There is no reason for the Supreme Court to have granted certiorari in Fisher v. University of Texas at Austin. Unless, of course, the Court plans to overrule Grutter v. Bollinger—the case on which the Texas affirmative action plan at issue in Fisher was based. If that is its plan, the Court can invalidate the Texas program on some narrow ground that masks the magnitude of what it is doing. Or it can explicitly overrule Grutter—a case that no longer commands majority support on a Supreme Court whose politics of affirmative action has now been refashioned by …

This article starts from the premise that poverty is a growing problem in the United States. Intergenerational poverty, the entrenchment of a class of very poor people, is a major sub set of that problem and is tied very closely to the issue of race. The author claims that missing in the fight by the poor and their allies against stratified poverty is the creation and utilization of power. This paper examines the disparate ways in which commentators have defined power. This questionnaire-based study examines how libraries are now handling electronic journal (e-journal) article requests in both lending and borrowing. With an increasing number of publishers and e-journal content providers permitting interlibrary loan (ILL) sharing, and with the availability of new license management tools and services, many respondents stated that they share e-journal articles. However, problems persist. Respondents cited is- sues such as restrictive licenses, automatic deflection of e-journal article requests, and the lack of information from libraries about what e-journal titles they are licensed to ILL.

The U.S. Supreme Court in Eldred v. Ashcroft gave First Amendment importance to the topic of copyright history. In measuring whether Congress has altered the “traditional contours” of copyright such that First Amendment scrutiny must be applied, federal courts—including the Supreme Court in its 2011 Term case Golan v. Holder—must carefully examine the intertwined history of copyright and freedom of the press. The famous but misunderstood case of Donaldson v. Beckett in the British House of Lords in 1774 is an important piece of this history. In Donaldson, several lawyers, litigants, judges, and lords recognized the danger posed …

Slang lexemes and swearwords are commonly discussed in conjunction with each other as though they were slightly different versions of the same phenomenon. However, they clearly are not, as a careful consideration of their different prototypical functions reveals. Each of these lexical categories has a central or core function, and in each case this function is linked to the obligatory expression of affect. Different kinds of affect are entailed in the prototypical uses of slang and of swearwords, but in the case of both of these lexical types, this affect is incompatible with the formality and deference of honorifics, or, …

Manual annotation of large textual corpora can be cost-prohibitive, especially for rare and under-resourced languages. One potential solution is pre-annotation: asking human annotators to correct sentences that have already been annotated, usually by a machine. Another potential solution is correction propagation: using annotator corrections to dynamically improve to the remaining pre-annotations within the current sentence. The research presented in this paper employs a controlled user study to discover under what conditions these two machine-assisted annotation techniques are effective in increasing annotator speed and accuracy and thereby reducing the cost for the task of morphologically annotating texts written in classical Syriac. …

Elicited imitation (EI) is a testing method for learners’ oral language proficiency. One common criticism aimed at EI is that performance might not require linguistic knowledge, but mere rote memorization. This study explores the issue by administering two tests to the same group of students studying English as a second language: (1) a working memory test, and (2) an English EI test. Participants came from a range of English language proficiency levels. Our goal was to test whether scores from these two treatments (English EI scores and working memory scores) would correlate significantly. If not, this would suggest that there …

Testing The Developmental Nature Of Work Motivation Using Kegan’S Constructive-Development Theory, Marilyn J. Bugenhagen, John E. Barbuto Jr.

This article reports a field study testing the relationship between individuals’ constructive-development level and their sources of work motivation. Constructive development was assessed using the Subject–Object Interview for 53 community and educational leaders. Motivation was assessed using the Motivation Sources Inventory. Results indicated that constructive-development progression was significantly related to instrumental motivation. No other significant relationships were found, indicating that the other four sources of work motivation exist independent of individuals’ constructive development. Implications for research and practice are addressed.

Targeting Outcomes of Programs (TOP) is a seven-step hierarchical programming model in which the program development and performance sides are mirror images of each other. It served as a framework to identify a simple method for targeting photographic events in nonformal education programs, indicating why, when, and how photographs would be useful to inform other evaluation strategies. In two case studies, photographs enhanced the formative story of a geoscience project being developed and tested, and contributed to the outcome narrative of a 10-year partnership project between two universities. In both cases, TOP proved to be an efficient and easy-to-use framework. …

The aim of this study was to examine the relationship between resistance and perception of resistance during sexual assault and feelings of self-blame in college aged women. The literature has shown that self-blame has uniformly negative effects on a victimized woman's emotional and psychological health, including poor adjustment, and higher levels of sexual dissatisfaction, depression and global distress. Behaviors and situations during and after the experience that correlate with self-blame that have been studied include alcohol use and knowing the perpetrator. In the last 20-30 years, missionary burnout has become a popular topic in the missionary care and support community. Although much research has been done on the issue, few studies have provided a comprehensive approach to the study and appropriate care of these missionaries. The goal of this research was to present a model that more accurately represented missionary struggles while incorporating past findings on missionary burnout. Four retired missionaries were interviewed about their experiences on the field, and their estimation of the model’s relevancy and helpfulness. Pony Distress: Using Espn’S 30for30 Films To Teach Cartel Theory

This study provides a roadmap for economics instructors to use a graphical model along with various clips from ESPN’s critically-acclaimed 30FOR30 films series in order to complement classroom discussion of cartel theory, particularly the story of the National Collegiate Athletics Association as a cartel. The two films used here are Thaddeus D. Matula’s Pony Excess (2010) and Jonathan Hock’s The Best that Never Was (2010). Each chronicles the rampant rules-breaking, or cartel cheating, in college football during the 1970s and 1980s, culminating in the “Death Penalty” at SMU and the collapse of the Southwest Conference cartel.

The study examined which socio-demographic differences between clients and providers influenced interpersonal complementarity during an initial intake session; that is, behaviors that facilitate harmonious interactions between client and provider. Complementarity was assessed using blinded ratings of 114 videotaped intake sessions by trained observers. Hierarchical linear models were used to examine how match between client and provider in race/ethnicity, sex, and age were associated with levels of complementarity. A qualitative analysis investigated potential mechanisms that accounted for overall complementarity beyond match by examining client-provider dyads in the top and bottom quartiles of the complementarity measure.
