Taking the Singapore Court of Appeal’s Decision in RecordTV Pte Ltd v MediaCorp TV Singapore Pte Ltd [2011] 1 SLR 830, this article seeks to argue that the copyright fair dealing defence would have been the more appropriate basis to exempt RecordTV, a digital recording service for recording television programmes, from primary copyright liability. In March 2011, a high profile initial public offering in Singapore involving a business trust raised a staggering US $5.5 billion making this one of the world’s largest initial public offering of the year. This paper surveys the recent literature on inflation forecasting and conducts an extensive empirical analysis on forecasting inflation in Singapore, Japan, South Korea and Hong Kong paying particular attention to whether the inflation-markup theory can help to forecast inflation. We first review the relative performance of different predictors in forecasting h-quarter ahead inflation using single equations. These models include the autoregressive model and bivariate Philips curve models. The predictors are selected from business activity, financial activity, trade activity, labour market, interest rate market, money market, exchange rate market and global commodity market variables. Assessing Urban Environmental Management Practice With A Scalar Approach: The Case Of Shanghai, Wei Tu

Shanghai’s urban environmental management in the past three decades has been focused primarily on the environmental problems at the intra-urban level. While this ‘end of pipe’ approach greatly mitigated domestic and industrial pollution, progresses were much slower in dealing with environmental impacts both at a smaller (i.e., those related to people’s daily activities) scale and at a larger (i.e., those related to inter-urban/regional or global issues) scale. Urban environmental management policies in Shanghai and China should prioritize and address urban environmental impacts at continuous geographic scales to achieve long-term ‘triple bottom line’ sustainability.

Teaching Public Relations To Students With A Confucian Cultural Background, Jurrien Gregor Halff

This paper explores how the Confucian cultural background of students influences their perceptions of and reaction to the dominant public relations curriculum from the ‘West’. Using focus groups of Asian students, three heuristics that affect the students’ affinity to learn public relations are identified. Instructors working with students from a Confucian cultural background are advised to incorporate these heuristics when planning their curriculum.

This article examines the legal framework governing economic relations between the United States and the Association of Southeast Asian Nations (ASEAN) and outlines a roadmap for a US-ASEAN Free Trade Agreement (FTA). Notwithstanding ASEAN’s emerging centrality in Asian regionalism, America remains the only Pacific power that has not concluded any form of FTA with ASEAN.This article explains that limited progress in Washington’s efforts stemmed from the domestic politics of the US Trade and Investment Framework Agreement (TIFA) approach and the Myanmar dilemma. The recent increase in bilateral investment treaties and free trade agreements entered into by Asian states has exposed them to increased commitments to foreign investors and the risk of investor-state arbitration. The rise in such arbitrations elsewhere has led to a considerable body of arbitral case law. This article examines the trend of such increased exposure of Asian states, salient issues that have emerged in arbitration case law and lessons for Asian treaty-makers and their legal advisors.

As late as 2001, Indian outward investment was less than US $1 billion. Instead, India, like all developing countries, was actively courting foreign investment into the country. By 2006, India had reached the tipping point. For the first time, Indian outward investment of US $10 billion had outstripped foreign investment into India. The spending spree continued unabated in 2007. Indian companies arranged or concluded US $21 billion in 40 foreign investment deals in January and February of 2007 alone. Moreover, Indian foreign investment in the financial year closing 31 March 2007 exceeded the cumulative total foreign investment by Indian companies …

Singapore’S Chinatown: Nation Building And Heritage Tourism In A Multiracial City, Brenda S. A. Yeoh, Lily Kong

This paper focuses on the pivotal role played by the state in refashioning the Chinatown landscape as part of both nation-building and heritage tourism projects, and the ensuing cultural politics. After a brief history of the creation of Singapore’s Chinatown, the paper discusses, first, Chinatown’s place in Singapore’s post-independence nation-building project and, second, the reconfiguration of the Chinatown landscape as a tourism asset. The final section reflects on the changing politics of place as Chinatown gains legitimacy in state discourses on heritage, tourism and multiculturalism, as well as in the popular imagination as an ethnic precinct par excellence.

This article explores the attainments of China and India on measures of basic human development as ingredients of a long-term economic development strategy. It proposes that major differences in ideology and state capacity explain in part why India has fallen behind China. The analysis suggests that these relatively hidden political factors play an important role in transforming and advancing human development not only within India and China but also in other developing and emerging economies. Politics in Singapore is generally marked by incremental change. When Singapore eventually becomes a two-party or multi-party democracy, the 2011 general election is likely to be regarded as the starting point of the epochal political transition. It was a boisterous year politically where political excitement and consciousness went up several notches due to the 7 May general elections and the 27 August presidential elections, both of which produced keenly contested hustings and outcomes. The aftermath of the general elections also saw the retirement of former Prime Ministers Lee Kuan Yew and Goh Chok Tong from the Cabinet.

This Article uses the derivative action in Asia as a lens for re-evaluating the foundational theories of Asian and comparative corporate law. It begins by demonstrating that the cultural theory of “Asian non-litigiousness” provides scant explanatory or predictive value for either the evolution or function of the derivative action in Asia’s leading economies. As such, this Article suggests that the theory of Asian non-litigiousness should be relegated to the dustbin of academic history. At the end of 2011, the Singapore High Court in Re David Joseph QC [2011] SGHC 262 (per VK Rajah JA) permitted the admission of an English Queen’s Counsel, David Joseph QC, to represent eight entities of the Astro Group, a Malaysian broadcasting and media entity, in proceedings arising from an arbitration with three subsidiaries of Indonesia’s Lippo Group. Under Singapore’s current statutory scheme, the court may admit QCs on an ad hoc basis if a matter contains issues of fact or law of “sufficient difficulty and complexity”, and if the circumstances of the case warrant it. This study focuses on the uses of Twitter during the elections, examining whether the messages posted online are reflective of the climate of public opinion. Using Twitter data obtained during the official campaign period of the 2011 Singapore General Election, we test the predictive power of tweets in forecasting the election results. In line with some previous studies, we find that during the elections the Twitter sphere represents a rich source of data for gauging public opinion and that the frequency of tweets mentioning names of political parties, political candidates and contested constituencies could be used to make predictions about …

Bong Joon-ho‟s monster movie blockbuster, The Host (Gweomul, 2006), is the most commercially successful film in South Korean cinema history. The film‟s popularity and significance derive from its unearthing of the ambivalence concerning South Korea‟s rapid transformation from a rural dictatorship to an urban democracy with one of the strongest economies on the planet. This ambivalence is buried beneath a veneer of "progress" blanketing contemporary South Korea and constitutes a condition I call inverted exile.
