Managing Risk On A $25 Million Bet: Venture Capital, Agency Costs, And The False Dichotomy Of The Corporation, Robert P. Bartlett Iii May 2006

Managing Risk On A $25 Million Bet: Venture Capital, Agency Costs, And The False Dichotomy Of The Corporation, Robert P. Bartlett Iii

ExpressO

An implicit dichotomy of the corporation exists in legal scholarship. On one side of the dichotomy rests the publicly-held corporation suffering from a significant conflict of interest between its managers and dispersed shareholders; on the other side, the closely-held corporation plagued by inter-shareholder conflict.

This Article argues that understanding the agency problems that can exist within a firm demands a rejection of this traditional dichotomy and the theories of the firm built upon it. Using venture capital finance, this Article demonstrates for the first time how this dichotomy obscures how all firms - public and private - often face the …

Final Offer Arbitration In The New Era Of Major League Baseball, Spencer B. Gordon May 2006

Final Offer Arbitration In The New Era Of Major League Baseball, Spencer B. Gordon

ExpressO

This article provides a comprehensive analysis of the economic, athletic, and social impact of final offer salary arbitration in Major League Baseball (“MLB”). The article delves into the motivations, fluctuations, and evolution of the player-owner relationship and free agency. The commentary then focuses on the distinguishing features and intricacies of final offer arbitration. Although salary arbitration in the context of Major League Baseball is a topic oft discussed in the law review setting, the analysis rarely reaches the level exhibited in this article. Moreover, most articles on the subject were written between 1996 and 2000 when the 1994 players’ strike …

Lifeways In The Northern Mayan Lowlands: New Approaches To Archaeology In The Yucatán Peninsula, Jennifer P. Mathews, Bethany A. Morrison

Faculty Authored and Edited Books & CDs

The flat, dry reaches of the northern Yucatán Peninsula have been largely ignored by archaeologists drawn to the more illustrious sites of the south. This book is the first volume to focus entirely on the northern Maya lowlands, presenting a broad cross-section of current research projects in the region by both established and up-and-coming scholars. To address the heretofore unrecognized importance of the northern lowlands in Maya prehistory, the contributors cover key topics relevant to Maya studies: the environmental and historical significance of the region, the archaeology of both large and small sites, the development of agriculture, resource management, ancient …

Stress And Health Behavior Among College Students, Lindsey Dorflinger May 2006

Stress And Health Behavior Among College Students, Lindsey Dorflinger

Honors Theses

The effect of stress and gender on health behavior, as well as the association amongst health behaviors, was examined. Past research has shown that stress can lead to higher levels of abnormal eating behaviors and attitudes, lower levels of exercise participation, and increased risk of smoking; studies have shown some gender differences as well. Seventy-eight college students completed questionnaires about stress, disordered eating, physical activity, and smoking status. Results showed that higher levels of stress were associated with higher levels of disordered eating, and that females have more abnormal eating attitudes and behaviors than males. Higher levels of exercise are …

2005 Nebraska Farm Business Data, Tina N. Barrett May 2006

2005 Nebraska Farm Business Data, Tina N. Barrett

Cornhusker Economics

Following a year of climbing fuel prices, tough crop prices and average yields, I really didn’t expect to be reporting record high net farm income for the State of Nebraska, but that’s the news I have to report. Net Farm Income for 2005 was $83,095, up 5 percent over last year’s record high income. I was really surprised as the averages were coming in, but it didn’t take long to understand where the numbers were coming from.

Development Decision-Making In St. Louis: Institutions, Incentives And Urban Development, William Ernst Winter May 2006

Development Decision-Making In St. Louis: Institutions, Incentives And Urban Development, William Ernst Winter

Dissertations

This study uses the example of St. Louis to identify how local leaders make decisions about development and what factors influence the type of projects chosen. Through an analysis of projects conducted in the downtown and two distressed neighborhoods, the study concludes that St. Louis has a system of development decision-making that is substantially privatized and decentralized. At the center of development activity are place-based entrepreneurs who understand the local market and work to change the incentive structure for reinvestment. The leadership of the private sector in planning and implementing development policy is the flipside of local institutions that are …

Finding New Constitutional Rights Through The Supreme Court’S Evolving “Government Purpose” Test Under Minimum Scrutiny, John H. Ryskamp May 2006

Finding New Constitutional Rights Through The Supreme Court’S Evolving “Government Purpose” Test Under Minimum Scrutiny, John H. Ryskamp

ExpressO

By now we all are familiar with the litany of cases which refused to find elevated scrutiny for so-called “affirmative” or “social” rights such as education, welfare or housing: Lindsey v. Normet, San Antonio School District v. Rodriguez, Dandridge v. Williams, DeShaney v. Winnebago County. There didn’t seem to be anything in minimum scrutiny which could protect such facts as education or housing, from government action. However, unobtrusively and over the years, the Supreme Court has clarified and articulated one aspect of minimum scrutiny which holds promise for vindicating facts. You will recall that under minimum scrutiny government’s action is …
