In recent years, there has been heavily publicized incidents of police use of military weapons and tactics, which has raised concerns regarding the militarization of police. More famously, in 2014, Ferguson police utilized military weapons and tactics to quell the masses after the police shooting of Michael Brown incited protests and riots. Despite an overall decrease in incidents of police use of force and deadly shootings, individual dramatic events of police militarization paint a picture of a militarized police force. This coincides with an overall increase in military equipment transfers (e.g., weapons, vehicles) to police agencies in the United States. …

The purpose of the current study is to examine how ideology and situational factors shape terrorist target selection in the United States. While a growing number of studies have examined target selection by terrorists, the current study is the first to consider how combinations of factors present situated opportunities for terrorists to select particular types of targets as opposed to others. Guided by the situational crime prevention approach, this study relies on data from the American Terrorism Study (ATS) to measure attributes of incidents perpetrated by far-right and Islamic extremists and target selection. This work examines criminal effects of the legalization of recreational marijuana in the state of California in 2016. While multiple states have legalized marijuana for recreational purposes, there is little empirical evidence to determine the criminal effect, if any, of introducing marijuana products into the legal market. The research analyzes crime rates pre and post legalization. Crime rates from the years 1990-2018 are taken from the California Attorney General Office “Crime in California” annual report, and consist of FBI Part I offenses: murder and non-negligent homicide, rape, robbery, aggravated assault, burglary, motor vehicle theft, larceny-theft, and arson. This thesis seeks to create a policy proposal in order to address incidences of prosecutorial misconduct and abuse of discretion in the Mississippi criminal justice system. To do so, the author has summarized and analyzed seven criminal cases in which defendants have become victims of prosecutorial misconduct in order to shed light on the lack of prosecutorial accountability in the state’s criminal justice system. In an attempt to solve the problem, the author has developed a novel grading rubric in order to objectively and systematically analyze and evaluate previously proposed policy recommendations by legal experts and justice organizations. Over the course of the last two decades, anxiety over school shootings has continued to influence school safety reform. Due to prominent news coverage and growing fear over school shootings, school securitization in American public schools has expanded to include the arming of schoolteachers. While supporters advocate for the need to arm schoolteachers, little is known about the level of support the policy receives from the very people it is intended to protect - students. Mass incarceration has been a dominant concern within the criminal justice system since the 1970s. Criminologists and other researchers have looked at the effects crime has on the steadily increasing incarceration rate but to little avail. Intergenerational patterns of incarceration further oppress minority and low-income communities. Although researchers have been able to identify some forms of causation, much more research needs to be done to understand why certain people, according to race, age, gender, and socioeconomic status, are more likely to be incarcerated, arrested, and convicted than others. Violations of academic honor are relative to many of the same factors that lead to dishonesty by individuals subject to the criminal justice system. Malingering is defined as the feigning of psychological or physical ailment for gain, which is a technique regularly used to exploit both academic institutions and the U.S. court system. A phenomenological qualitative study using Critical Race Theory and counter-storytelling was completed to investigate what K-12 public schools should be doing to keep young people out of the school-to-prison pipeline (STPP). This study took place in a large city in the Mid-Atlantic region of the United States. Interviews were completed with former students of the researcher who were previously incarcerated, educational professionals, and justice system professionals. Additionally, observations of the court systems and document reviews were completed in order to triangulate findings. Mental health problems have become a common occurrence in American correctional settings. This occurrence is not equally distributed in terms of gender; incarcerated women have higher rates of mental illness incarcerated men (Bronson & Berzofsky, 2017; James & Glaze, 2006). This phenomenon is problematic as research suggests that American correctional institutions are ill equipped to treat and manage inmates with mental health problems (Arrigo & Bullock, 2008; Bennion, 2015; Clark, 2018). The purpose of this research is to determine police officers perceived benefits of take-home police cruisers. The primary question to be answered by this research is: do officers see take-home cruisers as a benefit to the department and what are those benefits? Departments typically make large decisions like switching to take home cruisers based on department budgets, what makes the most sense for their individual department, and how it would affect their officers. This research project conducted and then analyzed qualitative interviews from former and current addicts and criminal offenders who are voluntarily participating in the Christian faith at the same non-traditional, Protestant church. An abridged case study of this church is also provided for background and context. Life-course theory and grounded theory are utilized.
Both the offenders and this church were chosen in an attempt to better understand how the offenders’ involvement at this house of worship, along with their faith in general, have impacted them. In recent years, correctional agencies have increased their use of video visitation in an effort to offset costs and increase security, among other objectives. In the present study, interviews (N = 12) and surveys (N = 58) were conducted with prisoners at a jail in the Northwestern U.S. that had replaced in-person, glass partition visitation with remote video visitation. The results suggested that while there were positive aspects of video visitation, such as the ability to visit with loved ones from afar, there were criticisms as well, including technological and access issues. Case evidence and situational arrest characteristics are widely speculated to influence courtroom actor decisions, yet such measures are infrequently included in research. Using new data on felony cocaine cases from an urban county in a Southern non-guideline state, this study examines how physical evidence and arrest circumstances affect three stages of case processing: initial charge type, charge reduction, and sentence length. The influence of evidence appeared strongest at the early stage when prosecutors chose the appropriate charge, though certain evidentiary and arrest measures continued to influence later decisions. Charge reductions were driven mostly by legal factors, and while guilt should …

Debt Bondage: How Private Collection Agencies Keep The Formerly Incarcerated Tethered To The Criminal Justice System, Bryan L. Adamson

This Article examines the constitutionality of statutes which allow courts to transfer outstanding legal financial obligations to private debt collection agencies. In Washington State, the clerk of courts can transfer the legal financial obligation of a formerly incarcerated person if he or she is only thirty days late making a payment. Upon transfer, the debt collection agencies can assess a “collection fee” of up to 50% of the first $100.000 of the unpaid legal financial obligation, and up to 35% of the unpaid debt over $100,000. This fee becomes part of the LFO debt imposed at sentencing, and like that …

It is believed that the punitive values of the United States have had a direct positive correlation with the mass incarceration rates experienced in the United States. Many studies have attempted to understand variation in punitiveness across social groups, and have found that there are consistent racial differences that exist. Grantees use an online data management system to submit data on participants served under their Vocational and Life Skills programming. This data is due monthly and reflects all services provided during the previous month to participants. Evaluators at the Nebraska Center for Justice Research work with grantees directly to manage data entry errors on an ongoing basis during update calls and site visits.

Safe Consumption Sites And The Perverse Dynamics Of Federalism In The Aftermath Of The War On Drugs, Deborah Ahrens

In this Article, I explore the complicated regulatory and federalism issues posed by creating safe consumption sites for drug users—an effort which would regulate drugs through use of a public health paradigm. This Article details the difficulties that localities pursuing such sites and other non-criminal-law responses have faced as a result of both federal and state interference. It contrasts those difficulties with the carte blanche local and state officials typically receive from federal regulators when creatively adopting new punitive policies to combat drugs. In so doing, this Article identifies systemic asymmetries of federalism that threaten drug policy reform. While traditional …
