Managing The Risks Of Corporate Fraud: The Evidence From Hong Kong And Singapore, Wai Yee Wan, Christopher C. H. Chen, Chongwu Xia, Say Goo

Research Collection Yong Pung How School Of Law

Since the Asian financialcrisis of 1997, Hong Kong and Singapore have implemented reforms that promote independenceand monitoring competency of the boards of directors of their listed companies. However, with the advent of the financial crisis of 2007/2008, a wave of fraudcases prompts the question as to the effectiveness of these reforms. Analysing asample of 62 listed companies which are found to have committed fraud between2007 and 2014, and comparing against a matched sample of no-fraud companies, wefind that the fraud companies tend to either combine the roles of chairman andchief executive officer (or they are close family members) and have fewer …

What Does It Take To Become A Partner At A Big 4 Accounting Firm? Insights From Singapore’S Experience, Gary Pan, Poh Sun Seow, Yang Hoong Pang, Kwong Sin Leong

Research Collection School Of Accountancy

Due to the shift in partner’s identity, there have been growing interests in understanding characteristics, skills and behaviours of accounting partners. Given that Big 4 Accounting firms are supposedly international accounting firms that are organized in similar structures, an interesting question of whether the same partner qualities can be applied in the Big 4 accounting firms for a non-western context such as Asia. As far as we know, no such study has been conducted in an Asian context. We argue this could be of great interest to the Big 4 Accounting firms as Asia is one of their fastest growing …

Long-Term Care Needs In The Context Of Poverty And Population Aging: The Case Of Older Persons In Myanmar, Bussarawan Teerawichitchainan, John Knodel Jun 2018

Long-Term Care Needs In The Context Of Poverty And Population Aging: The Case Of Older Persons In Myanmar, Bussarawan Teerawichitchainan, John Knodel

Research Collection School of Social Sciences

Myanmar is one of the poorest and least healthy countries in Southeast Asia. As elsewhere in the region, population aging is occurring. Yet the government welfare and health systems have done little to address the long-term care (LTC) needs of the increasing number of older persons thus leaving families to cope on their own. Our study, based on the 2012 Myanmar Aging Survey, documents the LTC needs of persons aged 60 and older and how they are met within the context of the family. Nearly 40% of persons in their early 60s and 90% of those 80 and older reported …

How Strong Is Public Support For The Death Penalty In Singapore?, Wing-Cheong Chan, Ern Ser Tan, Jack Tsen-Ta Lee, Braema Mathi Jun 2018

How Strong Is Public Support For The Death Penalty In Singapore?, Wing-Cheong Chan, Ern Ser Tan, Jack Tsen-Ta Lee, Braema Mathi

Research Collection Yong Pung How School Of Law

Singapore is well known internationally for its uncompromising stance towards law and order and its use of the death penalty in particular for murder and drug trafficking. Until 2012, it was one of the few countries in the world where the death penalty was mandatory for persons convicted of these two crimes. The law was amended in 2012 to give a judge the choice to impose the death penalty or life imprisonment (with caning) for non-intentional murder and drug trafficking in some situations. What do Singaporeans think of the use of the death penalty in their own country? This article …

Digital Or Trade? The Contrasting Approaches Of China And Us To Digital Trade, Henry S. Gao Jun 2018

Digital Or Trade? The Contrasting Approaches Of China And Us To Digital Trade, Henry S. Gao

Research Collection Yong Pung How School Of Law

With the growing importance of the internet, digital trade, or electronic commerce, has become a key issue in international trade regulation. As the home to some of the largest internet companies in the world, the United States took the lead in bringing the issue into the WTO and has been the leading proponent on the issue. In contrast, the developing countries were quite sceptical and reluctant to engage on discussions on the issue. Recently, however, several developing countries has changed their positions and become more active participants. Chief among them is China, which has raised some interesting proposals both within …

The Indian Evidence Act And Recent Formulations Of The Exclusionary Discretion In Singapore: Not Quite Different Rivers Into The Same Sea, Siyuan Chen, Eunice Chua Jun 2018

The Indian Evidence Act And Recent Formulations Of The Exclusionary Discretion In Singapore: Not Quite Different Rivers Into The Same Sea, Siyuan Chen, Eunice Chua

Research Collection Yong Pung How School Of Law

Sir James Fitzjames Stephen’s Indian Evidence Act of 1872 continues to govern the law of evidence in almost a dozen common law jurisdictions today. But the fundamental features of the IEA would undoubtedly be considered anomalous when viewed against modern notions of relevance and admissibility, foremost of which are the fact that the statute represents an attempt to codify relevance exhaustively in an inclusionary, rather than exclusionary way, and the judicial discretion to exclude relevant evidence finds no obvious expression in any of its provisions. The IEA has thus had a strained relationship with the common law, especially since judicial …

Divergence, Convergence Or Crossvergence Of Chinese And Us Approaches To Regional Integration: Evolving Trajectories And Their Implications, Heng Wang Jun 2018

Divergence, Convergence Or Crossvergence Of Chinese And Us Approaches To Regional Integration: Evolving Trajectories And Their Implications, Heng Wang

Research Collection Yong Pung How School Of Law

Trends in Chinese and U.S. approaches to regional integration are likely to profoundly affect other states and even the future of global economic governance. Showing a possible paradigm shift, the Belt and Road Initiative (BRI) and North American Free Trade Agreement (NAFTA) renegotiation reflect the latest major developments in China and the U.S. regarding regional integration. In particular, the U.S. pursues managed trade, shifts to bilateralism, and adopts an aggressive approach. This article analyses a core question: will Chinese and U.S. trade approaches converge, diverge or both, and why? For the analysis of the convergence or divergence, four aspects will …

Global Reform Of Investor-State Arbitration: A Tentative Roadmap Of China’S Emergent Equilibrium, Mark Mclaughlin Jun 2018

Global Reform Of Investor-State Arbitration: A Tentative Roadmap Of China’S Emergent Equilibrium, Mark Mclaughlin

Research Collection Yong Pung How School Of Law

Investor-State arbitration is in a state of flux. In recent years, doubts about its adequacy have become apparent: questions of coherence, consistency, legitimacy, and utility have rendered fragile the central place of investor-State arbitration in global foreign direct investment (FDI) governance. Three threads of reform have been advanced as a corrective to these deficiencies, encompassing incremental reform, institutional reform, and fundamental reform. China is perhaps the most influential nation not to have declared a preference for one future or another. For over a decade, the Chinese approach to investor-State arbitration has been in a state of disequilibrium: bilateral investment treaties …

Mareva Injunctions Under Singapore Law, Adeline Chong Jun 2018

Mareva Injunctions Under Singapore Law, Adeline Chong

Research Collection Yong Pung How School Of Law

Whether the Singapore court has the jurisdiction or power to grant a Mareva injunction in aid of foreign court proceedings was recently considered by the Singapore High Court in PT Gunung Madu Plantations v Muhammad Jimmy Goh Mashun [2018] SGHC 64. Both plaintiff and defendant were Indonesian and the claim related to alleged breaches of duties which the defendant owed to the plaintiff. The plaintiff had obtained leave to serve the writ in Indonesia on the defendant. The defendant thereupon applied, inter alia, to set aside service of the writ and for a declaration that the court has no jurisdiction …

"Rule Of Trust": The Power And Perils Of China's Social Credit Megaproject, Yu-Jie Chen, Ching-Fu Lin, Han-Wei Liu

Research Collection Yong Pung How School Of Law

Emerging as a comprehensive and aggressive governance scheme in China, the “Social Credit System” (SCS) seeks to promote the norms of “trust” in the Chinese society by rewarding behavior that is considered “trust-keeping” and punishing those considered “trust-breaking.” This Article closely examines the evolving SCS regime and corrects myths and misunderstandings popularized in the international media. We identify four key mechanisms of the SCS, i.e., information gathering, information sharing, labeling, and joint sanctions, and highlight their unique characteristics as well as normative implications. In our view, the new governance mode underlying the SCS—what we call the “rule of trust”—relies on …

How May China Respond To The U.S. Trade Approach? Retaliatory, Inclusive And Regulatory Responses, Heng Wang Jun 2018

How May China Respond To The U.S. Trade Approach? Retaliatory, Inclusive And Regulatory Responses, Heng Wang

Research Collection Yong Pung How School Of Law

This paper endeavours to conceptualize and provide an analytical framework for China’s response to U.S. trade policy. It analyses the following questions: what is the new U.S. trade approach? How might China respond to the United States’ trade approach? What are the trend and implications of China’s response to the U.S. trade approach? It argues, first, that the U.S. trade approach has not changed regarding most of the U.S.-style regulatory disciplines. However, it has changed in terms of the shift toward managed trade, unilateralism and trade enforcement. Second, China will likely adopt a three-track approach: consisting of retaliatory, inclusive and …

Policy Innovations For Affordable Housing In Singapore: From Colony To Global City, Sock Yong Phang Jun 2018

Policy Innovations For Affordable Housing In Singapore: From Colony To Global City, Sock Yong Phang

Research Collection School Of Economics

Global cities today are facing fundamental challenges in relation to unaffordable housing and growing economic inequality. Singapore’s success in making home ownership possible for 90% of its population has attracted much attention internationally. This book represents a culmination of research by the author on key housing policy innovations for affordable housing. Housing policy changes were effected in the 1960s through reforms of colonial legislation and institutions dealing with state land acquisition, public housing, and provident fund savings. The comprehensive housing framework that was established enabled the massive resettlement of households from shophouses, slums and villages to high-rise government-built flats. In …

Trans-Boundary Variations Of Urban Drought Vulnerability And Its Impact On Water Resource Management In Singapore And Johor, Malaysia, Joon Chuah, Beatrice H. Ho, Winston T. L. Chow Jun 2018

Trans-Boundary Variations Of Urban Drought Vulnerability And Its Impact On Water Resource Management In Singapore And Johor, Malaysia, Joon Chuah, Beatrice H. Ho, Winston T. L. Chow

Research Collection School of Social Sciences

Low-latitude areas generally experience relatively large precipitation totals, but droughts/dry spells do occur periodically and are potentially hazardous in these regions - especially within rapidly developing urban settlements. These areas typically have high water demand and therefore may potentially be subjected to water scarcity. Effective local water resource management lowering risks and vulnerabilities to drought is thus paramount, and these policies may be affected in regions with national borders sharing a common transboundary water resource. In this study, we (a) quantify and identify drought episodes using the Palmer Drought Severity Index in the neighbouring equatorial regions of Singapore and Johor, …

Inherent Multiculturalism: An Ancient Chinese Practice Becomes A Part Of The Indonesian Everyday, Margaret Chan May 2018

Inherent Multiculturalism: An Ancient Chinese Practice Becomes A Part Of The Indonesian Everyday, Margaret Chan

Research Collection School of Social Sciences

Several methods are used to trace cultural transfer between countries. The time-honoured methods are chronicles of early travellers and archaeology. We can also look to epigraphs and loan words. Present-day ethnic communities also suggest earlier settlements. Edward B. Tylor proposed the world distribution of games as anthropological evidence. Tylor's method combined with an archaeology into the Everyday provides evidence of earlier cultural transfer and present-day applications of the game enables analysis to draw socio-cultural knowledge of inter-ethnic, inter-cultural reception to foreign influences in host societies.

Navigating The Singapore’S Private International Rules In The Age Of Innovative Cross-Border Commercial Litigation Framework, Man Yip May 2018

Navigating The Singapore’S Private International Rules In The Age Of Innovative Cross-Border Commercial Litigation Framework, Man Yip

Research Collection Yong Pung How School Of Law

In the last decade, Singapore has been consistently working on consolidating its position as a leading dispute resolution hub in Asia. China’s One Belt One Road (OBOR) initiative affords, in principle, an invaluable opportunity for Singapore to foster its role in dispute resolution services. Conversely, the success of the OBOR is in part dependent upon the availability of reliable and efficient dispute resolution mechanisms to handle commercial disputes that will invariably arise. Singapore looks poised to contribute to the success of the OBOR in that respect, in light of its mature and business-friendly legal system.

Coincidentally, China announced its OBOR …

Building A Smart Nation: Singapore’S Digital Journey, Siu Loon Hoe

Research Collection School Of Computing and Information Systems

The journey towards smart city status is a strong global trend as governments around the world strive to harness technology to improve the quality of life for their citizens (United Nations, 2016). The widespread phenomenon of becoming “smart” is a key topic of discussion and research that continues to change as new digital technologies develop (Ishkineeva et al., 2015). The smart cities theme is important because it explores how governments, as providers of public goods, harness digital technologies to improve the lives of citizens around the world in the present and the future.

Understanding The Effects Of Taxi Ride-Sharing: A Case Study Of Singapore, Yazhe Wang, Baihua Zheng, Ee Peng Lim May 2018

Understanding The Effects Of Taxi Ride-Sharing: A Case Study Of Singapore, Yazhe Wang, Baihua Zheng, Ee Peng Lim

Research Collection School Of Computing and Information Systems

This paper studies the effects of ride-sharing among those calling on taxis in Singapore for similar origin and destination pairs at nearly the same time of day. It proposes a simple yet practical framework for taxi ride-sharing and scheduling, to reduce waiting times and travel times during peak demand periods. The solution method helps taxi users save money while helping taxi drivers serve multiple requests per day, thus increasing their earnings. A comprehensive simulation study is conducted, based on real taxi booking data for the city of Singapore, to evaluate the effect of various factors of the ride-sharing practice, e.g., …

Unpacking Public Sentiment Toward The Government: How Citizens’ Perceptions Of Government Communication Strategies Impact Public Engagement, Cynicism, And Communication Behaviors In South Korea, Soojin Kim, Arunima Krishna

Research Collection Lee Kong Chian School Of Business

In this study, we explore the relationship between two types of public sentiment toward the government (i.e., public engagement and cynicism) on publics’ information transmission behaviors, i.e., megaphoning, about the government. In doing so, we unpack how citizens’ perceptions of the communication strategy adopted by the government, as well perceived authenticity of the government’s communication impact their sentiments toward the government. An online survey was conducted in South Korea (N = 1112) to understand these relationships. The results revealed that perceived use of bridging strategy by the government is associated with public engagement, and perceived use of the buffering strategy …

The Effect Of Non-Contributory Pensions On Labour Supply And Private Income Transfers: Evidence From Singapore, Yanying Chen, Yi Jin Tan May 2018

The Effect Of Non-Contributory Pensions On Labour Supply And Private Income Transfers: Evidence From Singapore, Yanying Chen, Yi Jin Tan

Research Collection School Of Economics

Non-contributory pensions are becoming increasingly prevalent worldwide. As their effects are likely to be context-dependent, evaluating their effects in a wide range of settings is important for establishing the external validity of the non-contributory pension literature. We use a new monthly panel dataset and a difference-in-differences strategy to study the effect of a new non-contributory pension in Singapore (the Silver Support Scheme or SSS) on labour supply, work expectations, private cash transfers, and expenditure, 1 year after its implementation. We find no evidence that receiving SSS payouts led to a fall in labour supply, work expectations, or the receipt of …
