Aiming For Certainty: The Kanun, Blood Feuds And The Ascertainment Of Customary Law, Sandra F. Joireman Jan 2014

Aiming For Certainty: The Kanun, Blood Feuds And The Ascertainment Of Customary Law, Sandra F. Joireman

Political Science Faculty Publications

Customary law is an alternative legal framework to statute or public law. In the past the existence of customary law was viewed as problematic due to the uncertainty which accompanies legal pluralism. Increasingly, scholars are recognizing legal pluralism as simply a reality to be negotiated, rather than a problem. One frequently proposed solution to the difficulties posed by the existence of customary law is to write it down, or ascertain it, in order to provide for legal certainty. This article addresses this goal in three parts. The first part describes customary law and how it functions in its uncodified form …

Strategies For Health Care Cost Containment (1980s-Present), Rick Mayes Jan 2014

Strategies For Health Care Cost Containment (1980s-Present), Rick Mayes

Political Science Faculty Publications

The U.S. health care system during the past three decades has been over two interrelated questions: first, who will control the manner in which medical care is paid for, and, second, how much will it cost? Many health care experts believe that Medicare's efforts at cost control, primarily in the form of the program's seminal transition to and continual modification of prospective payment of health care providers, has both triggered and repeatedly intensified the economic restructuring of the U.S. health care system. Medicare is an almost $600 billion public health insurance program for individuals sixty-five years of age and older; …

Yemen Between Revolution And Counter-Terrorism, Sheila Carapico Jan 2014

Yemen Between Revolution And Counter-Terrorism, Sheila Carapico

Political Science Faculty Publications

This chapter juxtaposes these seemingly two quite different storylines - one about Yemeni aspirations for social justice and better governance and the other about American and Saudi operations undertaken in the name of combating terrorism. The so-called GCC Initiative, and in particular the National Dialogue Conference process playing out as this book goes to press, provides the link between them. From the perspective of domestic politics, the Dialogue can be read as the outcome of agitation by the new generation of 'peaceful youth', as well as an outgrowth of Yemen's tradition of dialogue - an historic effort to resolve crisis …

Rebuilding Communities After Violent Conflict: Informal Justice Systems And Resource Access, Sandra F. Joireman Jan 2014

Rebuilding Communities After Violent Conflict: Informal Justice Systems And Resource Access, Sandra F. Joireman

Political Science Faculty Publications

A community recovering from war or ethnic conflict has to find ways of reweaving the fabric of economic and social life with new patterns of interaction and changed demographics.2 In post-‐‑conflict settings customary law has a particular attraction because of the moral authority it brings to the establishment of order. Customary law is familiar, tied to the identity and history of a community, and operates independently of outside resources. Although the term evokes images of a universal acceptance and ancient origin, customary law has always been dynamic, defined by those in power, and subject to political interests.3 Informal …

The goal of this chapter is to discuss key values and archetypes of Russian culture that have developed over several centuries of Russian history. This fundamental introduction is important because these values and archetypes have successfully manifested themselves through various institutions of the Russian Empire, the Soviet Union and post-Soviet Russia. What are they and what are their roots? Answers to these questions can help us better understand Russian economic and business culture that shapes the behaviour of entrepreneurs, investors and employees in the current economy, and also political and legal traditions that play enormous roles in establishing and running …

An Introduction To The Cultural Anthropology And Preservation Of The Rio Grande Valley, Margaret E. Dorsey, Miguel Díaz-Barriga Jan 2014

An Introduction To The Cultural Anthropology And Preservation Of The Rio Grande Valley, Margaret E. Dorsey, Miguel Díaz-Barriga

Sociology and Anthropology Faculty Publications

Anthropology is the study of human behavior and culture, and anthropologists in the United States divide their research into four sub-fields of study: physical anthropology; archaeology; linguistic anthropology; and cultural anthropology. North American anthropology draws its impetus from the foundational work of Franz Boas, a professor at Columbia University who lived along the Arctic Circle on Baffin Island, Canada for one year in the late nineteenth century where he kept copious notes of the language, life ways and customs of the Inuit. The following year, Boas collaborated with several museums conducting fieldwork along the North Pacific Coast setting the tone …

A Paradox In Development: Exploring The Obesity Pandemic In Latin America, Laila G. Heid Jan 2014

A Paradox In Development: Exploring The Obesity Pandemic In Latin America, Laila G. Heid

CMC Senior Theses

The purpose of this paper is to explain the obesity pandemic in Latin America and identify the factors of development contributing to the pandemic. The paper uses the framework of the nutrition transition as presented by Barry Popkin to trace consumption patterns and changes in dietary habits in the region. The paper looks at three case studies: Mexico and Chile, two countries with high obesity rates, and Peru, the country with the lowest obesity rate in South America. This comparative framework is intended to determine which conditions are necessary for obesity, which conditions are sufficient for obesity, and any conditions …

Trade Liberalization In Mexico: An Analysis Of The Anti-Export Bias, Daniel J. Serra Jan 2014

Trade Liberalization In Mexico: An Analysis Of The Anti-Export Bias, Daniel J. Serra

CMC Senior Theses

Modern trade theory suggests that protectionist policies hinder exports by altering domestic prices and production incentives. This paper examines the effect of import tariffs on Mexican non-oil exports through a comprehensive analysis of the Mexican trade sector, including a breakdown of the most important free trade agreements for the Mexican economy, information on Mexican resource mobility and factor endowment, and analysis on Mexico’s tariff structure. The paper finds that import tariffs on both intermediate and final goods have a direct and significant effect on exports, alluding to the existence of an anti-export bias, and argues that free trade is the …

A Discussion Of The Impact Of Political And Economic Forces On Equitable Access To Potable Water In Ecuador And Recommendations For Improvement Through Better Watershed Management, Eliza States Jan 2014

A Discussion Of The Impact Of Political And Economic Forces On Equitable Access To Potable Water In Ecuador And Recommendations For Improvement Through Better Watershed Management, Eliza States

Pitzer Senior Theses

This thesis will address the impact of political and economic forces on the equitable access to fresh water in Ecuador. Demographic factors such as the rural-to-urban migration and the political and economic forces have strongly influenced the debate over the privatization of the provision of potable water and sanitation services. Within the context of Ecuador, two different approaches by the largest cities, Quito and Guayaquil, are analyzed; in Guayaquil, the services were privatized, while in Quito, the public utility was corporatized, remaining under public control. It concludes arguing that in the face of political instability and a lack of regulatory …

The Effects Of Adherence To Asian Values And Extraversion On Cardiovascular Reactivity: A Comparison Between Asian And European Americans, Lindsay K. Yamaoka Jan 2014

The Effects Of Adherence To Asian Values And Extraversion On Cardiovascular Reactivity: A Comparison Between Asian And European Americans, Lindsay K. Yamaoka

Pitzer Senior Theses

This study investigated the effects of personality type and ethnicity on reactivity to stressful stimuli by examining acculturation and adherence to Asian American cultural values as moderators. Twenty-two Asian American and twenty-two European American students performed a mental arithmetic task and a speech task while cardiovascular (CV) reactivity was monitored. Level of extraversion, acculturation, and adherence to Asian American values were assessed. As predicted, Asian Americans exhibited less CV reactivity to stressful stimuli and lower levels of extraversion than European Americans. Support was found for adherence to Asian American values as a moderator of the relationship between level of extraversion …

Constructing Creativity: Wisdom In Everyday Problem Solving, Audrey Defrank, Nicholas J. Arreola, Roni Reiter-Palmon Jan 2014

Constructing Creativity: Wisdom In Everyday Problem Solving, Audrey Defrank, Nicholas J. Arreola, Roni Reiter-Palmon

Criss Library Faculty Proceedings & Presentations

Creativity is conceptualized as an idea or product that is both original and high in quality (Amabile, 1996). Researchers have sought to better understand the creative process by examining predictors of creative outcomes. Wisdom may play a predictive role in this process. According to Webster (2003), wisdom is the competency in, and application of, critical life experiences to optimize development of the self, as well as others. Research has suggested that wisdom supports creativity at an implicit level (Sternberg, 1985, 1999), and contributes to creative achievements (Helson & Srivastava, 2002).

Process models of creativity have sought to demonstrate cognitive operations …

Winona State University, Krueger Library, Summer 2013. Time for a library website reboot. We wanted our online presence to be user-focused, simple, and elegant. Our dilemma? No developers on staff at our library. Our vision was galaxies ahead of our tools and knowledge. We turned to our university Web Communications and Web Development teams to boldly go where the library website had not gone before. At first, we educated each other. Librarians learned about the university’s web systems, and developers learned about library systems. Then we met weekly to share our ideas as a team, identifying and overcoming obstacles together …

Awareness, Agency, And Alternatives: Opportunities And Challenges For Conamuri And The Paraguayan Women’S Food Sovereignty Movement In An Age Of Social Media, Brianne Illich

Honors Theses

This thesis examines the influence and limitations of the use of social media by the Paraguayan female food sovereignty movement. Considering the Paraguayan campesino context of censorship and marginalization, it analyzes social media’s role as an alternative news source, a space for self-expression, and a vehicle for interactive engagement, outreach, and resistance. It focuses specifically on the experiences within CONAMURI, a Paraguayan women’s food sovereignty network. The study sheds light on the CONAMURI female campesino context, giving voice to the personal experiences, challenges, aspirations, and activities that make up everyday organizational resistance and motivate social media mobilization. Overall, this thesis …

The Role Of Underutilized Fish In New England's Seafood System, Taylor Witkin Jan 2014

The Role Of Underutilized Fish In New England's Seafood System, Taylor Witkin

Honors Theses

The global fisheries crisis has led to an increasing recognition for the need to relieve pressure on overfished, popular food fish stocks. Opportunities exist to shift consumer demand toward more sustainable choices, including fish that may be locally abundant. Attempts have been made to market underused fish (sometimes termed “trash fish”) that represent more sustainable alternatives; however, it is unclear whether consumers will choose to purchase these more sustainable options, particularly if underused fish are also unfamiliar. Chapter 1 reviews existing research and current issues surrounding sustainable seafood and the recent shift toward local, abundant, undervalued species in New England’s …

Borderline Depravity: The Impact Of U.S. Immigration Policy On Human Smuggling At The Mexican Border, Chloe J. Gilroy Jan 2014

Borderline Depravity: The Impact Of U.S. Immigration Policy On Human Smuggling At The Mexican Border, Chloe J. Gilroy

Honors Theses

Human smuggling at the southwest border has undergone a series of dramatic changes following the advent of militarized enforcement after 9/11. These changes have culminated in drug cartels becoming involved in the market for human smuggling as service providers. This role constitutes a massive departure from the traditional working dynamics of the market, and has created a human rights crisis with far-reaching implications. Accordingly, this thesis attempts to answer the following questions: Why are Mexican drug cartels entering into human smuggling? What part has U.S immigration policy had in incentivizing their involvement? When did their involvement begin? To answer these …

The Relationships Between Local Food And Food Security In Maine, Erin Love Jan 2014

The Relationships Between Local Food And Food Security In Maine, Erin Love

Honors Theses

There is a food systems paradox in Maine: the State has one of the highest levels of food insecurity in the nation, while simultaneously experiencing a local agriculture boom. Maine has some of the largest percentages of young farmers and women farmers in the country and is home to the second highest number of artisan cheese makers of any state in the country. Amidst this exciting, sometimes quirky, agricultural activity there is a critical need for food systems development in the state, especially in the context of serving vulnerable populations. This thesis explores the ways in which Mainers are working …

A New Balance: National Security And Privacy In A Post 9-11 World, Russell B. Wilson Jan 2014

A New Balance: National Security And Privacy In A Post 9-11 World, Russell B. Wilson

Honors Theses

The terrorist attacks on September 11, 2001 shocked the American security apparatus, placing greater pressure on the security actions of the U.S. government, particularly regarding information gathering. Laying out a framework that examines different notions of national security and privacy, this paper examine three case studies to illustrate the role of the government and the inherent friction between privacy and security that increased information gathering inherently creates. The shifting balance between the two variables forces us to reexamine how we want our government to protect us and what we will sacrifice in order to ensure our own well being. With …

A single mother of three, I had brought my kids along and got a lot of help from a dear friend Jenny, who had a husband and two kids. She also worked twelve hours a day, and when I asked her when she saw her kids, …

Working It Out: Examining The Psychological Effects Of Music And Exercise And Exploring The Theoretical Background Of Health Behaviors, Caroline R. Campbell

Theses and Dissertations

Exercise has been linked to mood benefits, and music may increase these effects. The purpose of the present study was to investigate the psychological effects of music and exercise. Exercise was hypothesized to increase mood more significantly in those who listened to music. Listening to music while exercising was also hypothesized to lead to lower perceived exertion and higher exercise enjoyment. Participants (N = 148) completed 20 minutes of moderately-paced walking, either with or without a personal music player. Exercise significantly increased mood in all measured dimensions. Exercise enjoyment was significantly higher among participants who exercised with music and music …

Perceptions Of Humanity: College Students On Homelessness, Emily Ann Burdett

Theses and Dissertations

Initially focused on previous research regarding the demographics of the homeless population over the past three decades to develop a deeper understanding of issues homeless people face, a brief study was done to gather college students' beliefs regarding the homeless population and demographics of the students. It was found that ethnicity and political affiliation both had significant effects on the students' perceptions of homelessness. Beliefs in the causes of homelessness were effected by political affiliation. Ethnicity affected scores regarding students' willingness to affiliate with homeless individuals. Social Dominance Orientation scores also correlated negatively with Distributive Justice Beliefs of Others. No …
