไทยควรนำมาเป็นแนวทาง โดยเฉพาะการกำหนดข้อยกเว้นของข้อพิพาทให้ชัดเจน การจำกัดขอบเขตของความสงบเรียบร้อยตามหลักนิติธรรม และการส่งเสริมบทบาทของศาลในการสนับสนุนมาตรการคุ้มครองชั่วคราว เพื่อยกระดับกระบวนการอนุญาโตตุลาการของไทยให้สอดคล้องกับมาตรฐานสากล

สิทธิและเสรีภาพของพระภิกษุในระบบกฎหมายไทยถูกจำกัดหลายประการด้วยกัน ในรัฐธรรมนูญแห่งราชอาณาจักรไทยทุกฉบับที่ผ่านมามีบทบัญญัติว่าพระภิกษุเป็นผู้ไม่มีสิทธิเลือกตั้งมาโดยตลอด ทำให้พระภิกษุไม่มีสิทธิประเภทอื่น ๆ ตามมา เช่น สิทธิในการลงประชามติ สิทธิในการเข้าชื่อเสนอร่างกฎหมายหรือแก้กฎหมาย ไม่เพียงเท่านี้ ยังมีพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 มาตรา 29 กำหนดให้เจ้าหน้าที่ราชอาณาจักร คือ พนักงานสอบสวนมีอำนาจสละสมณเพศพระภิกษุผู้ถูกกล่าวหาในคดีอาญาได้ และกำหนด ให้องค์กรคณะสงฆ์ คือ “มหาเถรสมาคม” ออกกฎ คำสั่ง มติ ระเบียบต่าง ๆ มาบังคับใช้กับพระภิกษุ ทำให้เกิดการจำกัดสิทธิภายในคณะสงฆ์มากขึ้นเรื่อย ๆ ปรากฏว่ากฎหมายเหล่านั้นบางฉบับไม่สอดคล้องกับหลักสากลว่าด้วยสิทธิมนุษยชน บางฉบับไม่สอดคล้องกับหลักการการจำกัดสิทธิและเสรีภาพตามรัฐธรรมนูญ และบางฉบับไม่สอดคล้องกับหลักพระธรรมวินัยของสงฆ์ บทความนี้จึงมุ่งพิจารณาว่ากฎหมายที่ตราขึ้นมาเพื่อจำกัดสิทธิและเสรีภาพนั้นเป็นไปสอดคล้องตามหลักสิทธิมนุษยชน รัฐธรรมนูญ กฎหมายบ้านเมือง และหลักพระธรรมวินัย มีผลสัมพันธ์กันหรือไม่ และได้ศึกษาเปรียบเทียบกับพระภิกษุในประเทศพม่า และประเทศศรีลังกา ซึ่งเป็นพุทธศาสนาเถรวาทเช่นเดียวกับพระภิกษุในประเทศไทย เพื่อแก้ไขกฎหมายให้เหมาะสมกับพระภิกษุในสังคมไทยต่อไป

"As technology has altered communication, qualitative criminologists have turned to digital spaces for a cost-effective approach to recruit participants who have been impacted by the criminal legal system. This paper analyzes the limits and benefits of online recruitment, detailing our experience recruiting 93 interviewees online for a qualitative study of criminal record expungement. We compare three approaches: social media advertisements, Amazon’s crowdsourced MTurk platform, and the opt-in survey platform Prolific, and analyze the financial and labor costs associated with each. We detail our experience individually screening 685 interested participants to obtain 86 qualitative interviews suitable for analysis. Our experience shows …

"Sexual assault (SA) remains a pervasive issue in the United States, marked by low reporting rates, inconsistent investigations, and limited convictions. In response, researchers and practitioners have promoted a range of best practices aimed at improving law enforcement and prosecutorial responses. This qualitative study draws on interviews with 13 law enforcement agencies and 12 prosecutors' offices to explore how recommended practices—such as victim advocacy, specialized units, interagency collaboration, and case reviews—are interpreted and operationalized in the field. Findings reveal substantial variability, shaped not only by resource availability but also by leadership priorities, organizational culture, and the ambiguity of guidance documents. …

"Current research indicates transgender women of color are experiencing what is being referred to as an “epidemic of violence.” Law enforcement personnel are in a unique position to mitigate this violence among transgender women of color, however past research shows that law enforcement may in some instances perpetuate already existing violence with this population instead of preventing and intervening in these situations. "Interactive theatre has long been used to educate and empower communities and prevent crime across all age groups. Although older populations are disproportionately victimized through fraudulent online schemes, effective educational interventions, like interactive theatre, have not been utilized to increase crime awareness. This paper describes an explorational research project, analyzing the results of a theatre-based fraud awareness program aimed towards educating victims and their communities about scams targeting older people. "A growing proportion of people leaving prison are over 50 years old and will live at least temporarily under the supervision of a parole officer. While recidivism rates are lower for older people, there are physical, mental, and societal challenges that accompany advancing age that make successful reentry and reintegration a challenging experience compared to their younger counterparts. When the police wrongfully arrest someone, that person faces distinct harms. Various scholarship, news articles, and studies document that AI-powered facial recognition technology (FRT) disproportionately misidentifies individuals from marginalized racial groups when used irresponsibly. Many of those sources indicate that police reliance on FRT without adequate vetting results in wrongful arrests. Yet law enforcement continues to misuse FRT.

This Comment contends that the 42 U.S.C. § 1983 state-created danger doctrine offers a potential remedy for plaintiffs harmed by police reliance on FRT. To prevail under this doctrine, plaintiffs must prove affirmative conduct, deliberate indifference, and proximate causation. If successful, these …

This thesis examines the persistent gap between legal reform and social practice in efforts to end Female Genital Mutilation (FGM) in Egypt. Although FGM has been criminalized since 2008, with stronger penalties introduced in 2016 and 2021, the practice continues, revealing the limits of law when it operates alongside powerful social, religious, familial, and medical norms. The Brady doctrine requires prosecutors to disclose all favorable and material evidence to the defense. To effectuate that rule, the U.S. Supreme Court has defined materiality as a “reasonable probability” that the evidence would have affected the outcome at trial. But apart from that definition, the Court has resisted offering any further guidance to lower courts. While far too little is known about how Brady materiality claims are actually adjudicated, there is strong evidence that courts often reject Brady claims involving withheld evidence on the grounds that the evidence was not significant enough to be material.

Black youth may be even more vulnerable than other youth to admitting to crimes they did not commit in the context of police interrogations. In support, analysis of data from the National Registry of Exonerations indicates that 65% of people who were wrongfully convicted on the basis of false confessions they gave when under 18 years old are Black, whereas only 14% of the U.S. population is Black. The rapid proliferation of incel-related content across digital platforms has raised concerns about online misogyny and its potential impact on women’s perceived safety. However, less is known about how exposure to such content shapes women’s perceptions of risk and emotional responses in everyday digital environments. The recognition and integration of male disposability theory would mean an evolutionary leap in modern theorizing about gender and the law, but it is ignored. Why? This thesis examines whether the protections established in Miranda v. Arizona, 384 U.S. 436 (1966), remain robust within contemporary criminal justice practice or have been weakened through doctrinal and practical developments. Miranda warnings were originally designed to mitigate the risk that coercive custodial interrogation would produce compelled or unreliable self-incrimination. Since 1966, however, both judicial interpretation and evolving law-enforcement practices have created a growing gap between Miranda’s formal legal promise and its practical operation in real-world interrogations.
