Representation in literature, popular culture, and media has been shown to influence identity development and belonging as exemplified in the enduring hashtag #RepresentationMatters. However, mixed race representation on television has received little attention in research and scholarship. Hence, this essay examines how multiracial characters are portrayed in coming of age and young adult storylines from four TV series (All American, Charmed, Trinkets, and Dear White Peoples) representing two different networks (Netflix and The CW). This essay advances the concept of the “rhetorical interlude,” a means by which scholars and teachers may examine how rhetorical messages are embedded in films. To illustrate, this study includes an examination of the rhetorical interlude in the film Gravity (Cuarón, 2013) as the film’s protagonist, Ryan Stone, is visited by the apparition of her dead colleague, Matt Kowalski, who instructs her on survival in space and on the significance of moving on from personal tragedy. In a pattern of ghostly apparitions appearing in perplexing outer space situations, Gravity situates scientific complexity as capable of being transcended with the help …

Accommodating Incompetency In Immigration Court, Elizabeth Jordan

In criminal law, an individual must be deemed competent to stand trial, yet our immigration courts routinely order the deportation of incompetent noncitizens. A removal proceeding against a noncitizen—where an outcome of deportation often risks life-threatening harm—continues apace even if the noncitizen has been deemed incompetent by the immigration judge. In place of halting proceedings, the immigration judge imposes “safeguards” pursuant to a provision of the immigration code that neither defines nor explains the term. In practice, judges’ application of the term “safeguards” is often absurd. The implications of continuing a proceeding against a noncitizen with a disability affecting competency …

Countless pages have been devoted to the question of why everyone should pay tax, yet its opposite has gone largely unnoticed: why should some people and organizations not pay tax? Our tax system exempts from ordinary income taxation a wide and diverse array of people and organizations engaged in significant economic activity—from parents providing childcare services for their family to consular activities and charities operating animal shelters—seemingly without a convincing explanation. Perhaps because of the dizzying diversity of tax-exempt activities, scholars and policymakers have avoided comprehensively or coherently justifying our exemption regimes.

"Legally Magic" Words: An Empirical Study Of The Accessibility Of Fifth Amendment Rights, Roseanna Sommers, Kate Weisburd

Northwestern University Law Review

Fifth Amendment case law (including Miranda v. Arizona) requires that individuals assert their right to counsel or silence using “explicit,” “clear,” and “unambiguous” statements—or, as some dissenting judges have lamented, using “legally magic” words. Through a survey of 1,718 members of the U.S. public, we investigate what ordinary people believe it takes to assert the right to counsel and the right to silence. We then compare their perceptions against prevailing legal standards governing invocation.

With respect to the right to counsel, the survey results indicate that members of the public have a uniformly lower threshold for invocation than do …

Counseling, Leadership, and Research Methods Faculty Publications and Presentations

The news is an efficient way to share information and plays an important role in shaping and reflecting cultural values and norms. However, research examining news consumption and abortion attitudes is limited. In this exploratory study, we analyzed data from a nationally representative sample of 886 US adults to assess whether self-reported frequency of news consumption—by news format (e.g., television, radio, newspaper, social media), news leaning (i.e., liberal, neutral, conservative), and total sum (i.e., total amount of consumption across leanings)—predicted abortion attitudes and complexity in attitudes. We conducted Poisson and negative binomial regression analyses controlling for demographic variables. We found …

This Note seeks to shed light on the life-threatening danger of extreme heat in un-air-conditioned Texas prisons. The Prison Litigation Reform Act (PLRA) starkly limits the relief available to those suffering and dying in these prisons. This Note proposes an amendment to the legislation that could create a path toward lasting relief for incarcerated people. After analyzing the effects of increasing heat on the particularly vulnerable prison population, this Note analyzes how the Supreme Court and the Fifth Circuit have handled claims alleging constitutionally violative prison conditions under the Eighth Amendment—in short, ineffectively, if at all. The Sixth Amendment of the U.S. Constitution guarantees criminal defendants “the right to a speedy and public trial by an impartial jury of the State.” Voir dire, the procedure during which the prosecution and the defense may challenge prospective jurors for cause or exercise peremptory challenges, purports to uphold this right. When the prosecution has access to cellular geolocation data on prospective jurors that the defense lacks, however, it may jeopardize the defendant’s Sixth Amendment rights.

Background: Prostate cancer is the most diagnosed cancer in Black/African American men (AA) and the second‑leading cause of cancer-related deaths. A prostate-specific antigen (PSA) blood test is an early detection screening tool for prostate cancer, but uptake of PSA screening remains low among AA men. Greater PSA screening rates among AA men, coupled with earlier treatment, may reduce disparities in prostate cancer outcomes, including mortality. The current pilot study will test the first-of-its-kind mobile health (mHealth) app to improve prostate cancer knowledge and increase PSA screening uptake among AA men using home-based screening methods. Mental illness is common and can affect anyone. Each year the University welcomes students with Mental Health Issues. One in four adults in the US will experience a mental illness in their lifetime, however according to a NUS survey, eight out of ten students will experience a mental illness while in higher education. For some student’s mental illness can be a lifelong disability. Others can experience short term issues that emerge around difficult or stressful life events, while some students may be more at risk of experiencing mental illness in relation to their ethnicity, gender, sexuality or socio-economic background. Popular culture curricula integration provides educational benefits for students (Morrell, 2002; Petrone, 2013); bridging students’ out-of-school popular culture knowledge with their in-school literacies promotes learning, engages students, and values students’ background knowledge (Dyson, 1993, 2021; Marsh, 2006; Morrell, 2002; Petrone, 2013). This article explores the relationship between games and pedagogy through the example of the roleplaying game Fiasco!. Fiasco! is a part of a growing genre of collaborative roleplaying games (RPGs) that have important applications in the university classroom. Fiasco! is an innovative game system that upends the traditional model of Game Master-led RPGs to create a collaborative environment for players to create their own stories. This paper explores how the unique model embedded within Fiasco! can be employed as a pedagogical tool for active student-led learning.

The convergence of politics and comedy within political entertainment has created a new environment, dissemination of information, and formation of public opinion. In response to white nationalist rallies, comedian Tina Fey utilized her political comedy platform to satirically comment on the inaction of several privileged consumers. Community response to the satirical skit reflected the complexity of satire as rhetorical strategy, notably when present online and within popular culture discourse, and the cognitive demands that result in fallacious tendencies. The following examines the fallacies that arise in response to Fey’s satirical message and the implications for political entertainment media.

Conspiracy theories are once again a topic of heated debate in both popular and scholarly media. Critics on one side of this debate often take for granted an “underlying assumption that conspiracy theories should be subdued if not eliminated” (Uscinski 444). Other scholars have expressed concern over the ways the “conspiracy theorist” pejorative stifles dissent and regulates political rationality (Rankin; deHaven-Smith). Bratich argues that social anxieties about issues like emerging technology and race “get managed” through the public debate about conspiracy theories as an “object of concern” (160–61). Virtual reality (VR) is a fast-evolving technology rapidly being integrated into education and training in multiple sectors of society. As the use of VR spreads, it is important to critically analyze both its role in effective pedagogies and how students experience it.
