The ASEAN landscape on trade and investment dispute mechanisms has been changing significantly over the last 15 years. Such changes have come about partly due to preparations for establishment of the ASEAN Economic Community (AEC) in 2015. An example is the coming into force on 29 March 2012 of the landmark ASEAN Comprehensive Investment Agreement (ACIA), a region-wide treaty in which ASEAN member States have committed to a number of significant investment obligations and dispute settlement mechanisms. To any criminal law practitioner, the Court’s power to grant probation as a sentencing option is of significant importance. Probation represents, to their clients, the key out of incarceration.Section 5 of the Probation of Offenders Act (Cap 252, 1985 Rev Ed) (“POA”) sets out the power of the Singapore Courts to grant probation. Section 5 uses three peculiar terms to create three categories of offences, namely:1. Sentences which are “fixed by law”; 2. Sentences carrying “specified minimum sentences”; and 3. Hong Kong’s “localists” depict mainlanders as locusts ruining the territory and bringing an end to a vaunted way of life.

In this article, we first discuss anti-mainlander prejudice in Hong Kong and its resemblance to earlier biases by Shanghai people against Chinese from neighboring provinces. We then empirically test claims localists make about the mainlander presence in Hong Kong and show that mainland visitors and migrants are not working the harms attributed to them. There follows a review of “insect language” as integral to racial vilification in several settings, with Hong Kong’s anti-locust movement a recent example. We go on …

After becoming the General Secretary of the CCP and Chairman of the Central Military Commission (CMC) at the 18th Party Congress in November 2012, Xi launched an anti-corruption campaign to eliminate the “tigers and flies” who had become rich through bribery and patronage.

According to Transparency International’s Corruption Perceptions Index (CPI) of 2012, China was ranked 80th among 176 countries with a score of 39/100. China’s performance did not improve significantly in 2013 and dropped significantly from 80th to 100th position in 2014 with a decrease in its score from 40 to 36.

With the advent of reform in Myanmar, Thailand hopes to be able to repatriate the large number of displaced persons from Myanmar. However, a survey shows that most Myanmar displaced persons do not yet have enough confidence about their security after repatriation. This article sets out the conditions and framework under which planning for repatriation should proceed. A human rights approach is needed to protect the rights of refugees. At present, the human rights mechanisms within ASEAN are not strong enough, and ASEAN is reluctant to intervene in controversial bilateral issues. This thesis seeks to augment previous scholarly research on Hindi film song through the presentation of a multivalent approach to thoroughly understanding and interpreting Hindi film song sequences. Temporary contract migrants as a class fall between systems of responsibility: home country, host country, and international community. The systems are separately inadequate and basically uncoordinated, leaving migrants in a precarious situation. The situation of temporary contract migrants is even more precarious as they cross international borders without a path to citizenship or full enfranchisement in the political, economic, and social life of the host country. Where citizenship and residence/employment are divided between multiple countries, the corresponding human rights obligations are similarly divided. This division results in migrant rights falling between different state-based systems of responsibility. Human rights can be …

This report was commissioned by the UK-South-East Asia Knowledge Partnership, an alliance between the British Council and the Foreign and Commonwealth Office to analyse and present the research performance of five South-East Asia countries: Indonesia, Malaysia, Philippines, Thailand, and Vietnam. The bibliometric study undertaken by Elsevier Analytical Services examined each country’s research performance, identifying its strengths, its most prolific or impactful institutions, and its collaborators between 2009 and 2013. The five countries selected have the most prolific scholarly output in the region and are partner countries for the UK’s Newton Fund, excluding Singapore due to its superior research performance.

Failure Of Development Under Neoliberalism: Involution Of Migrant Towns In Thailand, Sustarum Thammaboosadee

This articles demonstrate the unevenness of socioeconomic development under neoliberalism by utilizing the term "neoliberal involution." After Thailand shifted from import-substitution to export-orientation in the 1980s, industries need to achieve competitive low cost of production. In the decades since, an influx of migrant laborers has fulfilled this condition. Research in three different Thai provinces shows that migrant communities are subject to a process dubbed "neoliberal involution." First, migrant laborers are forced to accept high economic risks because of the low political power to negotiate in the labor market. Second, they are victims of social-disintegration in both their host and home …

The political prison camps of North Korea are blatant violations of human rights within the state. They have recently received international attention within the United Nations General Assembly and the United Nations Security Council. This paper examines these political prison camps through Kenneth Waltz’s levels of analysis in order to better understand the existence of these camps.
