The deminer was working in his clearance lane using a heavy rake to excavate the ground. The ground was very hard and use of the light rake was limited. At approximately 0710hrs an explosion occurred under the rake. The deminer was not wearing his visor correctly and as a result incurred facial injuries as outlined below.

This Article focuses on the current development-related problems in the global trading system. A widening income gap and widespread poverty among trading nations denote the WTO’s Gesellschaftian nature—interest and power—resulting in structural distortion and manipulation. This Article maintains that the global trading system can achieve its development agenda and become fair and legitimate only through a critical paradigmatic transformation enabled by the configuration of the “WTO’s Gemeinschaft.” This Article observes that a fundamental legal precept, the “Law of Nations” (jus gentium), plays a critical role in actualizing this communitarian telos. Analysis Of State Laws Permitting Intoxication Exclusions In Insurance Contracts And Their Judicial Enforcement, Sara J. Rosenbaum, Henry Van Dyck, Mandy Bartoshesky, Joel B. Teitelbaum

Health Policy and Management Issue Briefs

This Policy Brief reviews judicial decisions construing state laws that permit insurers to include intoxication exclusionary clauses in their insurance policies. The cases and state laws examined in this analysis span health, life, disability, accidental death and dismemberment (AD&D), workers compensation, and unemployment insurance. Some variant of the intoxication exclusionary clause appears across all of these products, depending on the state. The widespread nature of such laws has its roots in the 1947 Uniform Accident and Sickness Policy Provision Law (UPPL), a model statute whose broader public policy purpose was to avoid the use of insurance to protect against the …

A Model Of Animal Selfhood: Expanding Interactionist Possibilities, Leslie Irvine

Human and Animal Bonding Collection

Interaction between people and companion animals provides the basis for a model of the self that does not depend on spoken language. Drawing on ethnographic research in an animal shelter as well as interviews and autoethnography, this article argues that interaction between people and animals contributes to human selfhood. In order for animals to contribute to selfhood in the ways that they do, they must be subjective others and not just the objects of anthropomorphic projection. Several dimensions of subjectivity appear among dogs and cats, constituting a “core” self consisting of agency, coherence, affectivity, and history. Conceptualizing selfhood in this …

No News Is Bad News: Characteristics Of Adolescents Who Provide Neither Parental Consent Nor Refusal For Participation In School-Based Survey Research, C. Anderson Johnson, Jennifer B. Unger, Peggy E. Gallaher, Paula Palmer, Lourdes Baezconde-Garbanati, Dennis R. Trinidad, Steven Cen

CGU Faculty Publications and Research

Schools offer a convenient setting for research on adolescents.However, obtaining active written parental consent is difficult. In a 6th-grade smoking study, students were recruited with two consent procedures: active consent (parents must provide written consent for their children to participate) and implied consent (children may participate unless their parents provide written refusal). Of 4,427 invited students, 3,358 (76%) provided active parental consent, 420 (9%) provided active parental refusal, and 649 (15%) provided implied consent (parental nonresponse). The implied consent procedure recruited more boys, African Americans, students with poor grades, and smokers. This dual-consent procedure is useful for collecting some limited …

The Effects Of Ballot Position On Election Outcomes, Jonathan G.S. Koppell, Jennifer A. Steen

Publications from President Jonathan G.S. Koppell

This article presents evidence of name-order effects in balloting from a study of the 1998 Democratic primary in New York City, in which the order of candidates' names was rotated by precinct. In 71 of 79 individual nominating contests, candidates received a greater proportion of the vote when listed first than when listed in any other position. In seven of those 71 contests, the advantage to first position exceeded the winner's margin of victory, suggesting that ballot position would have determined the election outcomes if one candidate had held the top spot in all precincts.

School District Enrollment Forecast Reports

This report, prepared by the Population Research Center provides a medium-range school Enrollment Forecast, including background demographic information and analysis, for Lake Oswego School District (LOSD) and for its nine elementary schools, two junior high schools, and two high schools. The report considers several factors that are likely to affect the District’s enrollment between 2004 and 2010 and examines elementary attendance areas within the District. The most likely scenario indicates that there will be a slight decrease in enrollments between 2003 and 2010. Nebraska Farm Real Estate Reports

Nebraska’s agricultural land values moved sharply upward across the state during 2003 and into 2004, recording an average gain of 9.2 percent for the 12 months ending February 1, 2004. This average increase was the largest annual percentage gain in 14 years. And it followed on several years of fairly stable land values. Virtually all land classes showed gains, and in all areas of the state–even in areas of serious multi-year drought, where previous-year value declines had occurred. The highest-priced land in the state is now center pivot irrigated cropland in Eastern Nebraska as the market preference for this irrigated …
