The history of tribal-state political relations has been contentious from the beginning of the republic. As a result of these tensions, the relationship of tribal nations and the federal government was federalized when the U.S. Constitution was ratified in 1788. Thus, a number of states, especially in the West, were required in their organic acts and constitutions to forever disclaim jurisdiction over Indian property and persons. This article analyzes these disclaimer clauses, explains the factors that have enabled the states to assume some jurisdictional presence in Indian Country, examines the key issues in which disclaimers continue to carry significant weight, …

Vine Deloria, Jr., the most important Indian chronicler of indigenous political, legal, and religious experience in the U.S. in the last thirty years, noted recently that Indian life, particularly the experience of reservation-based tribal peoples, "has only the slightest resemblance to the conditions of three decades ago, and the current situation has elements of hope and portents of disaster." This observation is even more realistic as we sit at the dawn of the new millennium. It is widely reported that the federal government has a trust relationship with the Indian peoples of this land, one of the many distinctive features of the indigenous/federal relationship. Transformational leadership has become one of the dominant paradigms of leadership studies since its fist articulation by James MacGregor Burns in 1978. In recent years, however, this formulation of leadership has come under criticism, to include the critique of its ethical implications. One of the most innovative and provocative of such critiques is on by Michael Keeley in this book, grounded in his close study of the political theory of James Madison. Keeley argues that Madison provides a model of leadership that opposes transformational leadership and that avoids many of its ethical pitfalls. The discovery doctrine is one of the baseline legal concepts that has worked to seriously disadvantage the land rights of indigenous nations in the United States because it asserts, as one of its definitions, that the "discovering" European nations and their successor states, gained legal title to Indian lands in North America. The author argues, using comparative colonial and early American treaty, legislative, and other historical data, that this definition is a legal fiction. In historical reality, discovery was merely an exclusive and preemptive right that vested in the discovering state the right of first purchase.

Recently, however, Bechler & Johnson (1995) made an initial attempt to identify a relationship between perceptions of leadership and perceptions of listening skill. Their study found a significant positive correlations between member perceptions of who was leading the group and member perceptions of which members were the best listeners. “Those subjects ranked as most like a leader were also typically ranked as good listeners…Individuals perceived to be leading the groups were most commonly believed to be listening to the groups” (Bechler & Johnson, 1995, pp.82-83). The overall goal of this research project is to do a comprehensive study that integrates an undergraduate career in leadership studies with a thorough, critical examination of a topic that is of interest to me. Since beginning course work at the Jepson School, I have felt that a majority of the theories and concepts studied have been primarily focused on the leader and the follower, and their relationship. My goal is to examine the theory of transforming leadership through specific case studies of transforming leaders, and test how the element of culture affects this transforming leadership.
