บทความวิจัยนี้ศึกษาถึงความเชื่อมโยงระหว่างความรับผิดรับชอบของรัฐบาลและปฏิกิริยาต่อวิกฤตการณ์เศรษฐกิจที่เป็นผลมาจากการระบาดของโรคโควิด-19 โดยผ่านกรอบคิดเรื่อง competing principals ที่ชี้ให้เห็นว่าความรู้สึกรับผิดรับชอบของรัฐบาลต่อผู้มีส่วนได้ส่วนเสียต่าง ๆ นั้นอาจไม่เท่ากัน และอาจส่งผลต่อผลิตผลเชิงนโยบายด้วยเช่นกัน ในกรณีของการระบาดของโรคโควิด-19นั้น ผลเชิงนโยบายนั้นแสดงออกมาในรูปแบบที่รัฐต้องตัดสินใจว่าจะทุ่มเททรัพยากรเพื่อให้การช่วยเหลือทางเศรษฐกิจแก่ประชาชนกลุ่มไหน มากน้อยเพียงใด โดยอาศัยข้อมูลเชิงปริมาณและการเก็บสถิติเรื่องการให้การช่วยเหลือทางเศรษฐกิจของแต่ละประเทศจาก The Oxford COVID-19 Government Response Tracker (OxCGRT) และตัวชี้วัดแบบมหภาคอื่นๆ งานศึกษาชิ้นนี้พบว่าภูมิภาคเอเชียตะวันออกเฉียงใต้นั้นมีความแตกต่างจากที่อื่น ๆ ในโลก กล่าวคือ ความรู้สึกรับผิดรับชอบของรัฐบาลต่อผู้มีส่วนได้ส่วนเสียต่าง ๆ แบบเดียวที่มีผลต่อระดับการให้การช่วยเหลือทางเศรษฐกิจต่อประชาชนของรัฐบาลในเอเชียตะวันออกเฉียงใต้ คือ แบบแนวทแยง (diagonal accountability) ซึ่งเกิดจากการที่สื่อมวลชนและภาคประชาสังคมเปิดเผยและให้ข้อมูลต่อสาธารณชนเพื่อสร้างแรงกดดันต่อรัฐอีกทางหนึ่ง ข้อค้นพบนี้ไม่เพียงแสดงให้เห็นถึงสภาวะกลืนไม่เข้าคายไม่ออกที่รัฐต้องเผชิญเมื่อมีผู้มีส่วนได้ส่วนเสียจำนวนมากในกระบวนการกำหนดนโยบายแต่ยังสะท้อนอีกด้วยว่า 1) รัฐบาลในเอเชียตะวันออกเฉียงใต้อาจไม่ได้รู้สึกถึงความรับผิดรับชอบต่อประชาชนโดยตรงมากนัก 2) รัฐบาลในเอเชียตะวันออกเฉียงใต้อาจไม่ได้รู้สึกถึงความรับผิดรับชอบต่อกลไกเชิงบริหาร เช่น การตรวจสอบและคานอำนาจเช่นเดียวกัน และ 3) รัฐบาลในเอเชียตะวันออกเฉียงใต้จะรู้สึกว่าต้องทำอะไรบางอย่างเพื่อตอบสนองหรือให้การช่วยเหลือประชาชนก็ต่อเมื่อสื่อและภาคประชาสังคมเริ่มตีแผ่ปัญหาและให้ข้อมูลแก่สาธารณชน

In many parts of the United States, the bail system is strikingly unfair, imposing burdensome, and often unmeetable, financial conditions on pretrial liberty even for low-risk defendants. Reforms that reduce or eliminate cash bail and lower pretrial detention rates have made progress in recent years, but now face growing opposition even in generally progressive jurisdictions such as San Francisco and New York City. One source of this opposition is rising concern about crime—particularly crime associated with the unhoused, who disproportionately suffer from mental illness, including substance abuse disorder. Guns And Fatal Police Shootings: Accuracy Of Firearm Prevalence Proxies In A Panel Data Analysis, Corin Elmore

This paper explores the relationship between gun prevalence and fatal police shootings in the United States. Specifically, the study assesses the validity of using FSS (Firearm Suicides Per Total Suicides) as a proxy for gun prevalence. It examines whether FBI background check data can be a more reliable alternative. Through a panel data analysis, the study provides moderate evidence that FBI background check data performs better than FSS as a proxy for gun prevalence and that the relationship between firearm prevalence and fatal police shootings is positive. Much research has been completed on the forms of crime control theater (CCT), and the impact that the existence of CCT laws have on society. Research on CCT laws has shown that they are definitively unsuccessful in providing the safety they were created to provide. This thesis will utilize completed research to explain the main psychological phenomena holding people back from decreasing their support for CCT laws. It will also describe proven methods of correcting misinformation in order to change the perceptions of people who support crime control theater laws, and provide suggestions for how research should be continued.

Cultural stereotypes that link Black race to crime in the U.S. originated in and are perpetuated by policies that result in the disproportionate criminalization and punishment of Black people. The scientific record is replete with evidence that these stereotypes impact perceivers’ perceptions, information processing, and decision-making in ways that produce more negative criminal legal outcomes for Black people than White people. However, relatively scant attention has been paid to understanding how situations that present a risk of being evaluated through the lens of crime-related stereotypes also directly affect Black people. การวิจัยนี้เป็นการวิจัยเชิงคุณภาพ มีจุดประสงค์เพื่อศึกษา 1. มาตรการด้านสิ่งแวดล้อมขององค์การการค้าโลกในการพิทักษ์รักษาและอนุรักษ์สิ่งแวดล้อม 2. ผลกระทบของมาตรการด้านสิ่งแวดล้อมขององค์การการค้าโลกต่อการค้าระหว่างประเทศ และ 3. ความสำเร็จของการบูรณาการการค้าระหว่างประเทศและการคุ้มครองสิ่งแวดล้อมขององค์การการค้าโลก ผลการศึกษาพบว่า 1. มาตรการที่ถูกสร้างขึ้นภายใต้องค์การการค้าโลกเพื่อพิทักษ์รักษาและอนุรักษ์สิ่งแวดล้อมประกอบด้วย กลไกคณะกรรมาธิการด้านการค้าและสิ่งแวดล้อม กลไกองค์กรระงับข้อพิพาท และกลไกข้อตกลงที่เกี่ยวข้องกับเรื่องสิ่งแวดล้อมหลายฉบับ 2. คณะกรรมาธิการด้านการค้าและสิ่งแวดล้อมเป็นเพียงเวทีในการแลกเปลี่ยนความคิดเห็นและประสบการณ์ของประเทศสมาชิกที่มีต่อประเด็นด้านการค้าและสิ่งแวดล้อมเท่านั้น ส่วนแนวทางการตัดสินคดีสิ่งแวดล้อมขององค์กรระงับข้อพิพาททำให้ประเทศสมาชิกโดยเฉพาะกลุ่มประเทศพัฒนาแล้วได้มีการออกมาตรการการค้าเพื่ออนุรักษ์สิ่งแวดล้อมได้อย่างชอบธรรมซึ่งส่งผลกระทบต่อประเทศผู้ส่งออก ในขณะที่ข้อตกลงที่เกี่ยวข้องกับเรื่องสิ่งแวดล้อมต่าง ๆ ส่งผลทำให้ประเทศที่พัฒนาแล้วใช้มาตรการเหล่านี้เป็นเครื่องมือเพื่อกีดกันทางการค้า และ 3. องค์การการค้าโลกยังไม่ประสบความสำเร็จในการบรรลุเป้าหมายตามที่ได้ตั้งเป้าหมายไว้ในธรรมนูญ คือ การบูรณาการการค้าระหว่างประเทศและการคุ้มครองสิ่งแวดล้อมไว้ด้วยกัน แต่ในขณะเดียวกันมิได้ถือว่าล้มเหลว เพราะแม้มาตรการที่เกี่ยวข้องกับสิ่งแวดล้อมเหล่านั้นขององค์การการค้าโลกจะถูกพิจารณาว่าไม่มีประสิทธิภาพ แต่การมีมาตรการและมีการดำเนินงานที่เกี่ยวข้องสะท้อนให้เห็นถึงข้อเท็จจริงว่าองค์การการค้าโลกได้มีการดำเนินการอย่างเป็นรูปธรรมเพื่อที่พยายามที่จะบรรลุวัตถุประสงค์ดังกล่าว

การรับนักเรียนเข้าเรียนถือเป็นกิจกรรมที่เกี่ยวข้องกับปัญหาความเหลื่อมล้ำทางการศึกษาโดยตรง เพราะความเหลื่อมล้ำทางการศึกษาเป็นผลลัพธ์ของกระบวนการจัดสรรบริการด้านการศึกษาที่ไม่เป็นธรรม งานวิจัยชิ้นนี้ตั้งคำถามต่อนโยบายการจัดสรรที่นั่งเรียนในหน่วยบริการการศึกษาของรัฐไทยในระดับมัธยมศึกษา โดยมุ่งศึกษาว่าตัวแบบนโยบาย (Policy design) ของนโยบายการรับนักเรียนเข้าเรียนในสถานศึกษาสังกัดสำนักงานคณะกรรมการการศึกษาขั้นพื้นฐาน (สพฐ.) มีการประกอบสร้างภาพลักษณ์ของโรงเรียนและนักเรียนไว้อย่างไร? และการประกอบสร้างดังกล่าวมีส่วนช่วยบรรเทาหรือซ้ำเติมความเหลื่อมล้ำด้านการศึกษาอย่างไร? ผู้วิจัยใช้วิธีการวิเคราะห์นโยบายเชิงตีความ (Interpretive Policy Analysis) การวิเคราะห์กรอบการจำแนกแยกแยะ (Category Analysis) และใช้กรอบแนวคิดการประกอบสร้างกลุ่มเป้าหมายของนโยบาย (Social construction of target population) ของ Schneider and Ingram ที่มองว่า “ภาพลักษณ์” ของกลุ่มเป้าหมายของนโยบาย (ในที่นี้คือโรงเรียน) มีอิทธิพลต่อการออกแบบนโยบาย ซึ่งสุดท้ายจะมีผลตอกย้ำความไม่เป็นธรรมที่มีมาแต่เดิมในสังคม งานวิจัยพบว่า เนื้อหาของนโยบายการรับนักเรียนเข้าเรียนของสพฐ. มีการประกอบสร้างภาพลักษณ์ของโรงเรียนบนมโนทัศน์ของหลักกลไกตลาด ที่แยกแยะ “โรงเรียนอัตราแข่งขันสูง” ออกจาก “โรงเรียนทั่วไป” และสร้างแนวปฏิบัติที่เป็นการผลิตซ้ำภาพลักษณ์ทางสังคมที่มีมาก่อนของโรงเรียนทั้งสองประเภท กล่าวคือ ภาพลักษณ์ของโรงเรียนอัตราแข่งขันสูงถูกประกอบสร้างให้เป็นผู้ให้บริการการศึกษาของรัฐคุณภาพสูง ส่วนภาพลักษณ์ของโรงเรียนทั่วไปถูกประกอบสร้างให้เป็นผู้ให้บริการการศึกษาของรัฐคุณภาพต่ำ ในกระบวนการสร้างภาพลักษณ์ดังกล่าว นโยบายมีการจัดสรรภาระให้แก่โรงเรียนประเภททั่วไปที่สูงกว่าโรงเรียนประเภทอัตราแข่งขันสูงอย่างไม่สมเหตุสมผล เช่น โรงเรียนประเภทอัตราแข่งขันสูงมีสิทธิ์ในการคัดกรองผู้เรียนที่มีศักยภาพทางวิชาการ “สูง” ไปก่อนโรงเรียนประเภททั่วไป ในทางกลับกัน โรงเรียนประเภททั่วไปต้องรับภาระการจัดสรรสวัสดิการขั้นพื้นฐานและภาระในการพัฒนาผู้เรียนที่มีศักยภาพแตกต่างหลากหลาย

Objective: This is a meta-analysis focused on the success rates of scent detection canines and potential factors that could influence their accuracy. A series of statistical analyses were conducted to determine if certain demographic factors, such as the dog’s gender, age, and breed, have an effect on a scent dog’s accuracy during a search. Or if more circumstantial factors, like the dog’s level of experience in scent work, the type of target scent, and their handler’s awareness of the target’s location, affect the outcome of the search.

A Commentary On Qualified Immunity In The Aftermath Of City Of Tahlequah V. Bond, Delores Jones-Brown, Paul Reck, Richard C. Helfers, Henry F. Fradella

In this Article, we argue that the Bond decision continues a line of judicial decisions that make it difficult for plaintiffs to seek civil redress against officers who cause serious injury or death to private citizens. We note that this judicial trend runs counter to public demand for police accountability and thwarts the legislative intent behind the enactment of 42 U.S.C.A. § 1983. We suggest that police practice, policy, standards and training-not judicial opinions should govern whether officers will be immune from the consequences of their actions, especially in areas where a substantial amount of empirical evidence exists to alert …

Empirical studies have pointed to the increasing importance of procedural justice as a tool for improving the relationship between the police and local communities. The mediating role of procedural justice continues to be embraced by scholars, practitioners, and community members; as a result, we examine in the present study African Americans’ attitudes toward the police via the interpretive lens of procedural justice policing. Using procedural justice questions found in the social-psychology literature, we interviewed seventy-seven African Americans in Durham, NC, to assess their views about the U.S. police. The overall goal of this dissertation is to examine how the built and natural environment influences how potential criminals identify crime sites to offend within. Guided by the theoretical principles of crime site selection and crime pattern theory, this study specifically focuses on the crimes of street robbery and commercial burglary in three unique study locations—Atlanta, GA, Fayetteville, NC, and Rochester, NY. The data for this study were collected from multiple publicly available data repositories. As needs assessments are comprised of subscales that include non-observable, latent constructs, the comprehensive assessment of these items and scales is essential. Specifically, to ensure these tools are measuring offender needs as intended, their construct validity must be confirmed. The current project used a multi-level, multi-group analysis of the MPACT with a large, 10-state sample of youth. Building on previous work (see Mei et al., 2022), authors confirmed the dimensionality and reliability of the six MPACT needs domains. The acronym SWERF, or Sex Work(er) Exclusive Radical Feminism, and its attendant ideologies brings up a number of questions and potential schisms for the enterprise of feminist thought more broadly. This inquiry examines what it means for feminism to exclude, what the excluders believe is gained by protecting certain boundaries around which identities and practices are included, and the ideological foundations and consequences of this thinking. The first chapter examines the connection between gentrification and urban violence. I demonstrate a positive and plausibly causal relationship between urban redevelopment and gun violence in Philadelphia. As the underlying mechanism, I focus on gentrification's displacement effect on local drug markets. Treating the city as a spatial network of city blocks and using two-way fixed effects differences-in-differences estimators, I show the gentrification of one block increases violence across the surrounding neighborhood. I find that some 2,400 (8%) of Philadelphia's shootings between the years 2011 and 2020 can be attributed to spillover effects from the gentrification of drug blocks. This effect …

Extralegal Bias In The United States Military In Sexual Assault Cases, Taylor F. Blackston

By evaluating the case recommendations following a preliminary hearing from military sexual assault cases from fiscal years 2016-2018, this study aims to assess whether or not extralegal factors are influencing decisions of case recommendations of assigned convening authorities. Using secondary data from the Department of Defense’s annual reports on sexual assault in the United States military (n=5,171), this study aims to answer the following questions: Do extralegal factors contribute to convening authorities’ recommendations following Article 32 hearings? If so, what extralegal factors contribute to convening authority's decision on non-judicial hearing recommendations? The results of the following analyses identified several extralegal …

Defendant race and ethnicity impact sentencing length decisions, leading to discrimination in the criminal justice system. Aspects of the pretrial process that strongly correlate with a defendant’s socioeconomic status, the use of cash bail, may also influence sentencing length, given the negative stereotypes about individuals of lower socioeconomic statuses. Relatively few studies have explored the impact of cash bail use on sentencing decisions or sought to understand why use of cash bail might influence these decisions. The following paper aims to identify and explain variation in Ohio police department methods of response to calls for service (CFS) involving mental health crises. Police response to mentally ill or disturbed individuals has become a topic of increased discussion in recent decades. Communities have attempted to bring reform to this area with alternative solutions, including specially trained police officers, co-response with social workers, or community-based response teams. Despite the beneficial impacts of drug court participation, access to these programs may not be equitable across racial groups. The reasons behind racial disparities in access to these programs are not well-documented in the current literature. This study investigates disparities in access to drug court and the possible reasons they occur. Chi-square tests are used to assess for disparities in admissions between Black and White individuals referred to drug court. Forensic science and entomology programs may benefit from using deceased pigs as teaching resources due to anatomical similarities to humans. The use of such animals provides opportunities for students to learn the effects of geographical location and climate on insects; understand insect succession; practice insect collection and identification; and learn post-mortem interval procedures, taphonomic principles of decomposition, and crime scene investigation and management techniques. Forensic entomology and taphonomic studies fit well with educational interests in experiential learning. Pigs may be readily available through animal science departments or local producers, and many institutions may have property where this research can be …

Submerged items are often thought to lack evidentiary value. However, previous studies have shown the ability to recover DNA from submerged porous items for upwards of six weeks. The crevices or interweaving fibers in porous items are thought to protect DNA from being washed away. It is hypothesized that, because non-porous surfaces do not have the same traits that might aid in DNA retention, then DNA quantities and the number of donor alleles recovered would decrease over longer submersion periods. Intimate partner violence (IPV) is a severe public health and criminal justice issue that disproportionately affects women more than men. This sought to explore Latina experiences of IPV in the Rio Grande Valley (RGV). Twelve Latina IPV survivors from the RGV, ages 24 to 40 years old, were interviewed using purposive and snowball sampling methods. Several primary themes were discovered: types of abuse; perceived reasons for the abuse; education and economic insecurity; why stay or leave an abusive relationship; the criminal justice system’s role; and self blaming. How Racial Trauma Manifests In Black Women From Direct And Indirect Encounters With Police Brutality, Ashley Turner

This phenomenological study explored Black women’s lived experiences with racial trauma stemming from direct and indirect encounters with police brutality. A total of nine participants living in Washington state participated in this study. They identified as Black, ciswomen, fluent in English, and at least 21-years-old. In-depth, semi-structured, qualitative interviews were conducted to explore participants’ experiences with police. Transcripts were analyzed using interpretative phenomenological analysis. The results consisted of the following five themes: (a) forms of police encounters, (b) influence of identity, (c) perceived reason for police brutality, (d) emotions stemming from police brutality, and (e) tactics to survive police interactions. …
