การศึกษาเรื่อง การศึกษาการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย มีวัตถุประสงค์เพื่อศึกษารูปแบบการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ศึกษาการบังคับใช้กฎหมาย ปัญหาและอุปสรรคที่เกิดจากการบังคับใช้กฎหมาย ตลอดจนแสวงหาข้อเสนอแนะต่อการป้องกันและปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยโดยใช้วิธีการในการดำเนินการวิจัย คือ การวิจัยเชิงคุณภาพด้วยการศึกษาค้นคว้าจากเอกสาร และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 13 คน ประกอบด้วยพนักงานศุลกากร เจ้าพนักงานตำรวจ พนักงานสอบสวนคดีพิเศษ พนักงานอัยการ เจ้าหน้าที่กรมควบคุมมลพิษ ผู้แทนองค์กรพัฒนาเอกชนด้านสิ่งแวดล้อม และผู้เชี่ยวชาญด้านกฎหมายสิ่งแวดล้อม ผลการศึกษาพบว่า รูปแบบของการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยที่พบมากที่สุด คือ การนำเข้าเศษพลาสติก ด้วยการขนส่งทางเรือโดยบรรจุของเสียในตู้สินค้า ซึ่งมีประเทศต้นทางที่สำคัญ คือ ประเทศสหรัฐอเมริกา โดยผู้กระทำผิดใช้วิธีการฉ้อฉลทางเอกสารเป็นหลัก และเป็นการกระทำโดยองค์กรอาชญากรรมข้ามชาติ ในขณะที่หน่วยงานบังคับใช้กฎหมายก็เผชิญกับปัญหาและอุปสรรคในการบังคับใช้กฎหมาย อาทิเช่น ปัญหาช่องว่างของกฎหมายในเรื่องหลักเกณฑ์การเปรียบเทียบงดการฟ้องร้องตามกฎหมายศุลกากร เป็นต้น อันนำมาสู่ข้อเสนอแนะเชิงนโยบายในการงดการเปรียบเทียบงดการฟ้องร้องเพื่อดำเนินคดีผู้กระทำผิดในชั้นศาล การนำพระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 มาใช้ในการปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ตลอดจนการจัดการกับของเสียที่เป็นของกลางและของตกค้างด้วยการส่งกลับต้นทาง เป็นต้น

การวิจัยนี้ มีวัตถุประสงค์ในการนำเสนอขั้นตอนของกระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย กฎหมายที่เกี่ยวข้อง ตลอดจนปัญหาและอุปสรรค เพื่อนำไปสู่ข้อเสนอเชิงนโยบายในการปรับปรุงกฎหมายและพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐาน โดยเนื้อหาเกี่ยวกับลักษณะเฉพาะของพยานหลักฐานดิจิทัล กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัล ประเด็นปัญหาและอุปสรรคจากผู้ที่เกี่ยวข้อง ข้อเสนอเชิงนโยบายและเชิงปฏิบัติ โดยใช้วิธีการวิจัยเชิงคุณภาพจากเอกสาร การลงพื้นที่สัมภาษณ์เชิงลึกและกรณีศึกษา จากการศึกษาพบว่า กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย 4 ขั้นตอน มีปัญหาและอุปสรรค คือ 1) การรวบรวมพยานหลักฐาน มีปัญหาในการรวบรวมพยานหลักฐานให้สมบูรณ์ขณะเกิดเหตุโดยไม่ถูกเปลี่ยนแปลงแก้ไข 2) การเก็บรักษาพยานหลักฐาน ไม่เป็นไปตามมาตรฐานการจัดเก็บ และการจัดการพยานหลักฐานดิจิทัล 3) การวิเคราะห์พยานหลักฐานดิจิทัล บุคลากรบางส่วนขาดความเชี่ยวชาญที่จำเป็นเฉพาะด้าน 4) การนำเสนอผลพิสูจน์พยานหลักฐานดิจิทัล มีการโต้แย้ง หรือขาดน้ำหนักในการรับฟังในชั้นพิจารณาคดี ข้อเสนอแนะจากการศึกษาครั้งนี้ คือ ควรมีการปรับปรุงพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทยให้มีมาตรฐานการปฏิบัติที่ชัดเจนในทั้ง 4 ขั้นตอนให้สอดคล้องกับมาตรฐานสากล บุคลากรควรได้รับการอบรมเพิ่มเติมในประเด็นความเชี่ยวชาญเฉพาะด้าน เพื่อช่วยลดปัญหาและอุปสรรคในการปฏิบัติงาน มีการแก้ไขกฎหมายที่เกี่ยวข้อง รวมถึงสนับสนุนให้มีการจัดตั้งสภาวิชาชีพนิติวิทยาศาสตร์ และจัดตั้งหน่วยงานเฉพาะที่ทำหน้าที่ในการกำกับดูแล โดยเริ่มต้นจากการส่งเสริมบทบาทของศูนย์ดิจิทัลฟอเรนสิกส์ที่มีอยู่เดิม เพื่อให้การป้องกันปราบปรามอาชญากรรมคอมพิวเตอร์ในประเทศไทยมีประสิทธิภาพมากขึ้น การวิจัยนี้ ได้รับการสนับสนุนทุนการศึกษาจากทุนการศึกษาหลักสูตรดุษฎีบัณฑิต “100 ปี จุฬาลงกรณ์มหาวิทยาลัย” (The 100th Anniversary Chulalongkorn University Fund for Doctoral Scholarship) และทุน 90 ปี จุฬาลงกรณ์มหาวิทยาลัย กองทุนรัชดาภิเษกสมโภช [The 90th Anniversary of Chulalongkorn University Fund (Ratchadaphiseksomphot Endowment Fund)]

วิทยานิพนธ์เรื่องสายลับกับการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาถึงความเป็นมาและบทบาทของสายลับในการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย พร้อมทั้งศึกษาความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับในการทำงานปราบปรามยาเสพติด เพื่อวิเคราะห์ผลกระทบที่เกิดขึ้นจากการนำสายลับมาใช้ในการสืบสวนปราบปรามอาชญากรรมยาเสพติด โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ ประกอบด้วย เจ้าหน้าที่รัฐ สายลับ และบุคลากรในกระบวนการยุติธรรม จำนวนทั้งสิ้น 27 ท่าน ผลการศึกษาพบว่า สายลับเป็นกลวิธีในการหาข่าวที่ปรากฏหลักฐานมาตั้งแต่สมัยบรรพกาล ตราบจนกระทั่งสังคมมีพัฒนาการทางด้านกฎหมายและกระบวนการยุติธรรมทางอาญา วิธีการใช้สายลับจึงได้ถูกนำมาปรับใช้ในการทำงานสืบสวนของเจ้าหน้าที่ตำรวจซึ่งมีภารกิจรักษาความสงบเรียบร้อยภายในรัฐและการควบคุมอาชญากรรม บทบาทที่คาดหวังของสายลับคือ การกระทำใด ๆ ที่ตอบสนองต่อภารกิจการสืบสวนปราบปรามยาเสพติดตามที่เจ้าหน้าที่ต้องการ ซึ่งเป็นงานที่เจ้าหน้าที่ไม่อาจกระทำได้โดยฐานะของเจ้าหน้าที่เองหรืออาจต้องใช้ระยะเวลานาน บทบาทความสำคัญของสายลับส่วนหนึ่งขึ้นอยู่กับมุมมองของเจ้าหน้าที่แต่ละบุคคลซึ่งมีลักษณะเป็นอัตวิสัย รูปแบบของความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับจะแตกต่างกันไปในแต่ละคู่สัมพันธ์ การใช้สายลับได้ก่อให้เกิดผลกระทบในหลายด้าน เป็นต้นว่า สายลับต้องอยู่ในวัฏจักรของการกระทำความผิดและมีโอกาสกลับไปกระทำความผิดซ้ำ และด้วยลักษณะที่เป็นความลับทำให้การตรวจสอบความโปร่งใสของการทำงานเป็นได้ยากอันส่งผลกระทบต่อสังคมและกระบวนการยุติธรรมทางอาญาหลายประการ แนวทางพัฒนาการสืบสวนโดยวิธีใช้สายลับที่เหมาะสมกับบริบทของประเทศไทยจึงควรแก้ไขเพิ่มเติมกฎหมายวิธีพิจารณาคดียาเสพติด พ.ศ. 2550 หมวด 1 ว่าด้วยการสืบสวน โดยให้ระบุถึงการสืบสวนโดยวิธีใช้สายลับ พัฒนาระบบงานยุติธรรมทางอาญาให้ทุกฝ่ายยึดหลักการค้นหาความจริงในเนื้อหา และสร้างมาตรการกำกับดูแลให้ดียิ่งขึ้น

การตกเป็นเหยื่อการซื้อขายผลิตภัณฑ์ด้านความงามผ่านระบบพาณิชย์อิเล็กทรอนิกส์, จิตลดา สุจิตต์

การศึกษานี้ มีวัตถุประสงค์เพื่อศึกษา ปัญหาการซื้อขายผลิตภัณฑ์ด้านความงามผ่านระบบพาณิชย์อิเล็กทรอนิกส์ในสังคมไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อและการกระทำผิด รวมถึงผลลัพธ์ของการตกเป็นเหยื่อ และแนวทางการป้องกันการตกเป็นเหยื่อ โดยใช้การวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มผู้ให้ข้อมูลสำคัญ 4 กลุ่ม จำนวน 19 คน ประกอบด้วย ผู้เสียหาย ผู้กระทำความผิด เจ้าหน้าที่ที่เกี่ยวข้องกับการดำเนินคดีและกำกับดูแล และผู้ทรงคุณวุฒิที่เกี่ยวข้องกับการโฆษณาผลิตภัณฑ์ด้านความงามบนสื่อออนไลน์ และการวิจัยเชิงปริมาณ (Quantitative Research) โดยเก็บข้อมูลจากผู้เสียหายด้วยแบบสอบถามออนไลน์ จำนวน 27 คน ผลการศึกษาพบว่า ปัญหาที่พบ ได้แก่ ด้านกฎหมาย การบังคับใช้กฎหมาย การชดเชยเยียวยา การควบคุมและกำกับดูแลร้านค้าออนไลน์ การควบคุมความปลอดภัยของสินค้ และการโฆษณาบนสื่อออนไลน์ โดยปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อ ได้แก่ ค่านิยมการให้คุณค่าความงาม โอกาสในการตกเป็นเหยื่อ การมีส่วนร่วมของเหยื่อ การพึ่งพาเทคโนโลยีสมัยใหม่และพฤติกรรมของเหยื่อ ทั้งนี้ การพัฒนาแนวทางการป้องกันการตกเป็นเหยื่อในเรื่องนี้ ประกอบด้วย การปรับปรุงอัตราโทษทางกฎหมายเกี่ยวกับเครื่องสำอางให้สอดคล้องกับสถานการณ์ปัจจุบัน การกำกับดูแลเพื่อควบคุมคุณภาพและความปลอดภัยของผลิตภัณฑ์ การบูรณาการความร่วมมือกับหน่วยงานของต่างประเทศในการสืบสวนสอบสวน เป็นต้น

วิทยานิพนธ์เรื่องอาชญากรรมสิ่งแวดล้อม: กรณีศึกษาผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย ศึกษาปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยและเสนอแนะแนวทางและมาตรการในการป้องกันและแก้ไขการลักลอบนําเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยให้สอดคล้องกับอนุสัญญาบาเซล (Basel Convention) โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐบาลและภาคประชาสังคม จำนวน 10 ราย ผลการศึกษาพบว่า สภาพปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์เริ่มมาจากการที่ประเทศจีนมีประกาศห้ามนำเข้าขยะรีไซเคิลอย่างเด็ดขาดในปี พ.ศ. 2560 และปัญหาการกำจัดขยะอิเล็กทรอนิกส์ที่มีอยู่เดิมของประเทศไทย ทำให้ปริมาณขยะอิเล็กทรอนิกส์ในประเทศไทยมีจำนวนสูงมากขึ้น พบการลักลอบโดยการสำแดงเท็จ การดำเนินการส่วนใหญ่มักยุติที่ชั้นศุลกากรโดยไม่เข้าสู่กระบวนการทางอาญาแม้จะมีกฎหมายระบุไว้ การลักลอบนำเข้าขยะอิเล็กทรอนิกส์จะส่งผลกระทบต่อสิ่งแวดล้อม ระบบนิเวศ สุขภาพ สังคม ชุมชน และเศรษฐกิจของประเทศ สำหรับปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์นั้น มีทั้งหมด 4 ด้าน ได้แก่ ปัจจัยด้านพื้นที่ ปัจจัยด้านการปฏิบัติงานของเจ้าหน้าที่ผู้บังคับใช้กฎหมาย ปัจจัยด้านการบังคับใช้กฎหมาย และปัจจัยด้านความคุ้มค่า ผลการศึกษาแนวทางในการป้องกัน และแก้ไขปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์มีทั้งหมด 3 ด้าน ได้แก่ ด้านการปฏิบัติงาน และการบูรณาการร่วมกันของหน่วยงานที่เกี่ยวข้อง การปรับปรุงแก้ไขกฎหมาย/นโยบาย/มาตรการ และการบังคับใช้อย่างเคร่งครัด และการสร้างจิตสำนึก และการตระหนักถึงปัญหาสิ่งแวดล้อมให้มากยิ่งขึ้น

การวิจัยเรื่อง การนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้ในศาลเยาวชนและครอบครัว : ศึกษาการพัฒนามาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี มีวัตถุประสงค์เพื่อศึกษาการนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้ในกระบวนการยุติธรรมทางอาญาสำหรับเด็กและเยาวชนโดยศาลเยาวชนและครอบครัวผ่านการดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี ที่ได้นำแนวทางการศึกษาการนำนโยบายไปปฏิบัติมาใช้เป็นแนววิเคราะห์ปัญหาและอุปสรรคผ่านปัจจัยที่มีผลต่อความสำเร็จหรือความล้มเหลวจากขั้นตอนการนำไปปฏิบัติ และศึกษาเปรียบเทียบกับกระบวนการของต่างประเทศ นำไปสู่ข้อเสนอแนะแนวทางการพัฒนาการดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี เพื่อให้เกิดการพัฒนาและสามารถแก้ไขปัญหาอุปสรรคที่เกิดขึ้นจากการนำไปปฏิบัติโดยศาลเยาวชนและครอบครัวได้ โดยใช้วิธีการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสารที่เกี่ยวข้อง การสังเกต การอภิปรายกลุ่ม และการสัมภาษณ์แบบเจาะลึกจากผู้ให้ข้อมูลสำคัญ ให้ได้ข้อมูลเพื่อนำมาวิเคราะห์แบบอุปนัย สร้างข้อสรุปเพื่อตอบคำถามการวิจัย ผลการวิจัยพบว่า การดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี เป็นทางเลือกหนึ่งแทนกระบวนการทางตุลาการปกติ ซึ่งประยุกต์มาจากงานยุติธรรมเชิงสมานฉันท์ ที่ผู้กระทำสำนึกผิดเข้าสู่กระบวนการของการมีส่วนร่วมจากทุกฝ่ายผ่านการพูดคุย ให้ได้ผลเชิงสมานฉันท์ที่ผู้เสียหายได้รับการชดเชยเยียวยา และผู้กระทำผิดได้แก้ไขบำบัดฟื้นฟูเพื่อกลับคืนสู่สังคมด้วยดี ซึ่งพบปัญหาและอุปสรรคในการปฏิบัติโดยศาลเยาวชนและครอบครัว 5 ประการ คือ ด้านกฎหมาย ด้านคุณภาพและความพอเพียงของทรัพยากร ด้านลักษณะหน่วยงานผู้ปฏิบัติ ด้านการสื่อสารและควบคุมดูแล และด้านสภาพแวดล้อมหรือบริบท โดยสมควรปรับปรุงกฎหมาย จัดสรรทรัพยากร เพิ่มเติมหน่วยงานในองค์กรของผู้นำนโยบายไปปฏิบัติ และติดตามควบคุมดูแล เพื่อแก้ไขบำบัดฟื้นฟูเยาวชนอย่างสมดุลกับการชดเชยเยียวยาความเสียหายที่เกิดจากอาชญากรรมอย่างเหมาะสมกับบริบทของสังคม

Forensic entomology is considered a relatively new field of entomology yet insects have been around for millions of years. Insects have been associated with dead animals and humans for centuries. The remains of insects have been recorded from Ancient Egypt to the present time. Recent advancements have been with data presented to the courts that show that there is a specific order to insects arriving on a corpse and that order helps to determine time of death. This study investigates the order of insect succession in the northern front range area of Colorado.

Public libraries are increasingly faced with patron psychosocial needs, including mental health problems, substance use, homelessness, or poverty-related needs. Since library staff are often not trained to address these needs, many are choosing to host on-site social work practicum students to provide information and referrals for patrons presenting with psychosocial needs. However, little existing guidance is available about initiating a social work practicum placement, which can leave libraries unprepared and often “reinventing the wheel”. This manuscript provides guidance on the steps that should be considered by libraries intending to host their first social work practicum student.

There are many reasons why adolescents and young adults turn to delinquent behaviors, much of which result from the environment they are residing in. Copious research has been done on the effects that parent, teacher, peer, and partner relationships have on delinquency, but very little focuses on support systems as a whole. Support systems create positive or negative modeling behaviors for people to follow and individuals will allow these models to influence their own personal behavior patterns. Anti-Black racism is an interruption of contact that often takes place out of awareness, and is continuously enacted through innumerable fixed gestalts at every level of human experience. With the deepening of power market reform, distributed power generation is gaining momentum. This paper tests the distributed photovoltaic (DPV) economy under different business models by taking three provinces to stand for typical resource zones. The Internal return rate (IRR) is used to measure the economy, while the improved levelized cost of electricity (LCOE) is used to model the generation cost. Three business modes, namely pure producer (all generation sold to the grid), prosumer (self-use and the rest sold to the grid), and peer-to-peer trade (P2P, all generation traded via the grid) are studied. This study investigated whether the concentrations of four metals [lead (Pb), mercury (Hg), manganese (Mn), and aluminum (Al)] are correlated in cord blood and childhood blood samples from Jamaican children. Cord blood samples were obtained from 21 pregnant women enrolled in the second Jamaican Birth Cohort Study from July 1, 2011 to September 30, 2011, and blood samples were drawn from their children who participated in a follow up study when the children were 4–8 years old. During the medieval and early modern periods the Middle East lost its economic advantage relative to the West. Recent explanations of this historical phenomenon— called the Long Divergence—focus on these regions’ distinct political economy choices regarding religious legitimacy and limited governance. We study these features in a political economy model of the interactions between rulers, secular and clerical elites, and civil society. The model induces a joint evolution of culture and political institutions converging to one of two distinct stationary states: a religious and a secular regime. Contrary to conventional economic growth theory, which reduces a country’s output to one aggregate variable (GDP), product diversity is central to economic development, as recent, “economic complexity”, research suggests. A country’s product diversity reflects its diversity of knowhow or “capabilities”. Researchers proposed the Economic Complexity Index (ECI) and the country Fitness index to estimate a country’s number of capabilities from international export data; these measures predict economic growth better than conventional variables such as human capital.
