In Nagase Singapore Pte Ltd v Ching Kai Huat and Lim Leong Huat v Chip Hup Hup Kee Construction Pte Ltd, the High Court of Singapore affirmed the proposition that a company may, like a natural person, conspire with its director to inflict harm on a third person even if the latter is its “directing mind and will”. In both cases, the courts’ focus was directed at a conceptual enquiry, ie, whether a company, whose “mind” is the same as that of its director, could properly be said to have “combined” or “agreed” to conspire. Ask any student at the Singapore Management University (SMU) to name one of the most practical and useful courses offered by the university. The answer would inevitably include CAT. CAT stands for the "Computer as an Analysis Tool" course. Originally based on a course of the same title offered by the Wharton Business School, the focus of CAT was shifted to provide business students the essential practical skills and necessary "real-world" exposure to better use personal computers for resolving business problems. The course is basically centered on using the Excel spreadsheet to work on ambiguous ill-defined problems.

This study addresses the extent of change and regional differences in gender roles in the Vietnamese family based on innovative surveys in northern and southern Vietnam. The similarities and differences in political, economic, and social histories between northern and southern Vietnam provide a compelling setting to investigate the impact of socialist policies and the recent shift from a centrally planned to a market economy on gender stratification in the domestic spheres. We assess determinants of the gender division of household labor among three marriage cohorts that underwent early marital years during 1) the Vietnam War and mass mobilization, 2) nationwide …

A matrimonial order of divorce, nullity or legal separation is often followed by ancillary orders relating to division of matrimonial property, custody of children and maintenance. Under Singapore law, many of the court’s powers in respect of these types of orders depend on the court having jurisdiction to pronounce on the status of the marriage. If an order made by a foreign court is recognised to have annulled or dissolved the marriage, then it is not possible for the Singapore court to assume jurisdiction in respect of the marriage; there is no marriage to speak of anymore. Taiwan, classified as an “unrecognized state” or an “entity sui generis” by most international law scholars, has been excluded from most major international organizations and agreements for decades. This diplomatic isolation has had a negative influence on the protection of Taiwan’s overseas investments. This Article explores the six bilateral investment treaties (“BITs”) that the Taiwanese government has reached with the Association of Southeast Asian Nations (“ASEAN”) States and compares the weaknesses of the Taiwanese agreements with the investment frameworks established within ASEAN States. In Imbree v. McNeilly, the High Court of Australia ruled that a learner driver is no longer to be held to the standard of a reasonable but unqualified (and inexperienced) driver in negligence claims. It is the modest aim of this case note to show that Imbree, while a decision on a narrow point, in fact hints at a larger difficulty in the ascertainment of the standard of care in individual cases. The focus of Singapore's response to terrorism post 9/11 has been to reach out to the “moderate, mainstream” Muslims as a bulwark against societal implosion. This article examines the broad-based endeavor toward “religious moderation.” While coercive draconian legislation remain the mainstay against extremists and radicals, the mobilization of soft law, aspirational norms, and values are consciously woven into the state's endeavors to enhance society's resilience and cohesion. They also seek to regulate religious conduct at a time when the state wishes to entrench secularism as a cornerstone of the governance of a multi-racial, multireligious society. This paper considers how a regional currency basket and the associated divergence indicators could be used in official surveillance. Recently, proponents of Asian currency baskets have referred to the role the ECU played in constructing exchange rate divergence indicators in Europe as evidence of the intrinsic usefulness of currency baskets for exchange rate monitoring. We show in this paper a number of problems with the use of regional currency-basket based divergence indicators. First, at a technical level, such indicators involve tracking regional exchange rates against a moving currency basket and can obscure underlying movements in bilateral exchange rates. Previous studies show that in contrast to evidence that share issue privatization (SIP) in most other countries have improved firm profitability, China's SIP of the 1990s had no such effect. We argue that the main reason for the failure of China's SIP is likely to have been the weak institutional environment in place at that time. We examine China's SIP in a more recent period in which the institutional environment was greatly improved. Using a matching sample method, we find that SIP firms continued to experience negative post-SIP profitability changes in our sample period. However, their performance decline was significantly …

The purpose of this study was to investigate how salespeople's renqing orientation and self-esteem jointly affect their selling behavior. Data were obtained from a survey of salespeople from 17 pharmaceutical and consumer-goods companies in Taiwan (n = 216).Salespeople's renqing orientation (i.e., their propensity to adhere to the accepted norm of reciprocity) compensates the negative effect of self-esteem on their selling behaviors, such as adaptive selling and hard work. Our study results underscore the critical role of the character trait of renqing orientation in a culture emphasizing a norm of reciprocity. Therefore, it would be useful to consider a strategy of …

Using a GARCH (1,1) model, this paper compares the extent to which financial sector liberalization in Singapore and Malaysia each has led to integration of its domestic equity market with external markets. The results show that the level of integration of the domestic markets with the external markets is higher when MSCI regional and global data are used, as compared to when individual country data are used to proxy regional and global markets. Singapore and Hong Kong share many similarities in their growth experiences and challenges. Both were traditionally entrepot economies and service hubs for their hinterlands – China for Hong Kong, and the Association of Southeast Asian Nations (ASEAN), in general but Malaysia and Indonesia in particular, in the case of Singapore. The two economies have gone through major structural changes over the years in response to changes in the global economy and in their relationships with their respective hinterlands. The changing relationships with their hinterlands play a crucial role in driving their external economic policies.

The non profit landscape in Singapore is large and diverse, consisting of more than 1,800 registered charities and more than 500 approved Institutions of a Public Character (IPCs). These organisations vary in size from less than $100,000 in annual receipts to those with over $10 million in receipts. They also operate in over 10 sectors ranging from religion to education to sports. While Western companies struggle with mergers and acquisitions, emerging giants like Indian aluminum producer Hindalco are using M&A as their main globalization strategy. That's partly because developing economies grew at near double-digit rates in the past 15 years, enabling many enterprises to make acquisitions. Until recently, Vietnam had the highest abortion rate in Asia. Abortion–mostly provided by the government—is believed to have contributed significantly to the country’s remarkable fertility decline over the last three decades. Despite the overall fertility decline, fertility rates vary across Vietnam’s 54 ethnic groups. The majority Vietnamese and ethnic Chinese, who together account for 85% of Vietnam’s total population, have total fertility rates below the replacement level. Meanwhile, other ethnic minority groups such as Dao and Hmong, who are disproportionately poor and live in remote, isolated areas, have the total fertility of 3.6 and 7.1 respectively. Guanxi Versus Networking: Distinctive Configurations Of Affect- And Cognition-Based Trust In The Networks Of Chinese And American Managers, Roy Y. J. Chua, Michael W. Morris, Paul Ingram

This research investigates hypotheses about differences between Chinese and American managers in the configuration of trusting relationships within their professional networks. Consistent with hypotheses about Chinese familial collectivism, an egocentric network survey found that affect- and cognition-based trust were more intertwined for Chinese than for American managers. In addition, the effect of economic exchange on affect-based trust was more positive for Chinese than for Americans, whereas the effect of friendship was more positive for Americans than for Chinese. Finally, the extent to which a given relationship was highly embedded in ties to third parties increased cognition-based trust for Chinese but …

Both are rapidly learning through outsourcing with multinational enterprises (MNEs) from advanced nations, yet their paths to this dynamic sector are very different. How does the EU deal with incoherence and coherence? In this paper we try to answer this research question in order to draw conclusions on the specific nature of the EU as a foreign policy actor. We define coherence and incoherence in EU foreign policy as our dependent variable in a first step.
