Repurposing The United Nations Trusteeship Council To Govern The Establishment Of Outer Space Settlements, Andrew Wulf

Current existing international law and treaties on outer space do not address or regulate private actors’ property claims or human settlements in outer space. American companies such as SpaceX and Blue Origin, as well as countries like the United States, Russia, and China, are seeking to create colonies on the Moon and Mars. However, there is no international legal authority to allow or regulate this. In order to legitimize and control this impending outgrowth of human settlements, this paper proposes that the U.N. Trusteeship Council be repurposed to govern non-state actors’ claims of outer space property.

This article argues that climate change’s destabilizing impacts require us to look at existing international governance tools at our disposal with fresh eyes. As such, Council climate action cannot and should not be dismissed out-of-hand. As conflicts rise, migration explodes, and nations are extinguished, how long can the Council remain on the climate sidelines? They were created around the 1990s amid a paradigm shift in international relations after the end of the Cold War. This study examines whether the United Nations should take steps in the near future to exploit the operational characteristics of lighter-than-air (LTA) and hybrid aircraft in support of its peace and humanitarian operations. Continued progress in the development of LTA transport system makes this a timely issue. At the same time, this progress highlights persistent challenges to the conduct of reliable and safe LTA operations, particularly in the face of bad weather and threats from groups hostile to the UN mission. Indigenous peoples throughout the world face diverse and often formidable challenges of what might be termed “water justice.” On one hand, these challenges involve issues of distributional justice that concern Indigenous communities’ relative abilities to access and use water for self-determined purposes. On the other hand, issues of procedural justice are frequently associated with water allocation and management, encompassing fundamental matters like representation within governance entities and participation in decision-making processes. The United Nations Security Council (UNSC)’s mandate gives it the unique authority to maintain international peace and security. Made up of ten nonpermanent rotating and five permanent Member States (P5), the UNSC gives this decision making power to less than eight percent of the Member States of the UN at a time, five of whom never change. When Haitian President René Préval early in January 2011 lambasted the international community for riding roughshod over his country’s sovereignty and his government, and called for greater Haitian ownership over the aid and recovery effort in his country, he highlighted a frustration which has been noted by so many other nations before: while international aid efforts are welcome and usually do provide critical relief to the targeted populations in the short term, they generally tend to undermine governments (and the faith of the people in their government) over the long term.

On March 11th, 2000, two children who were playing in the neighborhoods of Mitrovica, Kosovo, got hurt by an “unexploded ordnance”. One of them died in the explosion, the other was severely injured. An inquire clarified that the ordnance was a “bomblet”, a part of a cluster bomb dropped during the 1999 NATO air campaign against the Federal Republic of Yugoslavia.

This research generates a method for easy comparison of national military doctrines as they pertain to peacekeeping operations by using the Conceptual Model of Peace Operations (CMPO) as an organizational framework.
