The research study investigated student perceptions and utilization of Title IX services on U.S. university and college campuses, testing the hypothesis that if students hold negative perceptions of Title IX offices, then they will not report campus sexual violence they experience to Title IX offices. There are currently high rates of sexual violence on college campuses but very low rates of reporting. Current or former U.S. college students aged 18-30 (N = 47) completed a mixed methods anonymous survey composed of Likert scale and open response questions. Some topics include media coverage for women and how women are portrayed in the media, the gender pay gap, Title IX, women referees and women in higher positions in professional sports. I surveyed alumni and women's lacrosse players at the Division 1 and 3 level to gain a better perspective of the state of the sport industry currently.

Title IX of the Education Amendments of 1972 (Title IX) prohibits discrimination on the basis of sex in federally funded education programs or activities. Since its enactment, Title IX has dramatically increased interscholastic and intercollegiate athletic opportunities for women and girls. Despite indisputable progress since Title IX’s enactment, particularly for female athletes, many high schools and universities still fail to offer equal athletic opportunities for members of both sexes. Examining Incidents Of Sexual Misconduct Reported To Title Ix Coordinators: Results From New York’S Institutions Of Higher Education, Tara Richards, Taylor Claxton, Lane Kirkland Gillespie

A paucity of studies has examined incidents of sexual misconduct reported to Title IX coordinators at institutions of higher education (IHEs) or examined differences across types of IHEs. We used 2018 data from incidents of sexual misconduct (N = 3,829) reported to Title IX coordinators at IHEs in New York (N = 209) to examine the context, processes, and outcomes of reported incidents. Findings show that most incidents reported to Title IX coordinators did not prompt the IHE’s conduct process; “other” disciplinary sanctions were the favored response for responsible students, while suspensions and/or expulsions were rarely used. On May 6th, 2020, after extensive public comment and review, the Department of Education published the final rule for the new Title IX regulations, which took effect in schools on August 14th. Title IX is the nearly fifty year old piece of the Education Amendments that prohibits sexual discrimination in federally funded schools. The Ncaa's Breaking Point For Equal Opportunity: A Title Ix Perspective On Name, Image, And Likeness Sponsorship Legislation, Joshua C. Sorbe

This paper analyzes the efficacy of Title IX when considering national name, image, and likeness (NIL) legislation and NCAA Division I athletic department expenditure behavior. To answer this question, I analyzed Title IX’s legislative history, current compliance rules, recent litigation, and academic literature. Using publicly-available data reported to the US Department of Education, I performed regression analysis on institutional characteristics and expenditure behaviors to assess the impact that spending behavior has on gender equity. My results show that revenue-generating sports had a large impact on spending equity, and disparities in expenditures are more distinct than participation. Ultimately, the market-based exceptions …

Inappropriate comments, behavior, or acts engaged in by faculty members have resulted in sexual harassment complaints being filed by students, and in some cases resulted in costly litigation and settlements for some colleges and universities. In the recent news, public figures like actor Bill Cosby and Hollywood director Harvey Weinstein have been openly accused of sexual harassment and/or rape. This article elaborates on and critiques the law’s separation of pregnancy, with rights grounded in sex equality under Title IX, from reproductive control, which the law treats as a matter of privacy, a species of liberty under the due process clause. While pregnancy is the subject of Title IX protection, reproductive control is parceled off into a separate legal framework grounded in privacy, rather than recognized as a matter that directly implicates educational equality. The law’s division between educational equality and liberty in two non-intersecting sets of legal rights has done no favors to the reproductive rights movement either. By …

Help seeking after an experience of campus sexual assault is an important link for many survivors towards processing and healing. College campuses have a plethora of resources available, from free counseling, health clinics, advocates, and reporting options all right on their doorstep. Yet many students do not seek help from these offices. This study sought to find out why by looking beyond the victim, and examining the relationship between Title IX policy, professionals who provide resources, and victims. Since the late 20th century, the federal government has regulated colleges’ and universities’ handling of campus sexual and gender-based violence (CSGBV). Although the arc of history has bent toward establishing greater protections for victims of such violence, new proposed regulation by the U.S. Department of Education under the Trump administration focuses more heavily on ensuring due process rights for students accused of CSGBV. This thesis examines the impacts of Title IX compliance on salary gap of Division I Football Bowl Series and Football Championship Series universities male and female associate professors. Title IX athletic proportionality requirements have been established since the 1980’s and require that each university have an equal percentage of female student athletes as they do female undergraduates. It discusses the role of the Title IX of the Education Amendments of 1972 along with a Dear Colleague Letter enacted by the United States’ federal government to all public institutions regarding how to respond when complaints and allegations of sexual violence are made. Sexual Assault Campus Climate Surveys: Insights From The First Wave, Kristen M. Budd, Alana Van Gundy, Rose Marie Ward, Glenn W. Muschert

Dignity: A Journal of Analysis of Exploitation and Violence

One tool to help institutions of higher education (IHEs) to address campus sexual assault is the campus climate survey (CCS); yet little is known about the CCS implementation process. This study used a mixed methods approach to examine the implementation process of CCSs deployed during the 2015/16 academic year at 244 IHEs throughout the United States. Quantitative results indicate CCSs were designed primarily by the Title IX officer and campus administration; assessed victimization rates and knowledge about campus resources; and were voluntary. Qualitative findings generate concerns surrounding generalizability, participation rates, validity of data, and suggestions for improvement for future CCSs.

No Evidence Of “Weaponized Title Ix” Here: An Empirical Assessment Of Sexual Misconduct Reporting, Case Processing, And Outcomes, Tara N. Richards

Little is known about actual incidents of gender-based violence reported by college students or the campus adjudication process or outcomes of reported cases. Data from Annual Security Reports (ASRs) and Title IX Coordinators was used to examine the context, processes, and outcomes of reported incidents of sexual misconduct (n=1,054) at Institutions of Higher Education (IHEs) in a Mid-Atlantic state. Results showed that ASRs undercounted incidents of sexual misconduct. Few incidents reported to Title IX Coordinators resulted in a formal Title IX complaint, and fewer still resulted in a finding of responsibility or suspension/expulsion of the responsible student.
