The corporate governance debate has focused recently on executive compensation. While defenders of the status quo assert that CEO compensation – and corporate governance generally -- is efficient, critics contend that boards have been captured by powerful CEOs who demand excessive pay unconditioned on their performance. Both sides argue that the evidence garnered from CEO compensation justifies their positions on legal reform of corporate governance as a whole. Defenders of the status quo argue that the system works well as is, as demonstrated by the enormous success of U.S. corporations. Dynamics And Control Of Tethered Satellite Formations For The Purpose Of Space-Based Remote Sensing, Kurt A. Vogel

This dissertation assesses the utility of tethered satellite formations for the space-based remote sensing mission. Energy dissipation is found to have an adverse effect on foundational rigid body (Likins-Pringle) equilibria. It is shown that a continuously earth-facing equilibrium condition for a fixed-length tethered system does not exist since the spin rate required for the proper precession would not be high enough to maintain tether tension. The range of required spin rates for steady-spin motion is numerically defined here, but none of these conditions can meet the continuously earth-facing criteria. In the wake of the Court’s near-total refusal to impose a check on the legislature through the public use clause, this paper discusses whether any confidence in our property rights be restored through the just compensation clause in the form of restitutionary compensation, rather than the traditional, and myopic, “fair market value” standard. This paper discusses the historical presumption against restitution, elucidated through Bauman v. Insider Trading Laws And Stock Markets Around The World (Former Title: Do Insider Trading Laws Matter? Some Preliminary Comparative Evidence), Laura N. Beny

Law & Economics Working Papers Archive: 2003-2009

The primary goal of this article is to bring empirical evidence to bear on the largely theoretical law and economics debate about insider trading. The article first summarizes various agency cost and market theories of insider trading propounded over the course of this perennial debate. The article then proposes three testable hypotheses regarding the relationship between insider trading laws and several measures of stock market performance. Using international data, the paper finds that more stringent insider trading laws are generally associated with more dispersed equity ownership, greater stock price accuracy and greater stock market liquidity. We propose and test the implications of a two-dimensional concept of candidate quality in U.S. House elections. Strategic quality is composed of the skills and resources necessary to wage an effective campaign; personal quality is composed of the characteristics most ordinary citizens value in their leaders and representatives, such as personal integrity and dedication to public service. We employ district informants in studies of the 1998 and 2002 congressional elections to measure these qualities in candidates, and we merge mass survey data with the district informant indicators to assess constituents’ awareness and evaluation of House candidates, and voting choice. Import Competition And The Probability Of Job Displacement In Us Manufacturing, 1983-1999, Roger White

Economics

The trade-displacement relationship is examined using observations from the 1984- 2000 Displaced Worker Surveys and corresponding industry data. Increases in import penetration and decreases in import prices correlate with higher displacement rates. Considerable variation in the effects of import competition on displacement probabilities is found across worker types. For example, the estimated displacement probability for a minority female who is not a union member but who has completed some college coursework ranges from 6.44 to 7.13 percent. This is significantly higher than the range estimated (1.02 to 1.24 percent) for collegeeducated, white, male union members. Setting import competition values equal …

The railroad industry is experiencing a worldwide resurgence. International trade is booming as populations continue to grow and transportation infrastructures are nearing capacity. In the United States, the industry is being pressured to provide more services, while at the same time traffic levels are skyrocketing on a network that is much smaller than it was just fifty years ago. Additionally, security and safety issues are challenging the industry, as well as the regulatory agencies associated with railroading. Since joining the company in 2004 as chief operating officer and head of general medicines, Gorsky has overseen the continued growth of Novartis's industry-leading cardiovascular franchise, notably the blockbuster drugs Diovan and Lotrel. The company sells a variety of products, including those that treat endocrine and respiratory disease, gastrointestinal illnesses, cancer and blood disorders and bone and joint conditions, among others. Labor Supply With Social Interactions: Econometric Estimates And Their Tax Policy Implications, Andrew Grodner, Thomas J. Kniesner

Our research fleshes out econometric details of examining possible social interactions in labor supply. We look for a response of a person's hours worked to hours worked in the labor market reference group, which includes those with similar age, family structure, and location. We identify endogenous spillovers by instrumenting average hours worked in the reference group with hours worked in neighboring reference groups. Estimates of the canonical labor supply model indicate positive economically important spillovers for adult men. The estimated total wage elasticity of labor supply is 0.22, where 0.08 is the exogenous wage change effect and 0.14 is the …

The author reflects on his experience and discusses problems in teaching a course about spirituality and religion in the workplace. Sometimes indoctrination happens when professors treat their own spiritual ideology as the truth, or they require students to engage in religious practices in class. Indoctrination is teaching people “to accept a system of thought uncritically.” The management education literature has little to say about indoctrination. Indoctrination can be avoided by (1) ensuring informed consent, (2) designing learning activities for students from all spiritual perspectives, (3) teaching about the topic (instead of taking the “how to” approach), (4) presenting diverse spiritual …

Blacks, while still not an integral part of the management structure in the South African economy, are making gains. As management composition changes, cultural issues will become more salient. Early senior black managers were well versed in the Anglo/American cultures due to foreign education and work experience. Future gains will likely come from internal promotion. This new breed of black managers will be more immersed in their native culture. This paper focuses on how managerial networking relationships developed with external entities affect organizational performance using survey data from organizations in Ghana. Networking relationships with external entities are established so as to obtain resources, valuable information, and to acquire and exploit knowledge, in order to overcome the high level of uncertainty in the business environment. The findings provide strong support that managerial networking relationships developed with top managers of other firms, government bureaucratic officials, community leaders, and leaders of employee unions and representatives enhance organizational performance.
