The Article on “Legal Consciousness and Contractual Obligations” will explore and offer an explanation of the origins of the moral foundations for contractual obligations beyond conventional analysis. Building on themes and threads across many disciplines and theories, it seeks to identify and locate certain unities and common elements that explain human consciousness in exchange relations across cultures. The term contract is used in its non-technical and most inclusive sense to cover agreements, promises, undertakings and other forms of consensus whether or not supported by consideration. Upwards of $50 billion in capital needs go unmet each year in Indian Country in such vital sectors as infrastructure, community facilities, housing, and enterprise development, in part due to the restrictions imposed on tribal access to the capital markets, specifically the ability of tribal governments to issue tax-exempt debt. Section 7871 of the Internal Revenue Code requires tribal tax-free bond proceeds to be used only for “essential governmental functions,” a restriction not applicable to state and municipal bonds, and Section 7871(e) further limits the scope of available tax-exempt bonding to activities “customarily performed by State and local governments with …

Since 1984, the New Hampshire Community Loan Fund has been helping residents of manufactured home communities purchase the land underneath their homes. Since then, homeowners have purchased 80 manufactured home communities and converted them into “Resident Owned Communities” (ROCs) in New Hampshire. These communities now include 4,200 homeowners. The premise of the loan fund program is that resident ownership provides both an important vehicle for preserving affordable housing and economic benefits to homeowners in ROCs. Until now, no systematic data have been available to confirm the benefits. To fill that gap, the fund contracted researchers from the Carsey Institute at …

Employees have shown a great desire for flexible work arrangements (FWAs). National data reveals that nearly 80% of workers say they would like to have more flexible work options and would use them if there were no negative consequences at work. However, most workers do not have access to flexible work arrangements and barriers to their effective implementation persist in many organizations as the following nationally representative employer-based survey data reveals.

In 2002, the United Kingdom passed new legislation granting employees with young or disabled children the right to request flexible work arrangements from their employers. The law does not guarantee a right to flexible working but seeks to increase flexibility in UK workplaces by requiring a process for negotiation between employees and employers. Stated simply, that process places the initial responsibility on the employee to propose a new work arrangement and explain its potential impact on the employer. The employee and employer must then consider the request together, and the employer may refuse the request only for certain business reasons.

Many people think of workplace flexibility as flexibility that is provided on a long term, regular basis — for example, flexibility provided through alternative work schedules, compressed workweeks, or part time positions. Under Workplace Flexibility 2010’s conceptualization, however, workplace flexibility also includes the ability to address day-to-day life needs on a short term basis.

Short term needs for flexibility are numerous: to recover from an illness; take care of a sick child; attend a school conference, funeral or medical appointment; wait for a repair person; or appear in court. Some needs may be anticipated; others will arise unexpectedly.

With the indefinite suspension of the WTO multilateral trade negotiations in July 2006 by WTO Director-General Pascal Lamy, the world trading system must now find ways and means to unblock what is perceived as a danger to the world order. This article analyzes the legal and policy implications of the currently fatal Doha Round for the two main developed WTO Members, i.e., the U.S. and the EC, and the most relevant developing countries of the WTO. Payments To Medicare Advantage Plans Exceed Fee-For-Service Costs: Options For Medicare Savings From 2007 Through 2011, Brian Biles, Emily Adrion

Health Policy and Management Faculty Publications

The Medicare Modernization Act of 2003 (MMA) and the Deficit Reduction Act (DRA) of 2005 include provision intended to increase the role of private health plans in Medicare. These provisions set Medicare Advantage plan payment rates at levels higher than average costs would be in tradition free-for-service Medicare in every county in the nation. The total amount of extra payments to Medicare Advantage plans resulting from these provisions is projected at $5.7 billion in 2007 and nearly $30 billion over the five year period, 2007 to 2011.

U.S. farm legislation is due to be updated in 2007, to become effective with the 2008 crop year. Major questions surround the role of environmental or conservation provisions in the new Federal farm bill. In this paper, I first present some background on the evolution of U.S. 'agri-environmental policies'-policies encompassing conservation of agriculture's natural resources and agriculture's impact on the environment. I follow that with a brief discussion of the concept of' multifunctionality' in agriculture, a concept that increasingly is driving discussions of agri-environmental policy options in Europe and the U.S. The subsequent section of the paper contains discussion of …

Economics Staff Paper Series (1969 - 2017)

A two-year study of early vs. normal weaning of steer calves was conducted in the western Dakotas in 2003-04. Economic and statistical analysis of calf feedlot performance and carcass quality was conducted. The analysis concludes that early weaning improves feedlot production efficiency, and reduces per day and per pound feedlot production costs. However, early weaned steers are lighter at slaughter; therefore, early weaning lowers carcass revenue relative to normal weaning. The early weaning effect on the profitability of retaining calves through the feedlot stage was not statistically significant. However, statistical analysis indicates that early weaning does have a positive effect …

“Arrogance Cloaked As Humility” And The Majoritarian First Amendment: The Free Speech Legacy Of Chief Justice William H. Rehnquist, Edward L. Carter, Brad Clark

In his 19 years as Chief Justice of theUnited States, William H. Rehnquist voted in favor of the individual expression interest asserted in approximately one-fifth of the Speech Clause cases heard by the Supreme Court. Meanwhile, he opposed protecting those constitutional interests in approximately two-thirds of the speech cases during that time. (His votes evidenced both speech-protective and non-protective elements just more than 10 percent of the time). This manuscript analyzes the Rehnquist jurisprudence in comparison with that of his two immediate predecessors as Chief, Warren Burger and Earl Warren.
