The purpose of this study was to explore the link between exposure to domestic violence (DV) and the presence of symptoms of anxiety in a population of justice-involved juveniles. The categories of DV were broken down into verbal abuse and physical abuse, along with a third category of juveniles that witnessed both forms of abuse within their households. This study compared the prevalence of anxiety in juveniles when faced with the different instances of DV through the use of data collected from a longitudinal study conducted by the Pathways to Desistance Project. Journal of Criminal Law and Criminology
Safeguarding Fourth Amendment protections is critical to preserving individual privacy rights and fostering positive perceptions of police legitimacy within communities. Maintaining an effective accountability structure for police stops, searches, and seizures is a necessary step toward achieving these objectives. In this article, we use qualitative interviews and survey data with defense attorneys to explore—from a court community perspective— their use of discretion to uphold the Exclusionary Rule through bringing suppression motions. Data demonstrate that power dynamics within the court community lead defense attorneys to conclude that litigating rights violations is often a futile effort that interferes with favorable case outcomes …

The Nebraska Center for Justice Research (NCJR) was established in 2014 with a mission to develop and sustain criminal justice research capacity internal to the State of Nebraska. Our goal is to assist the Legislature, justice agencies, practitioners, foundations, and stakeholders with research and evaluation to reduce recidivism, promote the use of evidence-based practices, and improve public safety. This annual report summarizes the activities and financial status of NCJR in its second year.

The COVID-19 pandemic has produced many changes in the lives of our students and families. In this article, the responses of students in criminal justice classes at a Hispanic serving institution in south Texas were collected and synthesized. The 252 responses were divided into seven frequently observed and repeated themes: jobs and job related, school and courses, graduation, routine, family, positivity, and groceries/shopping. Findings for this time period matched what much of what the national and international news and reports have all reported. It indicates that, as teaching professionals, we must be mindful to provide the added support to assist …

The authors give an overview of a research project that examined in detail 106 characteristics of 78 school violence incidents that occurred in the United States between 1979 and 2011. The result is an extensive overview of the location, date, and time of school violence incidents; the school environment in which violence occurred; the school violence incident itself; the characteristics of the perpetrators involved; characteristics of weapons used; and injuries incurred. This national survey research project examined the experiences of Canadian correctional officers (COs) in providing essential correctional services during the COVID-19 pandemic. The study sampled COs from several provinces across Canada (N=596) to better understand how the pandemic impacted stress and wellbeing of this population by exploring seven constructs including resiliency, workplace safety, changes in role or responsibilities, work stress, COVID- 19 related stress, perceived support, and positive mental health. The transactional model of stress and coping and the biopsychosocial model of stress were used as theoretical frameworks to investigate stress responses among COs. Due to the Coronavirus Disease 2019 (COVID-19), the public has been advised to isolate and quarantine from one another. These social distancing practices have also been applied to institutions such as schools, universities, businesses, and even prisons. Within prisons, officials have been working with the medical community to determine the best course of action to contain the spread of the virus. The current proposed policies for prisons to contain COVID-19 are decarceration or medical isolation. On May 6th, 2020, after extensive public comment and review, the Department of Education published the final rule for the new Title IX regulations, which took effect in schools on August 14th. Title IX is the nearly fifty year old piece of the Education Amendments that prohibits sexual discrimination in federally funded schools. Several of these changes, such as the inclusion of live hearings and cross examination of witnesses, have been widely criticized by victims’ rights advocates for potentially retraumatizing victims of sexual assault and discouraging students from pursuing a Title IX claim. Intimate Partner Violence (IPV) is a major public health issue that harms thousands of families and communities across the globe. Unlike other forms of violence or criminal behavior, IPV is often concealed within the privacy of one's household, where the public cannot witness the occurrence of spousal abuse. In 2016, Australia was in the international spotlight after an 11-year-old child became the ‘youngest known person’ to be charged with murder (Booth, 2016). The minimum age of criminal responsibility (MACR) in Australia is 10 years old, with children being charged, trialled, sentenced, and imprisoned for breaking the law. In response to the case, Amnesty International called on the Australian Government to raise the MACR to 12 years, noting that ‘Australia’s out-of-step laws dictate’ that this boy could be held criminally responsible (Booth, 2016; O’Brien & Fitz-Gibbon, 2017). Immigration has remained one of the most controversial political debates throughout the United States. Research has yet to fully examine the effects of political affiliation of federal districts on sentencing outcomes for specific immigration offenses. To fill the gaps in research, this study compares political affiliation of federal districts among immigration offenses to determine variations in sentencing outcomes. Data included Presidential and House of Representative votes for the 2016 election and Monitoring of Federal Sentencing for the fiscal years of 2015-2016. This thesis provides an ethnographically grounded analysis of how existing regulations shape the legal recreational cannabis industry in Washington State. I examine the processes involved from seed to sale, including cultivation, processing, quality-control testing, and distribution of recreational cannabis. Terrorism research has gained much traction since the 9/11 attacks, but some sub genres of terrorism, such as right-wing terrorism, have remained under-studied areas. Unsurprisingly data sources to study these phenomena are scarce and frequently face unique data collection obstacles. This paper explores five major, social-scientific terrorism databases in regards to data on right-wing terrorist events. The paper also provides an in-depth examination of the utilization of criminal legal proceedings to research right-wing terrorist acts. Lastly, legal case databases are introduced and discussed to show the lack of available court information and case proceedings in regards to right-wing terrorism.

It is a commonly held intuition that increasing punishment leads to less crime. Let us move our glance from the punishment for the crime itself to the punishment for the attempt to commit a crime, or to the punishment for the threat to carry it out. We argue that the greater the punishment for the attempted robbery, i.e., for the threat, "give me your money or else," the greater the number of robberies and threats there will be. The punishment for the threat makes the withdrawal from it more expensive for the criminal, making the relative cost of committing the …

Research suggests there may be a Camera Perspective Bias (CPB) effect across different camera footage types which influences viewer perceptions of police use of force encounters. Police body-worn camera (BWC) footage presents a first-person perspective from the officer’s point of view which predominantly captures the civilian. It is suggested that viewing an encounter from this perspective elicits a positive bias towards the officer when compared to CCTV footage. Additionally, research also shows that attitudes towards police influence perceptions of a filmed police-civilian encounters. Due to an over-reliance on law enforcement, police officers have become frontline responders to individuals suffering with mental illness, despite not being properly trained to handle such situations. Many studies have addressed officers’ feelings of incompetence and lack of preparedness when faced with an individual in distress. In the penalty-phase of a capital case, defense attorneys face a difficult task in managing the identity of their now convicted client. They must present a coherent narrative that combats the prosecution’s case and engenders leniency from the jury. The closing argument given by the defense attorney(s) provides a unique opportunity to analyze and understand the general use of stigma management techniques and their applicability to capital cases. Police suicide has consistently remained a more likely cause of death for police officers than being killed in the line of duty for the past several years. Understanding the risk factors and precursors associated with suicide is crucial to changing this anomalousness. Prevention, early intervention, treatment, support, and reducing stigma, may help lower the number of police officers committing suicide.

Law enforcement agencies and school systems face the critically important task of preventing attacks of targeted school violence and providing safe environments for students, faculty, and staff. The tragic results of past school shooting incidents have caused law enforcement agencies to work collaboratively with educators to develop strategies to reduce violent attacks.
Numerous examples from previous school shooting incidents show that shooters exhibited certain warning signs before the attack, and those signs went unaddressed. The collateral consequences and harmful effects of juvenile sex offender registration and restrictions has been the forefront of conversation surrounding sex offender legislation in the United States. The literature available has consistently shown that juveniles profoundly differ from adults in significant areas such as decision making, cognitive capability, judgment, and overall development. The literature has also consistently shown that juvenile sex offenders are amenable to treatment, have considerably low recidivism rates, and are unlikely to offend into their adulthood. The purpose of this chapter is to use the concept of folie à deux (or shared delusion disorder) to examine the phenomena of “Q” and the “QAnon” movement in the 21st century. The insurrection which occurred on January 6, 2021 during the attack on the United States’ capitol, drew the authors’ attention to try to understand the reason for this mass violence and to determine what individuals, motivations, and beliefs brought this violence to life. ความพยายามให้เกิดการบริหารจัดการสาธารณภัยอย่างเป็นระบบเป็นหนึ่งในประเด็นสำคัญที่รัฐบาลวางแนวทางไว้ในการปฏิรูประบบราชการเมื่อปี พ.ศ. 2545 และนำไปสู่การก่อตั้งกรมป้องกันและบรรเทาสาธารณภัยโดยมีภารกิจหน้าที่ในการจัดทำแผนแม่บท วางมาตรการ ส่งเสริมสนับสนุน การป้องกัน บรรเทาและฟื้นฟูจากสาธารณภัย บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาวิเคราะห์ปัญหากลไกการบริหารจัดการสาธารณภัยในระดับพื้นที่และเสนอตัวแบบการบริหารจัดการที่เหมาะสม จากการวิจัยกรณีศึกษา 8 จังหวัด พบข้อจำกัดของการบริหารจัดการทั้งในแง่ระบบงาน กลไก และโครงสร้าง ผลการศึกษานำมาซึ่งข้อเสนอในการกำหนดกลไกการบริหารจัดการสาธารณภัยในระดับพื้นที่ 3 รูปแบบ ได้แก่ รูปแบบสำนักงานป้องกันและบรรเทาสาธารณภัยจังหวัด รูปแบบสำนักงานป้องกันและบรรเทาสาธารณภัยกลุ่มอำเภอ และรูปแบบสำนักงานป้องกันและบรรเทาสาธารณภัยอำเภอ โดยรูปแบบที่เหมาะสมกับพื้นที่ตามหลักการบริหารจัดการเป็นรูปแบบสำนักงานป้องกันและบรรเทาสาธารณภัยกลุ่มอำเภอ เพราะมีความชัดเจนในโครงสร้างการตอบสนองภารกิจเชิงความเชี่ยวชาญและฐานะของหน่วยงานเชิงอำนาจหน้าที่ อย่างไรก็ตาม ไม่มีรูปแบบใดดีที่สุดเพราะการประยุกต์ใช้ยังเกี่ยวพันกับสภาพพื้นที่และการเข้าถึง ลักษณะสาธารณภัย ประชากรและขอบเขตการปกครอง และศักยภาพของเครือข่าย นอกจากนี้การประยุกต์ใช้ยังต้องอาศัยขีดความสามารถของหน่วยปฏิบัติด้วย นำไปสู่ข้อเสนอแนะว่าขีดความสามารถของผู้จัดการสาธารณภัยเป็นเงื่อนไขของการพัฒนาการบริหารจัดการสาธารณภัย

แม้ว่าการดำเนินกิจกรรมต่าง ๆ ในชีวิตสมัยใหม่ของผู้คนทั่วไปจะมีคำพยากรณ์อากาศของกรมอุตุนิยมวิทยากำกับแนวเป็นทาง ทว่า เหตุใดเหล่าพ่อค้าแม่ขายในตลาดนัดแห่งหนึ่งของกรุงเทพมหานครกลับปฏิเสธคำพยากรณ์ดังกล่าวของทางการและหันไปเชื่อถือปากคำของเจ้าเข้าทรงคนหนึ่งซึ่งช่วยบอกพวกเขาว่าสภาพอากาศในแต่ละวันจะเป็นอย่างไรแทน บทความพยายามตอบคำถามนี้ผ่านการแกะรอยสถานการณ์ที่เกิดขึ้นและให้ข้อเสนอว่าการหันไปเชื่อถือคำพยากรณ์อากาศของเจ้าเข้าทรงเป็นหนทางที่ผู้ค้าในตลาดนัดเข้าถึงอำนาจในอีกวิถีหนึ่งสำหรับต่อสู้ดิ้นรนกับกรงขังของความรู้ อันถูกสร้างขึ้นจากปฏิบัติการทางวิทยาศาสตร์และสิทธิอำนาจของหน่วยงานทางการ อีกทั้งยังครอบทับความเป็นไปได้ในการดำเนินกิจกรรมทางเศรษฐกิจของพวกเขา นอกจากนี้บทความยังอภิปรายมุมมองเชิงแนวคิดและทฤษฎีผ่านการทำงานภาคสนามและการทบทวนวรรณกรรมเพื่อชี้ให้เห็นถึงรูปลักษณ์อันผสมผเสของสิ่งต่าง ๆ อันนำไปสู่คำพยากรณ์อากาศทั้งในเชิงวิทยาศาสตร์และเชิงความเชื่อเหมือน ๆ กัน

In this essay, my contention is two-fold. One, Bong Joon-ho’s f ilm Parasite (2019) is not simply about class inequality but more importantly addresses the question “what is (not) to be done?”.To appreciate this point, we have to investigate it alongside Bong’s previous f ilms, especially Snowpiercer (2013) and Okja (2017). Although these three f ilms possess vastly different storylines,they all wrestle with this burning political question from different angles: seizure of state power and revolution (Snowpiercer), “folk politics” (Okja), and neoliberal privatization of social problems (Parasite). บทความนี้ศึกษาปัจจัยที่ส่งผลต่อความสำเร็จในการสร้างความเป็นปึกแผ่นให้กับประชาธิปไตยในเกาหลีใต้ โดยในการศึกษาจะใช้นิยามขั้นต่ำของการสร้างความมั่นคงให้กับประชาธิปไตยที่ให้ความสำคัญกับประเด็นคำถามที่ว่าประชาธิปไตยจะมีเสถียรภาพได้อย่างไร หรืออะไรคือเงื่อนไขที่เกื้อหนุนให้ประเทศประชาธิปไตยใหม่ไม่หันย้อนกลับไปสู่ระบอบเผด็จการอำนาจนิยม ข้อถกเถียงสำคัญของงานนี้คือการควบคุมโดยพลเรือนเป็นปัจจัยสำคัญที่สุดที่ทำให้ประชาธิปไตยในเกาหลีใต้มีความมั่นคงและยั่งยืน การดำเนินการดังกล่าวเป็นการปลดชนวนภัยคุกคามต่อเสถียรภาพของประชาธิปไตยที่น่าเกรงขามมากที่สุด ในกรณีของเกาหลีใต้ กระบวนการสถาปนาการควบคุมกองทัพโดยพลเรือนเริ่มต้นจากการปลดย้ายกลุ่มนายทหารที่ยุ่งเกี่ยวกับการเมืองและและการขับเคลื่อนการปฏิรูปภาคความมั่นคงที่มุ่งเน้นหลักความเป็นมืออาชีพของกองทัพ ความพยายามที่ผลักดันทหารกลับเข้าสู่กรมกองนี้ได้แผ้วถางทางให้กับรัฐบาลพลเรือนชุดถัดมาให้ดำเนินการขับเคลื่อนการปฏิรูประลอกใหม่ที่มุ่งเน้นทิศทางของการทำให้กองทัพมีความเป็นพลเรือนมากขึ้น ตัวอย่างเช่น การเพิ่มจำนวนเจ้าหน้าที่พลเรือนในกระทรวงการป้องกันประเทศ และการสนับสนุนค่านิยมแบบประชาธิปไตยในกองทัพ อาทิ หลักสิทธิมนุษยชน เป็นต้น
