Title Vii And The Age Discrimination In Employment Act: Should Partners Be Protected As Employees?, Colleen E. Medill
Title Vii And The Age Discrimination In Employment Act: Should Partners Be Protected As Employees?, Colleen E. Medill
Nebraska College of Law: Faculty Publications
In deciding whether a state law partner is an "employee" under Title VII or the ADEA, the test proposed by this Comment is as follows: (1) Did the partnership agreement create an "expulsion power" in favor of the partnership? If so, a rebuttable presumption exists that the partner is an "employee." (2) Assuming the partner cannot be expelled without cause, is this an "expendable partner?" Could the partnership afford to pay the partner the value of his partnership interest if he decides to leave? If so, a rebuttable presumption arises that the partner is an employee.
This test has several …
Protecting Shareholders From Themselves? A Policy And Constitutional Review Of A State Takeover Statute, C. Steven Bradford
Protecting Shareholders From Themselves? A Policy And Constitutional Review Of A State Takeover Statute, C. Steven Bradford
Nebraska College of Law: Faculty Publications
American business in the last twenty-five years has experienced an explosion in the number of hostile corporate takeovers. Attempts to acquire billion-dollar companies are becoming commonplace. Smaller takeovers barely attract the attention of the financial press. The likelihood of a tender offer has become another everyday concern of management, as much a part of the business landscape as sales figures and profit margins.
Proponents of hostile corporate takeovers argue that such takeovers generally benefit society and corporate shareholders. They provide a way to discipline the management of companies which are operating inefficiently or not returning the full value of their …

Returning To M'Naghten To Avoid Moral Mistakes: One Step Forward, Or Two Steps Backward For The Insanity Defense, Robert F. Schopp
Nebraska College of Law: Faculty Publications
The history of the not guilty by reason of insanity (NGRI) defense has been characterized by an extended search for a satisfactory standard. For many years, the M'Naghten test was the standard applied by the majority of courts in the United States. The M'Naghten test has been widely criticized, however, as being too narrow, over-emphasizing the cognitive aspect of personality, and artificially restricting the scope of expert testimony. In 1955, the American Law Institute (ALI) proposed an alternative standard as part of its Model Penal Code. Since that time, there has been a marked trend in many jurisdictions from the …

The Land of Norumbega - Maine in the Age of Exploration and Settlement.
An Exhibition by Susan Danforth, Maine Humanities Council, Portland, Maine 1988.
This exhibition began in 1986, when the University of Southern Maine received an extraordinary collection of rare maps, atlases, and globes donated by Lawrence M.C. and Eleanor Houston Smith. In 1987, in response to a call from the National Endowment for the Humanities for programs relating to the Columbian Quincentenary, the Maine Humanities Council submitted a proposal for the "Land of Norumbega" project.
Results Of Metal Detector Survey, Testing Operations, And Archival Studies The Wooten-Seale Plantation, Site 41rt362 Robertson County, Texas, John W. Clark
Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State
Preliminary historical and archaeological investigation of the Robert Henry Seale farm residences (41RT362) utilizin g a metal detector and limited shovel testing indicate that a recent owner of the property removed both residential structures, destroying the site and extensively damaging any buried deposits. It is the estimation of the cultural resources staff of the State Department of Highways and Public Transportation that the physical remains of the occupation of the property have been disrupted to such an extent that they now have no value in answering cultural- historical questions.

The State Department of Highways and Public Transportation (SDHPT) conducted archaeological testing on Site 41DW260 in DeWitt County during January 1988. The site is located along FM 3402 about 2.5 miles west of Cuero, Texas and extends from the north side of the highway onto private property. Testing has shown that the area within the right-of-way is a 20-25 cm deep prehistoric campsite where the primary activities were the reduction of fist-sized flint cobbles into usable flakes and the collection of freshwater mussels as a food resource. A total of 16 one meter squares were excavated into the narrow right-of-way …

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State
In January 1986, the Center for Archaeological Research entered into a contract to monitor construction for a sewer line for the San Antonio Wastewater Improvements Program. The primary concern was if the San Jose Acequia would be in the location of construction. Monitoring operations began in October of the same year and continued until January 1987. The acequia was exposed in three locations and proved to be an unlined ditch.

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State
Excavations at site 41 BX 1, located behind the Olmos Dam in San Antonio, Texas, were funded by the San Antonio River Authority. The excavations resulted in the documentation of a Late Archaic cemetery and Early to Late Transitional Archaic occupations. Thirteen human burials, accompanied by a variety of grave offerings, including deer antlers and marine shell ornaments, were radiocarbon dated 1680 B.C. (maximum date) to A.D. 260 (minimum date). In addition, two distinct occupational areas, horizontally separated from the cemetery, were investigated.
In conjunction with the excavations, final resource management negotiations resulted in mitigation measures of avoidance and protection …
